    • quite honestly id email shiply CEO with that crime ref number and state you will be taking this to court, for the full sum of your losses, if it is not resolved ASAP. should that be necessary then i WILL be naming Shiply as the defendant. this can be avoided should the information upon whom the courier was and their current new company contact details, as the present is simply LONDON VIRTUAL OFFICES  is a company registered there and there's a bunch of other invisible companies so clearly just a mail address

    • You can't, but you can (and really should) bring up the point that the lender isn't meeting their legal obligations in selling the property for fair market value. You'll have to do this in court, though. A receiver is bought in by the lender, not you. If they're a registered insolvency practitioner, you may be able to raise a complaint to the insolvency service but there are no guarantees here.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Im trying to be proactive regarding some letters im receiving from Cabot but i cannot find a recent SAR address for MBNA?

 

Does this one look current? I found it on thread dated from 2007, thats my only concern.

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Skanker, I am also going to send SAR to MBNA. Did you find out which address is the correct one please?

 

Also another question regarding MBNA SAR, Can I sign the SAR with a 'new' signature (different than my usual one) so I protect myself regarding them using my signature to insert the signature to my original credit card agreement as currently when I requested CCA regarding this card they did not provide me with a signed copy of the card agreement.

Any thoughts anyone about this: Also another question regarding MBNA SAR, Can I sign the SAR with a 'new' signature (different than my usual one) so I protect myself regarding them using my signature to insert the signature to my original credit card agreement (2006) as currently when I requested CCA regarding this card they (collection agency) did not provide me with a signed copy of a card agreement. I don't think I have ever signed anything with them so I guess this will not make any difference only a chance for them to make the mistake to use my 'new' signature to insert to the agreement and this way they will be in trouble.

You do nothing as yet, barclays have 40 + 2 days to send the info and you only sent yours on 5th march

This is the correct address for the Data Controller at MBNA. As per the Information Commissioners Office website; Register of Data Controllers!

It's all in the postcode and; do not use their PO Box number.

I did already and I used CH4 9WW. I sent it recorded...The idiots from MBNA over the phone told me to use the address with the PO Box. It has been received and signed by them already so hopefully it will get to the correct department. it seems all departments are situated in the same building anyway. I gave them 10 days to write to me if there is a problem...I will let you know from what address/post code they have responded to me.

Well, the left hand never did know the difference from their right...

They should know the registered address of their own Data Controller: as registered on the ICO register!

And a PO Box is insufficient for such an important legal request.

 

Anyhow, good luck; wonder if Vernon is still hiding in the DPA/Data dept?

Thank you angry cat. I called 'idiots' the MBNA people I spoke to. I called them twice and twice asked them for the address and explained to them why I need it and they kept me on hold and asked supervisors etc... I even mentioned the address with 9QQ post code and they still gave me the address with the PO Box. I even asked them 'Are you sure?'...and they said 'yes' lol

 

Once I receive any response I will update you.

ha, as angry says, its all in the postcode. they also use the box address for their complaints/contact us! but then give 9FB for their 'customer advocate' re complaints. all neighbours!

but, dont worry, it will get where its supposed to be. its been signed for. and you did what they said. otherwise, good grounds for a complaint :)

On the 5th March this year i sent off a SAR request to Barclaycard which i can confirm was delivered on the 8th March. Unfortunately i've had zero response back from them and im now on day 43.

 

Can someone please advise as to what i can do regarding this?
