I was sold goods not fit for purpose so after several months of chasing I have started a Small Claim action (value circa £500).

The Defendant (I'm claiming against his manufacturing Company) has lied several times on the defence paperwork he has submitted to the Court. In Court it will be his word against mine and I'm wondering how I can win my case.

I have to submit an Allocation Questionnaire Form N149 and have the opportunity to make comments to the Judge in Part G of of the Form. What can I write in part G? Shall I say he's lying? Or should I leave it blank?

Leave blank. The N149 is simply about how the claim should be managed, it is not about who is right and who is wrong. You will receive directions setting out what you need to do before trial.

 

If you want to win your case, then collect as much evidence as you can that the goods were not fit for purpose...
