    • Thank you BankFodder. I will do as you suggest to get everything in writing first and will construct the letter of claim over the weekend. Is it best to use the format for the letter of claim as the one on this website? Lastly, did I read the judgement correctly for the Farooq judgement as its not quite clear to me which act I am covered best by?
    • A letter of claim can't be served by email as per CPR 6.3 unless you've specifically told them. Also can't give you 7 days to pay, they've got to give at least 14 days. They know this, they're just hoping you wet yourself and cough up. This won't be going anywhere. IGNORE.
    • Good Morning, I received a speeding ticket last December, I had requested further information from the ticket office which they provided, I also sent back the form confirming i was the diver at the time, however, i had overlooked the signature at the bottom of the page, nobody from the ticket office got back in touch to mention this and i was trying to book a course with no luck, I got in touch with them and sent them a screenshot showing them I was unable to book the course, they came came back to me and said we have no documents to say you were the driver (they did they just failed to mention I never signed it) they re sent the form and it was over the 120 days, i had mentioned to them previously that the timeframe was coming up and they would need to extend this. They are now saying they have complied legally and i need to accept the 3 points, I am trying to plead my case and I am tempted to let this go to court and provide the evidence of my constant communication on the matter. has anyone got any experience with this? TIA.

    • Just on bankfodder's final point above. The Title Register you get online for £3 can't legally be used as proof of ownership for the property. Right now they'll suffice to see if there's an asset there. Should you need to use it in court to say he's trading at that address, you'll need to fill out an OC1 form with HM Land Registry to get an official copy in the post, which costs £7.00. Make sure that you get the Title Register, not the Title Plan! Title Register will tell you who owns the property etc while the Title Plan will tell you the property boundaries etc which isn't relevant in this case.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Had a contract with Vodafone that was ending

 

I called and went on a rolling month by month until I decided on a new contract.

 

I then decide to go to orange for whether deal.

 

I called Vodafone

To ask for the PAC code as I would need to unlock the phone ,

I was told this would not be given until I paid the outstanding balance of 52 pounds

I did this by debit card and was given the code.

 

I also asked her to confirm I owed nothing else which she did.

 

I received a letter from Vodafone saying I owed 182 pounds ,

I called them and explained the breakdown of the bills I paid

then explained the conversation I had regarding the PAC code

 

at this point he said there is nothing he can do

and its gone to a debt agency then hung up!

This was in 2013

 

I have received many calls over the months

I explained the same as I have here at first

but since then I have had four different agencies and ignored them

 

.I have received a letter from the county court in Northampton...issue date 22nd of Jan

 

..can anyone pls help

 

the amount has changed from each Agency and

 

now is over 250 with a solicitors charge from Bryan carter!

Hi I'm not sure tbh I could ask the bank its been a while.

Can I ask Vodafone for all the phone conversations ?

Should I call Bryan carter and explain this or would that be pointless?

This claim is for 182 the amount due under an agreement between the original crediitor and the defendant .

 

This debt was assigned to /purchased by lowellportfolio ltd on 05/09/2013

 

Issue date 22 Jan 15

 

They are also claiming 14.60 interest 25 court fee 50 solicitors costs...total 272

 

Mobile phone bill

 

After 2007

 

Claim is not by the original creditor

 

I received a notice from Vodafone and called them ...

I even received the PAC code to unlock the phone as I had paid in full

 

I'm not sure of my last payment ,should I call Vodafone ?

 

I had long conversation explaining the whole situation and going through the dates of payment

...at the end the agent for Vodafone said its gone to a debt collector and hung up..

.is it possible to get the phone conversations from Vodafone?

 

What's a CCA pls ?

And as its a mobile phone issue what do I do now ?

Righto your timeline is as follows..

 

Date of issue - 22.01.2015 + 5 days for service = 26.01.2015 + 14 days to acknowledge the claim = 09.02.2015 + 14 days to submit a defence = 23.02.2015.

 

yes, you can telephone Vodafone and ask when the last payment was made to the account and the amount paid and for what reason.

 

You would need to make a Subject Access Request to Vodafone for the telephone conversations, and TBH

 

Have you checked your credit files - any payment should be recorded there I would have thought.

 

You MUST acknowledge the claim by the date I have advised above - you can do this online.

 

I suspect your defence will likely follow what information you have provided already in that as far as you are aware, there is no debt as you paid all you owed, as they wouldn't allow you the PAC code until you had !

I have one for vodaphone of 182 and

 

 

one for Lowell of 34 no idea why its the same ref .

 

 

I paid the final payment that was asked by debit card to Vodafone,

 

 

then received the PAC code..

 

 

..I have not paid any money.

There is absolutely no point in telephoning Bryan Carter.

 

You need to follow the instructions on the claim form and log in to MCOL (moneyclaimonline) - acknowledge the claim and tick the box to say you are going to defend all you will then have more time to gather information and then submit a defence.

hoping for a non contested default judgement.

 

 

that way they don't have to show any paperwork or proof the debt is owed whatsoever

Sorry it's been a while ..just to add I also received a letter asking to call

Carter and negotiate a settlement ,I find this odd as I have submitted a defence

Expressing I don't owe anything!

Pls help me clear this up as I have a lot of other stress in my life at the moment .

Yes I have one from the Northampton court .

 

And I have the copy of the Carter's.

 

So should I go to medeation ?

 

What is it going to cost if I go to court and lose (extra)

 

As the debt has increased by over 100 pounds .

 

Will Carter's need to prove I haven't paid it or will I have to find the proof from Vodafone I have .

No not sure if I have to log in to Vodafone ..as I have no details now

 

I'm sure I have posted my defence..

 

I called Vodafone at the end of a two year contract to ask for the Pac code .

I was told I would be given it after full settlement of the contract 52pounds..

I paid it by debit card ...and was given the code.

I specifically asked if i owed anything else and was told no.

 

I'm sure this was correct .

 

I had a previous contract with them that included a dongle.

On the final payment they overcharged me 160..

.it took me three months to retrieve the money they took "by mistake".

 

Everything was fine again until the final payment and the end of the contract .

A huge coincidence.

 

So could you pls explain the two scenarios ..and what they will cost .

I sent the defence off some time ago and have only just received the N149a and n180.

 

I just assumed I would either get a letter regarding a court date

 

Or it thrown out tbh.

 

 

..now I have u til 9th April to complete small claims questionnaire.
