    • Hi,  It has been a long time but I have had confirmation claim will proceed to hearing in roughly 1 months time.  I was wondering if anyone could advise on defence please.  A few questions I have are: 1) I didn't notify VCS that I was not the driver of the vehicle and the judge may look negatively on this point.  I did not receive any direction in correspondence from VCS  that I should inform them if I was not the driver and that was going to be the foundation for may argument on this point. 2) The vehicle is stopped at a zebra crossing.  Based on the images from VCS for around 10 seconds.  At that time there is someone standing near the zebra crossing and someone else enters my vehicle.  I was going to raise the point that stopping at a zebra crossing when someone is standing near it is to be expected.  I was also going to ask the question how you can have a no stopping zone when there are zebra crossings where the driver is required to stop. 3) The no stopping zone is clearly signposted, however, no drop off or pickup is not clearly signposted with one small sign at the zebra crossing, parallel to the road and on the passengers side.  I was going to challenge that no-drop off or pickup is clearly signposted.  4) VCS mentioned my initial defence was generic and clearly copied from the internet.  It covered 1) Claimant not being in a position to state if the Defendant was the driver at the time.  2) No evidence that claimant's contract with landowner supersedes byelaws & signage isn't legally binding contract. 3) No contractual costs and interest cannot be accrued on speculative charge. I am interested to know if anyone has had success or been unsuccessful with this 'generic' defence. 5) If I should submit an updated defence to the court based on questions 1, 2 & 3.  Or if it is better to only raise these points in court?     • I honestly don't know, Baz. In addition what I don't  understand (from that pamphlet) is this: The s88 criteria are quite clear and don't need a medical professional to interpret them . The one most relevant to his topic says that an application is not a "qualifying application" if a relevant disability has been declared. The problem with the word "may" is how does the applicant establish whether me "may" driver under s88 when he has not complied with its conditions? I don't know the answer to that either. But to further muddy the waters, the pamphlet says this (about : But the s88 statute says absolutely nothing like that at all. It simply says that if you have declared a relevant disability s88 does not apply. The DVLA pamphlet is simply confusing as far as I can see. That's actually my opinion and that's what I would stick to if it was me making the application. But I'll seek a few opinions from others over the next couple of days.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello,

 

I recently took out a payday loan with poundaccess (wish I didn't now), I would like to speak to them regarding setting up a payment plan however I am finding it impossible to get a response from them.

 

I have sent numerous e-mails over the last week with payment proposals however I have had no response. I have also tried phoning them however it goes through to answerphone after a short while due to "high call volume".

 

Their site has also been down for several weeks now apparently due to maintenance.

 

Is anybody else in the process of dealing with poundaccess and have they had any luck contacting them recently?

apologies to all for not reading the forum properly prior to posting! I have seen the thread relating to poundaccess going into liquidation.

 

Where do I stand with my loan? Will I have to wait to be contacted by the liquidator?

Yep. Keep the money safe and wait to be contacted. When you do get contacted, make sure to check the credentials of the liquidator so you dont get scammed.

I took out a pay day loan with Poundaccess, against my better judgment. I have been trying to access their website for about 3 weeks now, but it just pops up stating "under maintenance". I have sent dozens of emails requesting details as to why I cannot access my online account - I asked them how I was suppose to make an early payment if I chose to do this. I finally received a response giving me the amount that was due on that particular day and asking me to confirm my debit card details. I asked them what the problem with their website was - they replied stating that their IS department had said that it would be "down indefinately". I wrote back saying that this was a serious concern for me and asking them to confirm that there were "no problems". They just replied saying that everything was fine and that my payment woudl be taken on 31st March 2013. However, I have been trying to contact them via email since before 27th March, asking how I can take the option to "roll-over" my loan. I have received no response. I have sent several emails since that date and the only emails I have received since is those telling me that my loan is due, they could not take the payment and had added a £20 late payment charge. I have tried calling them, but I only get an answerphone message. If they have gone into liquidation, will these charges be continually added until I make a payment? How do I make a payment? This is a very unsettling situation to be in and I do not want to get into trouble. Any advice would be welcome.

hi jlc001, i hve exactly the same problem , see my thread under'help with poundaccess' here in this forum . Poundaccess now is sending every single day 2 harassment emails advising penalties incurred in the account whereas I already extended my loan till 30 apr 13 and paid the fee. They are not contactable and are not answering any messages. Its a big concern for me too and I do not know where I stand legally. Because they took the roll ever fee under 3rd party company 'Sensible Home Finance' It stressed me out so much and I am thinking to complain .

Anyone knows where to complain , is it Financial Ombudsman Service ??

 

Please let us each other updated with any outcome we receive next days .

I have no heard anything from them since they sent me an email on 1st April informing me they had applied a £20 penalty because they could not take payment. I have been unable to "roll-over" my loan, albeit I have been trying to contact them to do this since 27th March. I responded to their email of 1st April asking why they have not responded to any of my correspondence. I requested delivery and read receipts, but neither have come back as confirmed. I have tried calling again this morning, but once again, no luck. Is there a way of finding out if they have definitely gone into liquidation and if so, who the liquidators are? Also, can they continue to apply financial penalties to the account, even though I have done everything within my power to contact them?

 

Will keep you up to date with any further developments, but assistance from anyone on the above would be much appreciated.

I have just received another chasing email from Poundaccess saying the following that I am now three days late with my payment and that I have incurred further penalties. It then goes on to say

 

"..... Loan repayments andloan extensions can be made online or the money can be transferred to our bankaccount directly by bank transfer. To make payments online, please login into your online Poundaccess account. (Returning Customers section) using your original email and password details. "

 

I can't access my online account, as it has been "under maintenance" for weeks now. I replied, yet again, to this email stating that they had yet to respond to any of my emails to them dating back to 27th April and I have been chasing them ever since.

 

Can anybody confirm what is going on with them? Are they still trading?

I have today received an email from someone called John M advising he is from a company called Life Boat Loans asking me to call his mobile number in regard to my Poundaccess account. He signs it of as collections manager. Who is he?

Dont pay anyone anything yet. Thats 3 companies now that seem to be involved in poundaccess's affairs. It very much sounds like they know they could be shut down in a few weeks when the OFT hits them hard, so theyre trying to shut up shop and open under new names.

 

Even the websites of the companies are all down.

I have now received a response from John M of LifeboatLoans who has said the following :

 

Thank you for your response, Lifeboatloans have taken overPoundaccess and your account is now held here. If you can call me on07720637826 I will provide you with further information.

 

Can anyboyd confirm this - how do I know this is fact. Is there any sort of paperwork that I should be asking for to ensure that this is legitimate?

I have taken your advice and emailed him back requesting the information. In the meantime, I have now received the following :

I understand your concerns, there should be letters being sentto all poundaccess customer over the coming days.

I have however responded to an email that you sent poundaccesswhich has been redirected to my emails due to the takeover of theiraccounts. This is common practise and can assure you it is all within thefinancial laws.

If you was to call me as stated I can present you with means torepay the loan that you have taken without incurring any charges of fess’s andpossibly reducing your settlement that will ease your fears

Is what he saying even legal? I am very dubious.

Sounds very strange to me. Why wont he put it in writing and why is he threatening you?

Despite I paid the fee on 22 march 13 and extended my loan with poundsaccess for 1 mnth till 30 apr 13 I received at least four emails on 30 mar 13 (original repayment date) advising I have been defaulted and that more penalties incurred etc . The fee taken under 3rd party co. Sensible Home Finance . - see my thread above -Despite my emails, tx , numerous phone calls to them last w/end finally the woman at Poundsaccess phoned me on monday 2/4 advised me that Poundsaccess would soon be back to normal and that is not in lliquidation. I specifically asked she said no. I mentioned how unfair it was after having paid the roll-over fee still to receive harrasment emails from them etc . She asked me to disregard and ignore them all. She once again confirmed me my repayment date of 30/4/13 , then a day after sent me an email to confirm this as I requested.. She said she could reduce the loan amount if i pay it earlier.I asked when I repay it if it would be poundsaccess or Sensible home Finance b the one that will appear in my bank statement she said she didnt know yet it might be either she said.

 

I really dont know what to do under this circumstances, since last w/end and spoke to her those harassment emails stopped but I do not know legally if I should repay them or not on my loan due date if they take the money under different entity other than poundaccess?

 

any advice would be appreciated.

To me, it's clear cut.

 

You took out a loan with poundaccess.

 

Do NOT pay any other 2 bit loan company who've told you that they are dealing with poundaccess accounts.

 

Wait to receive something in the post.

 

From poundaccess or their official receivers/liquidators

It never rains but it pours...

my worry is if I go beyond my repayment date and do not pay them then default charges, penalty etc to be added or may be not . i dnt know. other thing , regardless we owe them or not now may be we should really not pay them at this stage since they are not taking the money now under poundaccess name ???

Why, if another company state they have taken over the business, am I still receiving communication from Poundaccess, albeit it is not possible to act upon the instructions contained within their email? I have still not received any postal correspondence from anyone - albeit I have been told I will?

Ignore it for now as they are in breach of OFT guidance. More so they are misleading you as to the current status of the debt.

Thank you for replying. Will I be in breach of any agreement if I do ignore it? The website says one thing, Mr M says something else - he also said that he works on behalf of Life Boat Loans and that was his original email address - this now appears to have changed to Engaged-Solutions and also I am receiving obscure emails from Poundaccess. It is all very confusing and as yet, I have receiving nothing in writing. Is there any way I can find out what the legal situation is and what I do about it?

Nope you wont. They are the ones currently in breach.
