      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, can someone help with this please/

I got a letter today from DWP asking for me to go to a interview because my circumstances may have changed and to ensure my payments are correct.

It goes on to say I agreed to tell them immediately if the circumstances relating to my benefit entitlement changed, IT HAS NOT!

It then goes on to say an unreported change in circumstances any over payment will have to be paid back and further I may be liable for financial penalties .

 

Anyone advise please TIA

Anyone, really worried now as heard it could be for fraud? I have not worked or claimed for anything not supposed to have, always took in "fit" "sick" note for Sandy as requested, have phoned them but no-one answered apart form a machine,had to leave a message

My housemate received an invitation for one of these next week.

 

Best advice I can give is to take in copies/print out of your bank statements and all correspondence you have. Take a copy of your tenancy etc. If its fraud it could only be housing benefit, council tax benefit, ESA etc

 

If you have not changed circumstances, moved or worked then I don't think there's much to worry about. I could be wrong though. Someone with more experience should be able to help.

we only get JSA, housing benefit and council tax help, we pay bedroom tax and some towards the council tax. I have not worked at all, been looking for worked and gone for interviews but that is it

Yes, you should be paid as normal. Most Compliance interviews are routine and nothing to worry about.

As a general rule, no, most DWP staff can't access your bank account. There may be a few exceptions, specifically fraud investigators. Even they can't just access your bank account whenever they feel like it - they need to have a good reason. The Compliance officer who conducts your interview will not be able to see your bank details. That's why they ask for statements.

well seems it is about a £44 a year payment I get from a pension I closed, they think I am getting the £44 every month, how they know about this have no idea!, was told you are supposed to declare it? never been told this before now got to take in the documents re this

The bank will charge you, you could send a SAR, that would cost £10, I'd be tempted to print them off. It is disappointing that they think you get paid £44 a month. Almost laughable.

 

Just wondered if it is all right to print off bank statements or do you have to get them direct from the bank?

yes that is what we thought, rebel, they have not really said how long they want the statements to go back for but I have printed of the one that shows the payment of £44, also printed some more up to date onees off to show we only get JSA, will print some more off neare the time, fingers crossed we get our JSA tomorrow as got a stack of bills to pay

You won't be sanctioned. They'll take copies of your evidence and if necessary, make adjustments to your benefit. These won't be big adjustments over £44 a year.

 

Ask if they will cover your travel expenses to the interview.

hi , is it right and legal that they can access your bank accounts? if so how? you get told never give your bank details/pin number to anyone so surely it is against the law to do this?

I ask this as is say you have been given PPI back and it goes into your account are you supposed to tell them? will they stop your JSA etc, sorry but to me your bank account is secret. all wrong

I go tomorrow for this meeting and got the paper work from the pension people for all of £44 a year lol

Compliance officers can't access your bank accounts, nor can the vast majority of DWP staff. Certain authorised fraud investigators can do so, under very limited circumstances, if they can show that they have a good reason to believe that fraud may be taking place.
