    • You can't, but you can (and really should) bring up the point that the lender isn't meeting their legal obligations in selling the property for fair market value. You'll have to do this in court, though.     A receiver is bought in by the lender, not you. If they're a registered insolvency practitioner, you may be able to raise a complaint to the insolvency service but there are no guarantees here.     • Lolerz - I don't understand you.  Rebuked you?   No. I simply replied to your orange comments with legal facts as I know them.  I've already worked through the s42 and s146 issues - over the last 3-4y - and these issues are (mostly) resolved legally.  In terms of posting evidence.  Sure I can post some.  But my most recent questions have been a) how can I enforce a sale before trial?  And b) how can I make a complaint and/or a claim v receiver? (E.g. to which body do I complain?).  At the mo I'm asking for some helpful pointers on those specific questions??  I'm not asking for help with how to prove or present evidence. Fwiw - all evidence for trial has been disclosed (although additions are poss). The lender sent me like 10,000 emails and docs.  There's also 000s of emails, docs, photos, videos, recordings and texts that relate to freeholders/ me.   I read, filed and categorised everything for ease of future reference.  Witness statements and evidence were prepared for trial in the 42 and 146 matters. (now joined with current claim to save duplication).  I've lived the process before.  My current statement and linked evidence has taken like 6 months to draft/ write - to ensure I can succinctly prove my defence and counterclaim points.   Whether I can convince a judge at trial w/o lawyer / barrister is debatable 🙄   But I've prepared.  And continue to try better prepare - which is why I visit this site (and clinics).  This is NOT my business or expertise at all.  I'm just trying.  Not that anyone should ever have to justify why they need help if they ask politely!

    • It doesn't use the word reconstructed in the cover letter.  Although, I have just noticed on the cover letter they have asked me to complete a financial statement and offer a repayment within the next 10 days, or they will continue to follow court directions.  They sent a separate letter on the same day advising me they will be continuing with their claim ?  They have done the same for both claims.  Is it worth just doing that - doing the financial breakdown and offering a x amount.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

1st credit [now intrum] were masters at using an SD as a debt collection tool years ago

seems like they are hoping the court will not realise they are upto there old tricks again under their new name intrum.

 

they got told off for doing this then and that's why they stopped

they will tell you what to do.

Thank you very much, I posted in the afternoon special delivery, they should get it by 1 pm.

 

Talked to solicitors today,

they're not sure if to try to get the statutory demand aside within 18 days, 

because Intrum will have 12 days to deliver the CCA.

 

He also said that for the court won't be enough that Intrum can't provide the agreement.

And he said if to wait 12 days and then try to ask the court to set it aside,

will be too long,

usually it's only asked few days extension, 

if there's bank holidays.

the court don't even know the SD has been sent.

 

1s credit [intrum] in most cases will just drop it once they can see you know you know your onions

and even if they don't you simply put on the form the examples of the 6.4 / 6.5 that are already in those threads..9/10..the claimant has failed to comply with my cca request etc etc.

You have yet to give us the date that is actually on the set a side....and you came here for advice with just 7 days remaining of your 18 days to set a side...so very little we can do with regards to the time frame.

 

You are not waiting 12+2 days to submit your application.Its irrelevant when you make the CCA request although the earlier the better but in your case I can assure you that Intrum wont be able to comply on an agreement that's 20 years old after you submit it by this Friday , by the time your application is processed they will be in default of your request (12+2)...it will probably take the court 3 weeks to process it and set a date.

 

There are other numerous reasons to set a side a stat demand...none compliance with a CCA request being just one.

 

Hope you didn't pay for that Solicitors advice.

I am just worried that what solicitor said, that it's not enough to ask court to set it aside just because the creditor can't provide me with the agreement 🤔

 

Good morning, thank you for the advice.

I didn't pay solicitors fee, he was talking about setting upside demand at court, only  he was not sure if to wait until 12 days of CCA request expire or within 18 days of statutory demand. 

It looks that better I apply to court within 18 days because you never know Intrum can file bankruptcy petition.

The person on the statutory demand has worked for 17 years for first credit now Intrum  and bankruptcy is endorsed on LinkedIn.

I really woundnt want to get to that.

my account was opened in 2008, but Halifax sold it to Intrum in November last year. Account is only 11 years old.

there were 3 other debt collectors demanding to pay the same debt: Robinson way, CSL and Moorcroft.

 

The demand itself and its envelope are not dated. But the server sent me a letter first class saying that demand will be delivered on that day unless I rearrange with him, if not, it will be served anyway. 

Intrum used server, they didn't do it themselves.

Than you so much, it's really reassuring.

 

so far where legal help from different agencies, insolvency practitioners and solocitors I got;

- go to CAB (that was from gov legal aid after million paperwork and call assessments if I qualify); you will definitely go bankrupt if you don't pay £9000; sign IVA with me and sell your house within a year because bankrupt will cost you at least £70000; if I don't try to set aside your statutory demand, even though i cant promise anything, you will definitely go bankrupt; pay me money first and then I will see what I can do.

 

Very strange, everybody so far, except here, were threatening me with bankruptcy, if it's not enough I have the most horrible agency threatening me

And yes, all solicitors said, it will not be enough to set aside statutory demand at court only because DCA couldn't provide you with credit agreement, if you pay us from £700 to £2500 plus VAT upfront (quotes from different solicitors, even though most of them were advertising no win no fee) we will try to set it aside.

Right - Thing is these DCAs chance themselves on the purchase of these debts. Some they win, some they dont. 

Intrum have been slapped around like a fish before for certain things that they did in the past. 

 

I speak from experience - These companies prey on your stress and vulnerabilities you found that out before you came here. Dont get me wrong, you may succeed - You may not - But you are in good hands here and CAG will try to assist where we can.

Solicitors vary - I understand why you went to them. All you have to understand is that Intrum are not the same as other companies. They specialise in Debt and its all they know in reality...

just follow the advice you are given

and sty away from CAB, their advice is increasingly getting more dodgy recently.
