      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Best of luck with GE - I'm also heading to court on a DPA with them, the defence is nothing short of ludicrous and will be extremely easy to shoot down in flames!

Ohh well the battle Continues..lol

 

GE Had till yesterday to submit defence, Just phoned court this morning and they submitted defence yesterday afternoon, Will have to wait now and see what their defence is so I can rip it apart..lol

Well I have now recieved a copy of their defence from their Solicitors Eversheds, To be honest they Contradict themselves a couple of times and try to pass the buck, But that is only to be expected from them.

 

Will be working over the next week or so on my response etc and will get it off as soon as the stamped version of their defence arrives from the court.

 

Hopefully now things will start to move a bit quicker..

 

Oh and any Legal Experts Give me a shout..would be appreciated..

Hi Chris,

I pressume you sent it Recorded Delivery to them ?, Once the 40 day time limit has passed I would give them 2 extra days to allow for Post etc then if still nothing I would fire off a Failure to Comply notice under the DPA. That might get them to get the finger out of their Butt so to speak. You can also of course Register a Complaint against them with the ICO, I did and it did get a reaction..lol

PS: If there's anyone who hasn't got their original GE loan/PPI agreement and who wants to get an idea what they look like, PM me and I will post a copy of mine (circa Feb 2005). One thing that's a quite interesting is that the PPI is included in the total credit rather than the charge for credit!

Settled after first LBA - now that's what I call cooperative!

hi chris here good to see you are still about i got a bungle of dpa papers from yours truly ge money noted direct debit charges also other charges for early settlement a lot i mean a lot also solicitors fees deed fees redemtion fees extortion wil i have to calculate all mentioned to try to proceed to make a claim any advice appreciated chris /thankyou:confused:

hi reidnet can we ask administrator to maybe set up seperate threads for each company and we can post our details per company and maybe use each others details to use as evidence that we all faced the same tactic of mis selling.... mine is with welcome and I would appreciate if any other welcome customers who where told no insurance no loan ... then we could utilise each other against this loan shark!!!

Only direct action by the masses will work....

 

Look at all successes they have never come from negotiation!!!

Just a quick update, Got copy of GE's AQ, they disagree with Small claims and want the case to go Fast Track, Now I think this is simply them using their Bullying tacticts yet again as they either hope I will drop out with the thought of them being awarded costs etc. They have propossd a court date of around 23rd November 2007.. I Dont ..%44^^$$ Think so.

 

Well I will now be passing this latest bit onto the National Press, One National Paper are keen to take up the case on my behalf, Just to highlight how these companies think they can walk all over Consumers and use their Bullying and Scare tacticts to cover up their mis-selling.

 

Will just have to play the waiting game yet again to see what the court decide, After all it is the Courts decision which track the claim will take and not that of GE Money.

 

IMHO - If a document is passed to you for signature that already has the PPI box ticked, this does not in fact make the PPI optional ?

GE money have been fined £610,000 by the FSA for mis-selling PPI. Take a look - lots of info. for your claim I'm sure! :D

Hi Ian, nice to here from you, al though not good news, you've got them taped, thats why there are using bully tacticts. November's a hell of a time, don't know who they think they are, they make me so angry, Im sick of them too, as you know my x was put in the box which is pre assumptative selling of the PPI and they quoted the repayments to including the PPI. Please pass any info you have on the Press the more publicity the better for us all. And it can only help with your case it would be great if they take it up for you.

G E are so big they think they can frighten and bully us, but not anymore its my mission to get the b---- ( I word I never use) before I die

Well just had another long chat with one of My advisors from CAG..lol

 

GE Want a fight.. then they can Bloody well have one, and if they want to act like the school bully they will get even more bad Press on that tactics.

 

They think they can Dictate to the Courts, well we will just wait and see what the Judge says all in good time.. Obviously their AQ was written by the same muppet that wrote their Defence..
