    • I've just remembered that a friend of mine had bookings cancelled on Booking.com about a month ago - and the good news is that all worked out in the wash. I'm at work now but will scribble properly in a couple of hours with the full tale.

    • Their FAQs state - Cancellations and modifications If your booking has been cancelled, Booking.com refunds you immediately. The processing time may take 7 to 10 days and depends on your bank. If you have questions, contact your bank directly. I'm a regular Booking.com and AirBnB user.  The former have never cancelled.  The latter have and my money was refunded immediately (not that that helps you as we're not talking about AirBnB!) Best to check with your bank and see (a) if you did pay in advance and (b) if it has been refunded. Also, have you received a message from Booking.com officially stating the cancellation?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

terrible, terrible company.

 

I phoned to cancel my car insurance on 16th January 2012,

 

they told me it would cost me £55.00 and I thought that as the policy finished on 31st March I would leave it.

 

I then moved house and worked abroad for most of the year.

 

Went to get new car insurance this year and when I called Hastings for proof of my no claims, they said that I was insured with them.

 

They had taken nearly £700.00 from my bank account last year on April 1st.

 

I hadn't received any renewal documents, nothing!

 

When I called them, they said it was my fault and was the car SORN, it was but not until May and now they're arguing about whether I should have my money back.

 

Can't believe this company, I

 

've been on many forums and it seems that there is an awful lot of people out there who have had problems with them.

Have to say, I would not touch them with a barge pole and have steered many friends and colleagues away from them.

An update, received a letter from Hastings today, spoke to their terrible customer service department again, they really do need a retraining programme. The new law regarding policy automatic renewal came into force on 20th June 2012 and because of this they decided that all clients should be included! I was never consulted in their decision. Because of this and also because I mentioned that I wanted the policy cancelled on January 16th 2012 but as I was going to lose my no claims for that year and it would cost me £55.00, I said leave it. They decided to take £648.50 from my account.

 

I am waiting to hear from my uncle, a barrister. We're planning to take this to court to set a precedent. I really think Hastings need to get their house in order and I intend to do it through the courts. Too many people on too many forums complain about Hastings consistently, it can't all be their clients fault, they have to stand up at some point and take responsibility themselves. Watch this space.

apparently a new law came into force last year on 20th June 2012. I'm quoting now! " This law was brought into force to make sure drivers did not forget to renew their insurance" It's called Continuous Insurance Enforcement Law. Hope this helps

Your existing insurer should send a renewal quote a month before your policy ends giving you plenty of time to shop around and find the right cover at the best price.

Hastings Direct, What a rip-off company!!

How is this fair??

I had a bump in my car, NOT my fault. No problem our specialists Albany Assistance will take care of everything. 4 weeks go by, I ring, sorry the 3rd party denies liability so we do nothing, Hastings will take over! Hastings say we can't do anything until YOU agree to a courtesy car, with your excess, then we can fight for all costs!! Get courtesy car, mine taken for assessment, week later sorry mate, Beyond Economical Repair = write off. Ok says i but i want my car back, 'Cat C' (worthless but very reliable). Sorry NO. It goes to salvage. If we pay out you buy back from salvage company at auction. (They are en route to collect without me being made a financial offer!!) If you want the car back we close the claim, not written off, not repaired, no pay out. So, here i am waiting for my car to arrive back, (cant afford to buy another), I am left to pay for repairs myself, without compensation from other party!! Cant ask for him to pay bill otherwise the car is written off again & goes to salvage........ I will have my car back complete with scratches & a claim associated to my name for the next five years. LOST OUT big time Hastings. Thanks for nothing. Needless to say i will NEVER buy a worthless policy from you again.

I've been on so many forums and Hastings direct have a terrible reputation on all of al them. I'm taking them to court, we will set a precedent! My advise to anyone, please, please, please do not take insurance out with Hastings direct, you are asking for trouble!

Was with them years ago, for 3 years. Thought they were very good, although i never needed to claim. Now when i need to claim I'm left out in the cold. Made a comment on their facebook page, they didn't like my comment & removed it. Keep putting up a polite comment asking for them to comment on my case.... they just remove my posts. Very professional eh??

Good luck in your persuit for justice. Just wish i could afford to take them to court. :(

I know some companies will automatically renew your policy on renewal, UNLESS you tell them not to. This they say is to avoid a policy lapse should you forget the renewal date. Didn't know it was 'law'. Thought it was just a crafty tactic to con you into a policy whether you wanted it or not, to avoid losing a customer.

I can, however find no references that the insurer's have a right under law to auto renew.

 

I think the OP is having the wool pulled over his/her eyes.

 

It does pay to keep your eyes open with regard to insurances though.
