    • I have just read the smaller print on their signs. It says that you can pay at the end of your parking session. given that you have ten minutes grace period the 35 seconds could easily have been taken up with walking back to your car, switching on the engine and then driving out. Even in my younger days when I used to regularly exceed speed limits, I doubt I could have done that in 35 seconds even when I  had a TR5.

    • Thank you for posting up the results from the sar. The PCN is not compliant with the Protection of Freedoms Act 2012 Schedule 4. Under Section 9 [2][a] they are supposed to specify the parking time. the photographs show your car in motion both entering and leaving the car park thus not parking. If you have to do a Witness Statement later should they finally take you to Court you will have to continue to state that even though you stayed there for several hours in a small car park and the difference between the ANPR times and the actual parking period may only be a matter of a few minutes  nevertheless the CEL have failed to comply with the Act by failing to specify the parking period. However it looks as if your appeal revealed you were the driver the deficient PCN will not help you as the driver. I suspect that it may have been an appeal from the pub that meant that CEL offered you partly a way out  by allowing you to claim you had made an error in registering your vehicle reg. number . This enabled them to reduce the charge to £20 despite them acknowledging that you hadn't registered at all. We have not seen the signs in the car park yet so we do not what is said on them and all the signs say the same thing. It would be unusual for a pub to have  a Permit Holders Only sign which may discourage casual motorists from stopping there. But if that is the sign then as it prohibits any one who doesn't have a permit, then it cannot form a contract with motorists though it may depend on how the signs are worded.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

if you signed on trade premises then its a non cancellable agreement....that term doesnt apply. although lots of other things still do

 

the total amount of loan should be on there...........but, if the interest rate is variable they might not have to show it

 

the main items are here copied from the oft guidelines

 

What the agreement must contain

 

1 A heading in one of the following forms of words shown prominently on the first

page:

Hire-Purchase Agreement regulated by the Consumer Credit Act 1974

or

Conditional Sale Agreement regulated by the Consumer Credit Act 1974

or, in any other case,

Credit Agreement regulated by the Consumer Credit Act 1974.

Where the document embodies an agreement, of which at least one part is a credit

agreement not regulated by the Act, the word ‘partly’ must be inserted before

‘regulated’ in the heading – unless the regulated and unregulated parts of the

agreement can be clearly seen to be separate.

 

2 The name and a postal address of both trader and customer.

 

3 A description (in sufficient detail to identify it) of any security to be provided by the customer and a description of its subject matter. The description must be in the main agreement, but the full terms can be in a separate document referred to in the main agreement.

 

4 Details of any default charges which the customer or a relative of his is required to pay if he breaches the agreement.

 

5 Certain financial and related particulars (see below).

Hiya Falcon, Many thanks for your response. I will have a proper read later on tonight. I have another question also. They seem to put on a hell of a lot of "Interest Posting" on my statements every months which are just as much as I am paying back.....is this right as the loan in effect will never seem to go down. If i was paying 332.32 a month and they were putting 295.66 each month back onto the account, where do I stand on that?

 

 

 

Hello Alley-Cat, Interest posting is big at the begginning because by rule 78, that has been applied to our accounts, you pay more interst and less loan ammount....So if you cancel in the middle of the contract the interest more or less would be paid off(including PPI and Medicare)... you can check the thread Rule 78 unfair? could we claim on this alone? It helped me to understand WF statements...including Interest posting charge.

Have you got the scanner connected to the PC and all the software installed? If so then scan the image in (making sure you edit out personal details) and save the image. Goto Image hosting, free photo sharing & video sharing at Photobucket and sign up for an account. When youve signed in you should see an upload box on your albumn page. Select that and upload your scanned pic to photobucket. after it has uploaded, you should see a thumbnail of the pic together with 3 link boxes underneath it. select the pictures URL it will say coppied when you click to highlight it.

 

Come back to this forum and post a reply. Using the yellow square with like a landscape on it (when you put your mouse over it, it says "Insert Image". Click that and a box will open for you to put the URL that you coppied off of photobucket. Past the url in that box and select OK. Then finish your post and you should see your scanned pic in it.

It is fairly easy and if ive made it sound complicated, forgive me!!

Hi again , hows everyone doing with there claims againt welcome, I need some advice pleeese.

I have 4 accounts to claim on with welcome but dont know the account numbers so sent them the letter asking for account details i even put when loans were took out and the monthly payment so thay can chase it , but I got a letter back from them today stating that I need to do a full SAR and send £10.00 which I dont mind but they say they need account numbers .

I told them in letter I didnt have account numbers thats why I sent it asking for account numbers ( the muppets)

anyway any idea on what I do now ?

Im guessing that these 4 accounts are now finshed in duration?

If so, try calling in to your local branch on the pretence that you want another loan and ask them if they can tell you if the last ones received their final payments. They should have the details to hand and it sounds like theyre stalling. if they got the details up ask them for a printout to verify it with your records.

i have wrote to welcome numerous times, they sent me a photo copy of loan agreement, with wrong house number on it, no date in signiture box, no terms and conditions. i have wrote about there unlawful fees, mis-sold ppi and the cca request, i received standard letter about 3 weeks ago we are looking at ur complaint blah blah

since then nothin, really looking forward to there reply coz they are a bunch of half-wits especially the managers a while ago i received letter from manager apoligising that wecome staff are not trained properly his words not mine, and the dates he put on the letter were wrong to when the loan was taken out muppet.

so its all quiet on the welcome front maybe i should start ringing them 8 times a day and banging on the doors of there offices.

as they say whats good for the goose is good for the gander.

they are saying they will not contest the claim for charges but only up to 6 years, then they will use the limitation act to stop me from claiming past that. They have also said that they will be defending the claim for PPI as they do not believe it was mis sold and even if it was they will use the limitation act to stop me claiming. I think i may have a way of avoiding the limitation act but obvioulsy dont want to broadcast it on here... if you think you can help then PM me. x

Right I managed to get 4 account numbers over the phone from welcome finance ( believe it or not ) sure thats a data protection issue

anyway about to send a posta lorder for £10 with SAR and just wondered who i make this out to is it welcome finance or there other name progressive finance ?

I think its £10 for each account coco, but id send them to welcome as thats who theyre trading under at the moment!!

Vodafone overcharged Vodafon.. anything that could be done?

Wahayy...full arks for effort and persistence!

Ive had a brief look through them overflow, the one thing that immediatley sticks out, Did they sign the agreement or someone on their behalf?

I'll look through when I have bit more time later.
