Quick update - I sent a letter of complaint to OFT and have today received the following response: Consumer Credit Act 1974 (the Act) Complaint Against:Motormile Finance UK Limited trading as MMF Licence No : 628173 Thank you for your email received on 02 May 2013. I can confirm that the business you mention holds a consumer credit licence. Under the Consumer Credit Act, holders of consumer credit licences must be fit and competent to do so and the Office of Fair Trading (OFT) has a duty to monitor the fitness and conduct of all traders who hold such a licence. The OFT has issued guidance to consumer credit licence holders engaged in the debt collection industry. The guidance is intended to ensure that debt collectors treat individuals fairly. Non-compliance with this guidance will call into question the fitness of licence holders and applicants.   2. I am of the same mind. I have replied to the latest email, supposedly from ViaSMS and requested that a copy of the original agreement and a copy of the assignment me to send to me hard copy in the post. I replied to the email from Viasms@engaged-solutions etc and I will await to see what, if any, response I receive. If I hear further from John Milburn of engaged-solutions, I will send him a copy of my emailed request. OFT still confirm that PoundAccess have their trading licence etc, so I am more than a little concerned that I deal correctly with the right person.

As an updated - this is the email I received, supposedly from PoundAccess confirming that my account had been handed over to engaged-solutions - funny that the email has come from engaged-solutions. Via SMS Your agreement has beentransferred to Engaged Solutions who will be in touch shortly with up to datepayment arrangements. All your terms and conditions have been transferredtogether with any balances outstanding. You can contact EngagedSolutions to make payments and arrangements on 0800 949 9110 where the teamwill be happy to help and listen to your current circumstances.   5. Hi I have just been reading through this thread. I have been receiving 3 emails (all send simultaneously) every other day for the last couple of months in relation to WDA and Mr Lender. I sent the request for copy agreements and statement of accounts etc by recorded delivery, which was signed for on 23rd April 2013. Each time I receive a batch of these emails, I reply stating that they are in receipt of my letter dated 22nd April and it was signed for by their representative on 23rd April and until such time as I received a response from them, no further communication will be entered into. They continue to send emails, I continue to respond saying they are ignoring my communication to them. Today they left a recorded message on my colleagues voicemail here at work, naming me and saying if I did not call them they would be attending my home. I am furious. I have all the emails saved, letters and recorded signatures filed away - will this help your cause? They a bunch of ignorant bullies, that only want to deal with matters verbally - because then there is no record of ignorant and threatening behaviour.

Surely, written evidence must be provided that Poundaccess has been taken over by an alternate organisation - mobile numbers, constant changing email addresses and an informal email stating that this is so just doesn't instill me with confidence. It also doesn't help that OFT are saying that Poundaccess still have an active trading licence.

  9. Thank you for replying. Will I be in breach of any agreement if I do ignore it? The website says one thing, Mr M says something else - he also said that he works on behalf of Life Boat Loans and that was his original email address - this now appears to have changed to Engaged-Solutions and also I am receiving obscure emails from Poundaccess. It is all very confusing and as yet, I have receiving nothing in writing. Is there any way I can find out what the legal situation is and what I do about it?

Having been told by this John M that they had taken over Poundaccess, I received this email from Poundaccess over the weekend - I don't understand what is going: Your loan is now 14 days overdue and the total amount owedis £*** including interest and fees. Despite our calls, texts and emails, wehave been unable to collect payment of £*** from you. Loan repayments can be made online or the money can be transferred to our bankaccount directly by bank transfer. To make payments online, please login intoyour online Poundaccess account (Returning Customers Section) using your original email and password details. Why, if another company state they have taken over the business, am I still receiving communication from Poundaccess, albeit it is not possible to act upon the instructions contained within their email? I have still not received any postal correspondence from anyone - albeit I have been told I will? What should I do?
  11. I have taken your advice and emailed him back requesting the information. In the meantime, I have now received the following : I understand your concerns, there should be letters being sentto all poundaccess customer over the coming days. I have however responded to an email that you sent poundaccesswhich has been redirected to my emails due to the takeover of theiraccounts. This is common practise and can assure you it is all within thefinancial laws. If you was to call me as stated I can present you with means torepay the loan that you have taken without incurring any charges of fess’s andpossibly reducing your settlement that will ease your fears Is what he saying even legal? I am very dubious.

If you can call me on07720637826 I will provide you with further information. Can anyboyd confirm this - how do I know this is fact. Is there any sort of paperwork that I should be asking for to ensure that this is legitimate? Thanks for your help ......

  14. I have today received an email from someone called John M advising he is from a company called Life Boat Loans asking me to call his mobile number in regard to my Poundaccess account. He signs it of as collections manager. Who is he?
  15. I have just received another chasing email from Poundaccess saying the following that I am now three days late with my payment and that I have incurred further penalties. It then goes on to say "..... Loan repayments andloan extensions can be made online or the money can be transferred to our bankaccount directly by bank transfer. To make payments online, please login into your online Poundaccess account. (Returning Customers section) using your original email and password details. " I can't access my online account, as it has been "under maintenance" for weeks now. I replied, yet again, to this email stating that they had yet to respond to any of my emails to them dating back to 27th April and I have been chasing them ever since. Can anybody confirm what is going on with them? Are they still trading?
  16. I have no heard anything from them since they sent me an email on 1st April informing me they had applied a £20 penalty because they could not take payment. I have been unable to "roll-over" my loan, albeit I have been trying to contact them to do this since 27th March. I responded to their email of 1st April asking why they have not responded to any of my correspondence. I requested delivery and read receipts, but neither have come back as confirmed. I have tried calling again this morning, but once again, no luck. Is there a way of finding out if they have definitely gone into liquidation and if so, who the liquidators are? Also, can they continue to apply financial penalties to the account, even though I have done everything within my power to contact them? Will keep you up to date with any further developments, but assistance from anyone on the above would be much appreciated.
  17. I took out a pay day loan with Poundaccess, against my better judgment. I have been trying to access their website for about 3 weeks now, but it just pops up stating "under maintenance". I have sent dozens of emails requesting details as to why I cannot access my online account - I asked them how I was suppose to make an early payment if I chose to do this. I finally received a response giving me the amount that was due on that particular day and asking me to confirm my debit card details. I asked them what the problem with their website was - they replied stating that their IS department had said that it would be "down indefinately". I wrote back saying that this was a serious concern for me and asking them to confirm that there were "no problems". They just replied saying that everything was fine and that my payment woudl be taken on 31st March 2013. However, I have been trying to contact them via email since before 27th March, asking how I can take the option to "roll-over" my loan. I have received no response. I have sent several emails since that date and the only emails I have received since is those telling me that my loan is due, they could not take the payment and had added a £20 late payment charge. I have tried calling them, but I only get an answerphone message. If they have gone into liquidation, will these charges be continually added until I make a payment? How do I make a payment? This is a very unsettling situation to be in and I do not want to get into trouble. Any advice would be welcome.
