please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

If you are absolutely sure about the one-hour limit - then you can sue them for £750 for breach of your GDPR as you had done nothing wrong and there was no reason for them to approach the DVLA for your personal details.  Then they misused your details in the most serious way possible in a vexatious court case.  Have a think about if this is an avenue you want to go down, and if so come back to us.

I have just read your good news. Well  done it is not that easy to stand up in Court and defend yourself.

 

Dave is right about going for breach of GDPR. I have read recently that such breaches can achieve amounts from £2000 to £6000 according to some websites.

I would write to Highview pointing this out and saying that you intend to take them to Court for the breach and what the going rate is. Obviously you would love to win again and make a laughing stock out of them for taking you to Court on a case they couldn't win. However as you recognise that you would be wasting the Court's time as they had done by bringing their case perhaps they might be willing to agree to settle  out of court which would spare their blushes at the very least. 

 

In that vein you could suggest a figure of £3000 and avoid a much greater cost should it go to Court since the breach was so blatant.

For how much they have inconvenienced me and other people I am more than prepared to go for a knockout blow against them.

 

@FTMDave What would I need to prepare? Also you have said that "if I am sure about the 1 hour limit" please could you elaborate?

My thinking is that if you can prove the parking limit was an hour and a half, and you stayed less than that time, then the fleecers really have no defence.  It's an easy win.  They should never have approached the DVLA for your details.

 

If you can't prove it then things are not so certain, the fleecers could lie and pretend that the limit was an hour, and that the photo their representatives sent you was an administrative mistake.

 

If you want to go down the GDPR road we have experts who have done this sort of thing before, from what I've seen it's very easy, Letter of Claim, short Particulars of Claim on MCOL and then hammer them.
