    • An update - Still receiving emails and letters - but have been getting text messages too. nothing aggressive just asking me to get in touch.    the text makes it look like it from the bank on first glance - it reads -   'the banks name' would like to dicuss our recent communication...etc... then lists IDR phone number and email FYI - reporting them as spam
    • Hello, After seeing all of the posts about BMW on here I really wish I hadn't even considered them! I bought a used car from them over the weekend, one specifically which had a reversing camera and cruise control in the advert. I was foolish at the time of purchase and didn't check to see these functions work on the test drive (totally my fault). Now that the car is home I've checked and checked and neither of these functions are available. I even checked on Parkers and it seems that no Skoda Kamiq '21 models come with any parking cameras at all. When buying the car, I was told all that was needed was 'Four signatures and £500' to secure it. I was never shown any of the documents, and instead the sales rep opened a box on his iPad and asked me to sign. He had been complaining about the length of time some customers take these days all throughout my time with him. (Again) foolishly I signed. In my email inbox I now have four attachments from BMW, one of which is my signature under a letter which basically says that the cars don't need to match the advertisements online, or have any of the features that a sales rep talks about. I realise that I've made mistakes in not doing my due diligence here, but thought I might as well ask the experts here if I have any rights left to claim that the car was miss-advertised, or if I unknowingly signed them away? Thanks in advance

    • ah this is a B2B PCP then as your are sending the SAR as a private individual and not as repping the co. you need to prove to them. unfortunately, i think that will also reset the 30 days. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

In june 2011 i bought an apple laptop from currys

was asked instore if i would like to take out insurance,

 

 

i took the (anything that happens package)at ten pounds per month.

 

 

in september 2013 my laptop was stolen and it wasnt stolen from my home

 

 

.i rang currys who said the policy did not cover theft

 

 

!i was furious as i know that day that i was not told instore that the insurance didnt cover theft.

 

 

after knowing that my laptop has been stolen

they have still had the cheek to carry on taking money out of my bank account for the insurance!!

 

 

has anyone had this sort of problem??

 

 

and is there anyway i can take this further??

Were you told that it did cover theft?

 

Pretty much the only thing that this Whatever Happens policy covers is accidental damage,

and even then they seem to be rejecting more and more as "Damage not as described".

 

As for continuing to take the money,

unless you tell them to cancel the policy then they'll continue to do so.

 

 

Fortunately there's no minimum term so you can cancel it at any time with no outstanding to pay.

Did you read your Whatever Happens contract and Direct Debit mandate before signing?

It gives a complete list of what is and is not covered under the policy.

A signature is required to say you confirm you have read and understood the policy, and you are happy for Currys to take your money on a monthly basis.

 

If you didn't read the policy before, then this was a tough lesson for the future.

UKAnon is right. If you had read all the paperwork carefully you would have seen that "Whatever Happens" is a false promise with many exclusions.

 

Make sure that Currys learn "a tough lesson for the future" by telling all your friends, family and workmates about this shabby treatment. Every sale that you can divert to a more reputable retailer is a victory.

whatever happens is a joke. I am a former currys employee. The managers will force this sell on to the sales advisors and thus on to you. It is number one priority to get a WH on major products. Laptops are KEY as their profit margin is ridiculously low, this is why it is a rare instance you will ever get more than 10% discount - and even that is if they admit a fault. The common method of [causing problems] is offering you 3 months free insurance (thus putting you on a monthly plan which is always more expensive than 3 or 5 year plans) , they will discount your product by say £9 if the insurance is £3 a month. In reality, they have signed u up for a direct debit payment, and the idea is you will most likely forget to cancel it after 3 months !!!
