      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Paul,

 

I had this very recently, had a visit in August and did exactly what you did, signed the form etc.

 

 

Got a summons in Jan because admittedly after signing his form I missed a couple of payments.

 

 

My next payment was due on 3rd Feb to pay £58.20 which would have been that years licence paid in full then the court date was set for 13th Feb .

 

 

So I e-mailed and explained the above and that I had been having some financial difficulty etc and I got an e-mail back to say any further action was cancelled.

Maybe you can try and e-mail them but I think you will probably have to pay what's outstanding first.

Just paid the amount we are behind today.

 

 

...i am outraged at the way they can threaten court and imprisonment,

thinking of sueing them myself for distress to me and my family,

it really is horrendous they think they can have this power over people, disgusted!

 

 

Plenty of emails sent but whilst they cause stress to me over the weekend they arent at work so hope to hear back from them tomorrow!!

You can't sue them. As there's actually a law that says they can do that if you don't pay.

No. Its legal for them to come to your house and ask to speak to you to check. However you are under absolutely no obligation to answer the door to them or provide any information. Your problem is you did, you signed that form and so the whole game changes.

The simple way to avoid the tv tax is to watch catch up TV, then you don't need a licence.

 

Although £4 from every licence fee payer the government is using to fund their ''super fast broadband'' rollout throughout the country.

And their (BBC's) weekly taxi bill which is circa 33k a 'WEEK'!

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

So it's totally legal for them to come to my home and threaten to lock me up but it's totally illegal for me to actually speak!! Great!!

 

can you let me know how things worked out??? we just got a summons and have similar circumstances.... So for one day in court my husbands loses a days pay and gets fined ... super...

I would suggest you try contacting them and making the overdue payment, that's what I did and court action was cancelled and did not get a fine

Thank you myfamily!!! I will let my hubby know and hopefully thats all that will happen... its strange because our records show we are up to date but back in Nov. we had that visit from the door stop collections and my hubby did sign fingers crossed!!! :) thanks

Yes, I personally used the contact us form on their website because I was too scared to phone, either way is up to you.

 

I was very apologetic etc too.

Thank you Myfamily!!! I will let you know how we make out... they are only open until 5pm and wont talk to me on the phone my hubby is at work... so maybe the contact us on website will be better... he can sort it in evening when he is home!!! thanks

They only take you to court to scare others into paying it. It's sickening that BBC bosses are now saying that you should have to pay the TVL even if you have a smart phone as that could be capable of receiving TV broadcasts (Doens't even have to be from the BBC!!!).

 

I don't plan to pay when I move to my new flat. I don't watch TV after their plans to axe BBC3, and because of Top Gear.

 

Almost the same as protection money to the mafia.

I have lots of devices that "could be capable of receiving TV broadcasts", not least 6 TV's, but smart phones, consoles and the internet.

 

No TV licence though as I don't watch anything "live", so the BBC (and their Crapita goons) can do one.
