HSBC loan PPI, will they reject my claim?

Hi

I've been reading here a while and hope someone will be able to advise.

 

I've just been in touch with HSBC about PPI,

 

 

I have had 2 loans and a credit card in the past and they tell me all three had PPI on them.

 

Back in 2001,

fresh out of uni with an outstanding £1500 overdraft and

just starting a nursing job with the NHS ,

I needed cash for a car.

 

 

I've managed to dig out my paperwork from that loan and wondered if they'd reject a PPI claim with the way it's set out.

 

 

It does clearly show that the loan and PPI loan are separate amounts,

but add the two together at the top of the page as one amount and base the repayments on this total amount.

 

 

At the bottom it states WE STRONGLY RECOMMEND THAT YOU CONSIDER TAKING OUT OUR LOAN PROTECTION COVER etc..

. but to me that seems to be recommending an additional product,

and as I was told st the time, the protection outlined was part of the original loan.

 

 

And nowhere does it say the protection they quote for is OPTIONAL,

and I didn't get any sort of quote without it.

 

 

Would they reject the claim based on the statement at the bottom of the page,

saying We Recommend...etc, and tell me it was clear it was optional?

 

I also have some CC statements from 2002-4. Statements show protection payments,

which I would never have agreed to,

considering I was a newly qualified nurse with more than adequate sickness cover with the NHS

(which would obviously also have been the case with the loan).

 

Being 21 and just in need of some quick cash,

 

 

I know I probably didn't read the paperwork fully,

but also at no time was I asked or it explained to me about these insurances which would have been blindingly obvious I didn't need.

 

 

I think the CC was arranged over the phone, but I'm not 100% sure on that.

 

So, before I send the paperwork back to them, do you think I have a case?

I don't see they would have any reason to reject your claim - especially in view of the reasons you are providing :)

 

If you could convert your documents to pdf format, then we will be able to read them better :)

Thanks. I've had a go at converting to PDF, fingers crossed.....

 

It's only through reading here I realised it may be more difficult than I thought to claim, that's whyI thought I'd better ask before I get my hopes up!

 

Can I use the same rationale for the later loan that I have no paperwork for? CC was consolidatedinto it in 2006, so will the CC protection be payable 02-06? I only have around 18m of statements though. Am I going to have to request my info for that, or will HSBC figure it out? I have no idea of the balance when the acct closed with consolidating into loan. I have no clue of the amount of PPI I was paying on the 2006 loan.

 

I also have an ongoing HSBC mortgage, which I'm fairly certain I have a clear cut case for claiming back on. Again being 21 and buying a house I had no idea the extra payments going out weren't all part of my mortgage, and I have paperwork showing I clearly declined to add various protections which were subsequently added anyway.

OK, another question if you wouldn't mind,

 

 

seeing as I know I've had three different PPIs (not including my mortgage),

 

 

do I include them all in the same claim or do 3 different claims?

 

 

HSBC gave me 3 reference numbers,

 

 

can I put them all in this one form or send 3 copies, one with each ref no.?
