Hey All

 

Just a quick post

 

 

tomorrow i will be going to attend a interview at the dwp for a interview under caution

for claiming whilst my partner was working.

 

 

its not all as it seems hes on a 0 hour contract and most weeks he works

but certain times of the year work dies down which leaves them with no money

and is unpredictable when it will restart,

 

 

they was going through a hard time and didn't declare income as it is my claim

and i was undergoing depression as i lost twins and nearly lost my mum to cancer

then got pregnant a month after losing twin so i wasn't in the best place and im just getting back to myself.

 

 

I did stop claiming herself and declared income as she is still entitled to housing benefit and council tax as its a low income,

 

 

i worked out i owe around 5000 claimed for under 12 months,

 

will i go to prison?

 

 

has anyone been through this situation?

 

 

does anyone know what will happen?

My first advice is that you seek the help of a solicitor. You can ask for the interview to be postponed if you need more time to get legal advice.

 

I say this because based on what you say (and as you've said you know already) there may well be a fraud case to answer here. I am not any sort of lawyer, but if you wish your difficult family and personal circumstances to be taken into account then the best person to make this case on your behalf would be someone legally qualified and specifically experienced in benefits law.

my appointment is tomorrow and the women who i spoke to was extremely rude and said i needed to attend on the date or i would be taken to court. I cancelled my sons operation for his eye because of this. looked in the yellow pages for help but basically no ones available at such short noticed.

I've merged the two threads on this topic.

 

You said that you were told you had to attend the IUC on the given date. I believe whoever told you this was wrong. It is correct that they can proceed with a court case if you don't attend, but it is your right to take a legal representative with you and they should postpone the interview to allow you time to obtain this help. Given that the interview is tomorrow, I would attend, of course, and state that you were told you could not have time to get a lawyer. Ask them again for a postponement.

 

There are people here who have been through IUCs before, but I'm not sure how many of them will be around the forum before tomorrow. Hopefully someone will have further advice before you have to leave for your interview. Note that it is not a trial, and you will not be under arrest. Once the interview is complete, the interviewers will refer the matter to the DWP's lawyers to decide what to do next. There are a few possibilities. They could:

 

  • Decide to take no further action
  • Offer some sort of administrative penalty or departmental caution in lieu of prosecution
  • Prosecute you

It will likely be some time, possibly several months, before they inform you what action they intend to take.

 

 

The Citizens Advice Bureau provides some more information here. I would not think prison would be a likely outcome in the circumstances you describe, but I am not a lawyer.
