Advice regarding payment of judgement

Hi,

 

I'm looking for advice regarding payment of a judgement.

 

My husband had a dispute with someone he did some work for and

a judgement was made against him for a staggering 6k.

 

 

To cut a long and nasty story short,

she played the victim and portrayed him as a bully,

we had representation but it still went against him.

 

 

She just lied and lied and unfortunately the female judge believed her and my husbands 6 ft 4 stature did not help.

 

Very luckily we are in a position ( although loathing it) to pay due to recently downsizing our house and using the money from the sale.

 

I would really appreciate some thoughts about our intended payment method which is to have six thousand pound coins couriered to her address.

 

Can we do this?

Also I have looked into this and worked out that the weight will be in the region of 9 stone!

I can well understand your frustration if you believe you have been unfairly judged and it is an interesting thought to deliver 6,000 coins to the opposition.. however,

 

You would need to collect 6,000 coins - probably not as easy a task as you might think.

 

1 x £1.00 coins weighs 9.5gm - it is too late in the day for me to work out how much 6,000 would weigh. I just noticed you already did this.. 9 stone.. gulp..

 

You would then need a courier that would carry / deliver.

 

Almost certainly you would need to declare the content to the courier and they would probably want you to take out extra insurance.

 

Might be less stressful to send the cheque and move on.

 

Or.. if you think you have a case and can prove the opposition has lied or the Judge made an error in law, you could appeal the judgment.

Hi Citizen B,

 

Thank you for getting back to me.

 

The problem with appealing is that it would be difficult to prove her lies,

she is our neighbour and he agreed to work on her house at weekends to complete the front drive at a reduced rate

as he felt sorry for her as her previous builder had let her down.

 

 

There was no real plan, she just used the guys to do jobs as she thought of them.

 

 

She failed to submit her bundle on time,

sent it in after she received ours,

we went to the first hearing and complained that we hadn't had a breakdown of costs,

she was given further time to submit.

 

 

When these arrived she had gone 3k over the original claim but only submitted receipts for £900,

we seem to have been doomed from the start.

 

 

She claimed that the work had been condemned by the building inspector

but in court said 'she had asked her builder to inspect it',

he later turned out to be a joiner!

It just goes on and on, we are exhausted, want it gone.

 

Going back to the coins,

there are some logistical issues and obviously costs,

but it would be a massive headache for her,

 

 

we would have the last word but would it satisfy the judgement

or could it be rejected or have any legal comeback?

Sounds like a heck of a nightmare - Righto, I understand what you are asking now. I guess also if she is a neighbour, then it wouldn't be too much of a journey to deliver them. !

 

I must admit, I do like the idea and truly hope the legal gurus cannot find any reason why not :lol:

TBH it breaks our hearts that she will have our money but it has to be done, in her first threatening letter she pointed out that our chattels could be removed! We are so lucky that we made a bit of money when we downsized but now have to give it away - my husband earned less than £1500 on the job!

 

We were so worried what would happen if it went against her that we installed CCTV at our house!

 

Will be over the moon if this is an option.

The judge ordered that we paid in 14 days and claimant said she didn't want to let us pay in installments as she didn't trust us! We managed to get this increased to 28 days so we can pay on time as we downsized to move next to her!

You can pay in £1 coins and that's legal:-)

Coins:

 

Coins are legal tender throughout the United Kingdom for the following amount:

 

£20 - for any amount

 

£5 (Crown) - for any amount

 

£2 - for any amount

 

£1 - for any amount

 

50p - for any amount not exceeding £10

 

25p (Crown) - for any amount not exceeding £10

 

20p - for any amount not exceeding £10

 

10p - for any amount not exceeding £5

 

5p - for any amount not exceeding £5

 

2p - for any amount not exceeding 20p

 

1p - for any amount not exceeding 20p

 

 

 

As you can see, next to the £2.00 - £1.00 coins you can pay any sum in those coins. Whereas for other coins there is a maximum amount.. eg.. you can only tender 20 pence worth of 1p coins.

 

I would so love to be a fly on the wall when your neighbour opens the boxes :lol:

 

Perhaps print off the RM page that ploddertom provided and highlight the £1.00 coin section and enclose it in one of the boxes. .

I understand the OP's position but I would just send a cheque and not be tempted to be petty.

Get her to sign a receipt, in your presence, or in the prescence of an independant witness.

 

One receipt per coin!

Thanks for you thoughts on this, I have some time to think it through and realise that there are additional risks and issues which need consideration. She is so evil that I wouldn't put it passed her to claim she had been broken into and point the finger at us on the grounds that we were the only people who knew she had that much money in the house.

 

I'm just so angry and hurt by this - never a favour went unpunished eh!

Yes, I imagine you are and whilst your idea is a good one - and would give you great satisfaction - it does as you say have risks which could backfire on you. Console yourself with the knowledge that you know she has told lies and is a person you wouldn't trust.. that type of person does eventually receive their come uppance. !

 

At least you know not to do her any favours in the future !

When I had to return £1 coins they all had to be in coinbags of £20 each, then put into another bag which contained 25 x £20 = £500 and only then could I return them. Of course if paying someone that would not necessarily apply but I would certainly deliver them in person and make sure they were counted over correctly even if had to buy a coin counter, alternatively weigh them out - 20 x £1 coin = 190g.
