I think that this goes to show that unless the claimant follows all the rules it is worth fighting back. I have seen a few cases where it would appear that there is no defence against a ccj but because the claimant does not follow the CPR or is unable to provide some paperwork the claims get stayed then struck out. IMO always worth a punt although some might call it debt avoidance

Well you never know what the judge might call it but there may be nothing he or she can do about it. I certainly do not call it debt avoidance, I call it using the law to your best advantage

.... also when the original creditor had managed to milk you off in interests, fees and charges to the extent that you don't know how much is "Actually owed" ..because they ve refused to produce all paperwork with calculations !! I m heaving a big sign of relief! ! ALL THANKS TO THE ANGELS HERE !!!
