Still no joy ringing.

 

Just wondering, if it was issued in May17, why havnt they sent bailiffs round as that’s a fair few mnths to pass

 

Or gone back to court and asked for that to happen at least

May have overlooked it...not all judgment claimants execute CCJs.

cause cabot rarely do.

as they don't want the surface scratched of their flaky speculative default judgement

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

Morning all

 

got through to the court. Really helpful

 

I had an account with “shop direct” in 2010 and it was idle until capquest bought the debt in June 2014.

 

Then nothing was heard until capquest applied for a CCJ in April 2017 and it was issued in May 2017 against me as I didn’t turn up.

 

The address they have on the court forms I moved away from 5 ish years ago

 

The court hasn’t heard anything since then ie bailiffs etc from capquest

 

my options are ring their solicitors and find out about paying it.

 

If they refuse instalments then I can apply at the court to have them forced to take X amount a mnth

 

Or do I ring shop direct whom it states on the CCJ says shop direct

which I can only think of as very.co.uk with the account number I was given and find out last payment to see if this is statue barred

 

Advice guys?

 

I also received a text from Cabot asking me to ring them this morning as well which is a first

 

So are Cabot and capquest the same?

In all honesty I don’t know,

however when I rang I had to give an old address to shop direct,

the same address of what is listed on the CCJ, but this was incorrect.

 

The address they have is the one previous to this.

 

So they have the address in which I took the account out under, and then the address I moved to after

 

I’ve moved twice since then and never heard a thing

When you complete the N245 it requires you complete the contained I&E...your payment proposal will be governed by your expendable income.

Overthinking....if your I&E dictates you can only afford a £1 a month ...then a £1 a month it is....hence the importance of the N245...once its been processed by the court the claimant cant circumvent

Is this my income or joint. Reason being I’m a carer for my disabeled wife so do I take her disability benefits into it
