      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Are there to be any public meetings UK wide for the public to attend to discuss the EU issue ?

 

I would hope there is. A debate from both sides but giving factual evidence, not speculation would give the public some ideas of where to stand. The problem with politics is that all we minions get is what they (the powers that be) want us to see, not what is important.

Keep it secret until/unless there is some political gain from releasing it and go berserk (in parliamentary terms) should anyone dare to release it to the unworthy plebs (err populace/voters)

I think ever since Tony Blair was blind sided by an audience a few years ago, politicians only speak to "invited" audiences. I would imagine that anyone who applies for a ticket would be vetted from beyond the womb !!

Went to a protest as usual 70,000 there in Manchester.

Burnham was there.A nice chap walked for mile after mile holding a banner defending the NHS.

Strange how you see these politicians on the telly.Powerful,a aura about them yet when close up they are really humans,not ETs

Approachable,just have your say if ever close to them.Steady now, some of you would, and when you look in their eyes you see vulnerability.I suppose i mean human.

On a serious note, how would I find out where any of the leaders are going to be at any public given time so I can question em..

 

A good question.Are there to be meetings regionally about this.

So they can be grilled.Many must want to put questions to the politicians.

A very important matter.And time goes quickly.

Of course, they can check me out (I understand that) but to unreasonably deny me or anyone their right to hold public servants accountable and then use the threat of terrorism as the reason for any refusal can not be allowed to happen..

This is the EU desperately resisting allowing Turkey to become a member of the EU while still trying to get Turkey to control the migrants coming through.

 

Even more reason for an out vote.

 

Remember Germany told all these illegal migrants they are welcome despite EU rules and law.

I have not realised this had happened.The deal.And how widely known this deal about visas is in Great Britain

This will unsettle many who are considering how to vote surely.When this news becomes widely known.

It got me flapping a touch when i read it.

 

I would suggest people read that article,take it in and have your say.How you feel about things.

So the map of Europe would be up to Turkeys border.If they came in the EU of course.

But before that could or may,may not happen ,they have this deal with visas,good grief.

Wonder what country borders with Turkey.

But i might be looking at things wrongly of course.

I have followed these shenanigans over the past few days and these come to mind.

add to that that the Bankers are all in the UK not primarily to benefit from trade in the EU, but to benefit from the UK's protection of them from EU regulations (like pay limits) while still allowing them to trade with the EU at the UK taxpayers risk.

 

It is the only real concession Cameron got - protection for the city of London financial institutions.

The main risk is an economic heart attack affecting the UK and world markets for many years. Brexit could be the heart attack that leads to unintended consequences, with the collapse of the Euro and EU, pound sterling going on a rollercoaster ride, stock market falls, pension fund earnings reduced, changes to UK debt interest.

 

Some ( e.g Mervyn King ) are already predicting another major financial crash, as the Banks have not really recovered since 2008. Also the shadow Banks are carrying massive levels of debt. It is possible the next crash could be worse than 2007/08.

 

Would you vote Brexit, even if you knew there was a big financial risk, that could affect you and your family for years. Is independence from the EU so important and beneficial in the long run to the UK, that it is worth taking the risk ?

We could do with some help from you.

I broadly agree with all that unclebulgaria, BUT

Being in the EU (or out) will not protect the UK taxpayer from the fallout from these UK based banks, even if theose same banks and financial institutions pay Fanny Adams tax here.

 

Being in the EU will not protect the UK from increasing migration and the vast surge that WILL occur as Turkey gets its way. What worth building 156,000 houses a year (2015 figures) when net migration is 300,000+ a year and rising even now.

The pound may fall, but so will the euro.

 

Stock markets falling will affect pensions only 'on paper' and for those who take their pensions during the collapse - just as is always the case, and financial fall deflation is as likely to help the poorest in cheaper essentials.

 

Big businesses who pay nothing in tax while enjoying UK protection from EU regulation want us to stay in, but small businesses more want the preferentially treated big businesses out of their matkets.

Perhaps that would cause some price rises, perhaps even more than the falls which would result, but the tax and income would remain in the UK

 

 

We cant really do much about the financial institutions, so migration is THE big issue.

Why vote Brexit to trigger a possible heart attack ?

 

Surely, it is up to the government to assess risk and recommend to British public what is best ?

 

They are advising people to vote to remain.

 

If independent economists start to issue warnings, we would be mad to ignore.
