  1. Thank you Myfamily!!! I will let you know how we make out... they are only open until 5pm and wont talk to me on the phone my hubby is at work... so maybe the contact us on website will be better... he can sort it in evening when he is home!!! thanks
  2. Thank you myfamily!!! I will let my hubby know and hopefully thats all that will happen... its strange because our records show we are up to date but back in Nov. we had that visit from the door stop collections and my hubby did sign fingers crossed!!! thanks
  3. can you let me know how things worked out??? we just got a summons and have similar circumstances.... So for one day in court my husbands loses a days pay and gets fined ... super...
  4. just as an update.. . we have been 2 times already to court both times the solicitors. . Earlswood have failed to wait the proper amount of time as stated by court I am not sure what it is called. .. but it has been rescheduled 3 times.. . today we just got in the post that Britannica has instructed Earlswood to not go any further and the application for charging order to be withdrawn.. . so if any one wonders. .. it pays not to just roll over and let these big companies walk all over you!!!! :)
  5. I do have one more question... can we just send a letter to the judge instead of going and my husband missing another days pay??? which could be spent on the debt!!! yesterday when we went even the judge didnt know why we were there.. do most people not attend these hearings??? just confused!!

  7. Thanks! they may get the FCO but what are the odds of them doing a forced sale... while we are continued with the repayment plan as set up??? sorry guess I just need some reassurance!!!

  9. well yes the judge is always right! but its not proper for a solicitor to be doing that is it???? just wondering... when you said the defendant fails... does that mean we have no chance of keeping our home??? or just stick to the agreed repayment plan.... we do have that and we were advised to let the court know we have entered into a plan ... is that right???

  11. yes we are going back... and we did bring this matter to the judgese attention and he said it wasnt his place to deal with a matter like that??? sounded off to me....

I believe that the original date was 3rd of May.. . and yes I believe he did because he made an offer to pay and there was no response ... if there is any equity it is very little,.. .. our mortgage is in arrears.. that is being taken care of hence my prior help from CAG!! . .. we really want to be prepared the next time we go in front of the judge.. . yesterday was a waste of time.. . but. .. we sat in the waiting room before going in to see the judge and the solicitor from Earlswood. .. the firm used by Britannica.. . sat next to another solicitor friend not related to our case ... and was showing him my husbands paperwork. .. isnt this a breach of confidentiality??? if so who can we complain to??? because my husband had to take the day off for a wasted trip the judge told him to get a statemen t showing how much he lost and it would be reimbursed .. now I dont know if its just taken from the balance or what.. . we will see... we just want to have all the right paperwork in hand for a proper defence!

Hi Crazy Brit is my husband ... the house is registered in just his name. .. the reason I am doing this is information gathering for us and I have the time while he is working. .. financially things have been really bad and we are just now bringing in some money to clear these up and Cag has helped us before tremendously so I am back for some guidance.. . thank you for your quick respnses to me! I am sorry I dont understand what all the terms mean... FCO???? the hearing was adjourned because there needs to be 21 days? waiting period for the creditors to respond??? and only 14 had elapsed so the judge adjourned for another 28 days. . I am hoping that makes sense to you!
  15. Help.. . I dont know where to begin.... My husband had a MBNA credit card that he fell into arrears in the recession.. .. it has been sold on and sold on and now Britannica have it and they are in the process of ? charging order... they have done the first step and now are going for the next level... . we just dont know where we stand what are our options can anyone shed some light on this for us??? my husband is trying to work a deal of repayment.. .. we need to keep our home can they force us to sell??? we just dont understand all of this.. . I am sure this needs to be posted elsewhere but I just dont know where!!!! Thank you!!!!!
  16. does anyone else have any suggestions???? we have called and also complained to Santander... they just feel they are in the right going back and ignoring the judges order.... maybe back to court???? we are up to date on all repayment according to judges order we are just frustrated ... help anyone???????

I cant find this anywhere sorry... in Feb of 2011 we recieved a suspended repossion order.. the repayment was difficult to keep up with... we have since been back to court 2x with new judgements... my question is.. we have kept up with the latest and the Mortgage is through Santander and now we are getting letters from their solicitors HL Interactive referring to original order. We understood that because we went back to court the most recent judgement is what we have been following and according to that we are up to date.. can anyone advise please???? ThNK YOU

  20. Ell-enn, I was thinking I would have heard back from you by now.... would you help me compose a complaint letter to Santander???? I can try but I dont know if I will use the right wording! Thanks
  21. I was wondering the same thing Ell-enn, it just seems they are out for us no matter what... I would like some help on composing a letter... when we talked to Santander they told us one figure... then they called HL while we were there and HL told them something completely different. We went by the amount sent to us by Santander on the yearly mortgage statement clearing showing 2012 monthly payment. That is the figure we used in the past as the Contractual monthly payment, the one we used on the budget form and we were never advised otherwise... just so frustrating.... we have also never received anything from them yet stating that they acknowledge the courts judgement. And I guess my question is does this all fall under the unfair charges that they charge for accounts in arrears??? I read something from Bankfodder but i couldn't quite wrap my head around it!!! It just doesn't seem fair that the monthly payment changes every month... will the stress ever end???

  24. I am sure this is addressed somewhere on here but I cant seem to find it... can anyone help me??? Long story short.. . we have had eviction set aside by going to court and getting a judgement of current monthly payment plus £80. we paid that the first month and then got a letter from HL interactive the solicitors for Santander... .. that we have underpaid.. . seems to be that the solicitors, HL interactive, are charging us interest on our arrears also... . When we enquired at Santander they knew nothing about it... . is this legal can we do anything about it??? it was never done before and it just seems all they want is our home now because its not in negative equity and they can make some money on us..... HELP!!!!!!
