Folks, need some guidance on if there is a chance to appeal on overstay in the car park by few minutes a couple of times has been sent to me as a 2 PCNs so far. My bad that I overstayed but is there any leeway here or I have to cough up £60 x 2 times for 2 contraventions. Here are the details:

 

1 The date of infringement?
Answer: 05th September 2023 and 07th September 2023 (2 PCNs)

2 Have you yet appealed to the parking company yet? [Y/N?] 
Answer:  I haven't appealed yet.

have you received a Notice To Keeper? (NTK) [must be received by you between 29-56 days] - Yes

what date is on it - 08/09/2023 and 12/09/2023, respectively.

Did the NTK provide photographic evidence? Answer: Yes

3 Did the NTK mention Schedule 4 of the Protection of Freedoms Act 2012 (PoFA) [Y/N?] 
Answer:  There isn't any mention of Schedule 4 of the protection of Freedoms Act 2012.

4 If you appealed after receiving the NTK, No

did the parking company give you any information regarding the further appeals process? Yes

[it is well known that parking companies will reject any appeal whatever the circumstances]
Answer: I haven't appealed yet.

 

5 Who is the parking company?
Answer: MET Parking Services Ltd.

6. where exactly [Carpark name and town] did you park?
South Ruislip ASDA, (840) Arla old dairy

There is no point in appealing - MET are well known here, an absolute disgrace of a company who deliberately set up the car parks they "manage" to entrap the motorist.

The good news is that Asda are much, much better, and we've seen them call off the private parking companies and get tickets cancelled on many occasions.

Can you please scan & upload the two invoices you received?

A few minutes? One ticket was 26 minutes over and the other was 96 minutes. There is a grace period of ten minutes so we might be able to do something with the remaining 16 minutes but you will be hard pressed to get Asda to quash the  hour and almost 30 minutes overage unless your total spend was over £100 and/or one of the people in the car was disabled. I know that staff shortages are sometimes  causing  delays at the cash out counters which could account for some of it. Is there another reason why you stayed so long on the second visit?

The PCN could be classed as not compliant with the Protection of Freedoms Act 2012 which governs private car parks but if it went to Court Judges would take a dim view of the amount of the overstay.

The good news is that I can't remember a single case when Asda were not cooperative and didn't get the ticket cancelled.  Lay it on thick about being a genuine customer, attach proof of purchase, etc.

However, as LFI says, taking nearly seven hours to do the shopping is pushing it a bit.

I must admit I left my car in the charging there where I went locally to a friend's house. Was stupidly trying to maximize charge timing incorrectly assuming time limit is not enforced. I think I have to pay up now.

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...
