    • The 3 pieces of mortar that fell on the same day, at the same time, were approx. 25-30cm long and weighed around ½-1 kilo each from a roof that is above the 2nd floor; they were by no means tiny pieces of mortar but large chunks falling from a rather great height. I believe the size and weight is enough to cause serious injury and if it falls on your head, I assume it could potentially be lethal if unlucky, but we don't wish to put that theory to test... We can't in good conscience let a contractor install a patio and a gazebo as it is in the exact spot where the mortar fell, nor do I think anyone would be willing to take the chance. Looking at the roof, there are multiple other remaining pieces from the same 'line' or 'row' of mortar that can potentially fall. The mortar is right underneath the slate tiles on the neighbour's roof and I don't know whether the tiles are also (becoming) lose due to the loss of the mortar. I was trying to upload a photo but it seems it's not allowed. The first contractor to work in our garden in preparation for the patio and gazebo is scheduled to start on 10th June, that leaves the neighbour 5 workdays to sort their roof which is unlikely, so it seems we will have to postpone our patio contractor without knowing when they can come back. We have already had extensive work done in the garden in preparation for the wedding reception and it will become very costly for us if we have to move the wedding reception to a venue (if we can even get one at this short notice) rather than have it at home which was our dream.

Therefore I intend to issue proceedings against you in a county court without further notice unless you reimburse me the above amount in Full within 7 days from the date of this Letter     ------------------------------------------    I think its best if i hand him the letter as posting it might not get through so can claim expenses traveling up there ?   or would it be best to just post and get 'Signed for'  ?   Should i also put in the letter of claim interest added or leave that till the Particulars letter ?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Adding just so the thread can see the evidence first hand - Email sent at 5pm, Text message sent at 8pm. Also seems like a lot of other people have received voucher codes that are taking off £200-300 from orders, with their phone being even LOWER in price, or close to. They have no clue what they are doing

My current position is that the text message is an error and I assume no delivery will be made tomorrow and that I will be sending my letter of claim come Monday morning.

 

That 5% off against the phone I ordered at £1199 based on their standard pricing brings the phone to 1139.05 lol. Someone else who received the 5% noted it doesn't work on the Student or Employee discount portal

 

This just highlights how clueless they are with the whole situation themselves.

 

I also find it funny that they say "In accordance with our online store’s terms and conditions, where a pricing error is obvious and unmistakable (as is the case here) we are entitled to reject orders." but they themselves did not notice this for 10 days straight

 

Everyone has a different story though. Some ended up getting the phone, others like me haven't had official cancellation and then got a text message. Others still are allegedly saving more money since they were given £200-300 off vouchers, but who knows, Samsung may cancel those orders too. Easiest thing to assume is that its not coming and that I need to send that letter to them.

Hi there,

 

This happened to me as well. I bought a Samsung S21plus on 1st of November which was supposed to be delivered on 12th of November. I never received any cancellation until last night and it was after I called them asking about my delivery. Is there anything we can do as a group as they have been advertising falsely about SAMSUNG week and now they are refusing to deliver?

No there is nothing you can do as a group. It requires individual action from sufficient numbers of people and then a story in the press if a number of people are interested. We can put you in contact with a journalist.

However the first thing you should do – as you have probably seen on this thread – is to start your own thread because that will make it more prominent in the Google rankings.

Now that you have registered on the forum, please will you start off by posting your whole story on a new thread.

Well it's nearly 5pm. Safe to say, as assumed that the text message they sent about delivery on the 14th was a lie.

 

When sending the letter tomorrow, is there any difference between recorded delivery and special delivery?

Now register an account with the county court money claim website and start preparing your claim. You can save your work as you go.

Make sure that you identify the entity with whom you made the contract correctly. This is an error that many people make and the defendants then start introducing that as a technical obstacle and it destabilises inexperienced claimants.

At some point in the money claim process you will be asked to give information about your claim. This is essentially the particulars of claim.

Post up the draft of what you are going to say here so that we can check it.

If you have read around, you will find that the important thing is to identify the cause of action but other than that give very minimal information. This forces the other side to disclose their position in their defence and you remain with the upper hand.

They have an official delivery address which I used, sent to their executive office

 

Their support team (who are clueless) have responded to my prior message to them on Friday, asking about my complaint. Do I risk my position by giving them more details to see what they say, should I just go silent or respond

 

I've already sent my letter of claim to them.

They already have full details of your complaint. You'll find that your latest message has just gone to the back of the queue again and is being treated as a new issue. It's a merry-go-round.

You send a letter of claim – that basically says it all.

The most important thing is that you identify the claimant correctly. Address is very important as well of course but you will find that Samsung has lots of little companies with similar sounding names.

You need to check the name of the company that you actually contracted with – which sold you the phone.

I received the phone earlier today. Seems they've started to send phones out that were dispatched and refunded those where the dispatch notice was not sent out

 

I got an email from an executive officer last night who did indeed reference my letter of claim even before receiving it. I spoke to them on the phone in the morning not long before the phone arrived.

 

I was given £75 compensation for the ordeal in the form of a partial refund to my order. They originally offered £50 but I asked for more due to time wasted and the headache of sending accessories I bought back
