    • Hello, Firstly, and most importantly I am sorry for your loss. I would go back to the bank with the death certificate and ask them to step in. Remind them firmly but politely that there is no limit for DD claims   Please let us know how you get on.
    • My wife is the named person to his bank account with him having Dementia being his daughter (I say named person she still is but he recently passed away and the deputyship application has now being stopped by the solicitor as it's no longer needed) We've only just got the Death Certificate so the bank will be the next step informing them. She went to the bank and explained the situation but even being his named person the bank said she didn't have the power to stop DD without any legal documents (virgin money) was the bank. She could have copies of bank statements that was about it.
    • I see you said you tried to stop the DD but it seems that didn't work. May I please ask why that didn't work? You should be asking your bank to cancel the DD and I don't see why they would have objected, hopefully you can clarify this. I agree that you should be making a claim here against your bank and ask them for a DD refund. There is no timeframes for this.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi. I'm hoping someone can advise me correctly as after speaking to 3 different people on the tax credit helpline I'm totally confused!

I am currently receiving ssp and will unfortunately be unable to return to work due to disability! I have contacted HRMC to advise them of this and to give them my wages details for 13/14, showing that going from 5k to1k and my husband's wages staying the same at 14.5k! We have 3 children all under the age of 12! Now when I renewed my claim last week, I explained my situation to the advisor who then said that we will generate a potential payment and have an underlying entitlement to working tax credits! Now today I had my weekly tax credits which had gone up slightly, so I thus called them! Spoke to one person who really did not understand what I was saying but he said we would be entitled to working tax credits come April 14 based on this yrs wages! So I said so a potential payment would be due because of under payment for this year, first he said yes then said no!

He then said he'd transfer me to a more experienced advisor! Who then said that our payment would stay the same even though I income has gone down and that changes will be made in April 14!

Are you as confused as I am or do any of you understand the tax credit system??

We are going to really really struggle, and it's making me feel ill at the thought of not being able to provide for my children!

Any suggestions, ideas or knowledge would be greatly appreciated!

As far as I was told last year when my husband was sick is that if your salary goes down by less than £2500 in the tax year then nothing changes but if its more than £2500 then your payments will go up. I don't understand why they would say you would receive a payment for an underpayment for this tax year as it doesn't end until April 2014.

 

The other thing which I found out last year was that WTC stopped me from receiving free school meals. As I have 3 school age daughters it was £28 per week and the WTC was only £18 every 4 weeks so it was more beneficial not to receive the WTC.

I have the same issue. I have given my details for 12-13 but I have lost my wages of £6000 yet this won't affect my tax credits for this year at all and we will get more next year which is not very handy when we need the money to live on now. As it is we have had £100 a month cut and also being told we were overpaid by £600 for last year as tax credits have our income wrong for 2011-12 despite me correcting it last December and receiving an increase in tax credits.

 

I seem to get different answers from whoever I speak to and some are really rude. I have to wait up to 15 weeks now whilst my 2011-12 details are sent back to the tax credit office to look at and even then they may not change them so i will have to appeal. I have now got someone to act on my behalf from the CAB.

 

With the wait for our housing benefit claim to go through (which has so far been 6 weeks) we are really struggling to keep up with bills let alone try and feed ourselves.

They are ignoring the first 2500 that your income goes down by so say last year you earned 10000 last year, and this year you estimate you will only earn 5000 they are basing your claim on 7500.

They did say that come April 2014 if I was to earn the lower amount I would be paid benefit based on that at the end of the year.
