  1. Hi guys, just a quick update, I received my letter of "goodwill gesture offer" of £7732 - what I was asking for so just hanging on in there for the cheque to come now........
  2. deedee, I filed straight to MCOL, paid my fees, papers were issued to the Halifax on the 30/5/07, they acknowledged on the 7/6/07. I rang every day and sent them a letter to say that I am willing to come to a settlement and cancel any proceedings. Kept ringing and finally got an offer of £3866, didn't sound enthusiatic and I was asked how much I was looking for, I told him £8017, thats is minus interest but including court costs. He agreed to pay me in full for the 6yrs of charges minus the court fees - I was happy to accept that! If I can be of any further help, I will be.........Keep strong and don't take no for an answer! The banks are quick enough to take our money but they are sure slow on the mark and their procedures come out before paying anything back that is duly ours. Keep up the fight....... Jo x
  3. Guess what guys........Just rang the Halifax and they have settled over the phone £7732........will believe it more when I get the cheque within 14 days!!!!! OMG can't believe it still Jo x
  4. Emma, sorry to hear of your loss......keep strong. I have got a battle with the Halifax also, I have got 01977 627 280 as the Customer Relation contact and I am ringing them daily with my reference number and asking them for updates..... Take care, keep us posted - all the best Jo x

Hi all, just a quick update - i spoke to a chappie at the legal dept and he has advised me that they have reviewed my claim and a letter was sent out on the 11th (may have missed the post and have gone yesterday) and it is an interim offer! not got it yet but will let you know when I do - I am hoping tomorrow Fingers x'd Jo x

CONGRATULATIONS TO YOU.......I have been ringing everyday to the legal dept and am being fobbed off with "can't give you a time", "its in the queue to be dealt with" "its being reviewed" - ITS DRIVING ME NUTS!!!!!!!!!!!. Can anyone offer words of wisdom as I am getting a bit nervous as they have acknowledged and intend to defend the claim - giving them till the 2nd July.......claim is for £8k Any advice and encouragement is very much needed - Jo x
  8. its all very interesting reading and I am so scared, I filed my MCOL and they have acknowledged and intend to defend all of the claim. They have till the 2nd July to enter a defense. I am soo scared of them turning up and throwing it back in my face. Has anyone had problems when it gets to this stage? My claim in total is for £8020 Jo
  9. Hi there, I just wanted to say a big thank you to Yoda for doing what she did. It has given us all inspiration to exploit these money making scams that are so against the law but I am currently taking the Halifax to court as over the last 6 years alone they have stung me for £7,767 thus at times leaving me overdrawn with no OD facility, leaving no money for bills to pay or any money for day to day living. I am waiting to see if they pay up or chose to defend this in court but I will be figting it all the way as my benefits for my daughter were paid into the same account. Jo x
  10. Just a quick update, i filed me MCOL on Friday 25/5/07 and it has today been issued so the Halifax have 14 calendar days to respond. That will be nice - lets hope they pay up - i need some encouragement as I am getting nervous about going into court - if it comes to that?

Hiya thomasl - i am in ezactly the same boat as you - I got a "we are happy that these charges are justified" letter from Halifax and last Friday (25th) entered a MCOL online and have just spoken to the courts and the paperwork is going to be issued tomorrow 305/07 b4 10am, they then have 5 calendar days to acknowledge receipt and a further 14 calendar days to enter a defence........will keep you posted.
  12. Hi guys n gals - I am new to this thread but would like to update all claiming again Halifax, I requested my statements by phone, received them within 2 wks. Sent my 2nd letter off requesting payment of bank charges that had been applied to my account over the last 6 years. Gave them 14 days, Heard nothing so I sent them the LBA - again giving 14 days - was told when I rang then I would hear no later than the 4th June.....I then got a bog standard letter saying that their charges are justified blah blah blah - so I hesitated but realised that they have taken over 7k from me during the last 6 years and into that account has been paid my child tax credits and child benefit. I sent off my MCOL on Friday 25/5/07 so will wait and see if they do pay up........Any advice would be gratefully received - Jo
  13. just another update, I have today sent off my claim to the MCOL and sent a copy along with a letter to the Halifax registered post - so we shall wait n see what becomes of it all.....
  14. so just to put my mind at rest, is it a scare tactic to us as they don't want to pay out or is it really worth going to court over after Halifax have "reviewed" my request......I am scared that I will lose my money to go to court and slightly intimidated......what would you advise?...........Jo
  15. Hi guys, a further update, I have had a response from the Haliprats and they are saying that all charges are Justified! How! so there will be no refund. Is this the end or can I take this to court???? Please any advice would be fantastic!
  16. Hi there all, I have read with interest the goings on with the Haifax.........I too have had good response from them till now. Firstly I rang to request my statements, they arrived within 3 weeks (and they didn't take the money for them!), I sent my first claim to them for 2 years which I had stored in my paperless account then I sent off a second letter with the remaining 4 years of charges to be claimed back. I have had responses to both letters saying that I should hear from them no later than June4th......only round the corner I know but I have further more sent them the LBA as I have given them the 14 days to respond, no response, so am going to go via MCOL....it will cost me £250 for this but am claiming £7767 back so worth it I believe - if anyone has any advice - I would be truly grateful............Jo x

I have had a letter back from welcome regarding my charges and they have offered to give it back to me on the condition that it is taken off my loan and not given back to me as cash........I wouldn't mind doing this but they made me feel like it was the only option I have.........has anyone else had this sort of response from un-welcome?
  18. well further to my comments regarding PPI and Charges, Welcome have offered to pay me my charges and take it off the current loan I have with them but I have asked for it to be paid direct to myself or direct into my account not off the loan (money would be nice at the minute) however, they are playing silly buggers with the PPI claiming that it was not mis-sold as I have not at any time cancelled it or argued that it was not necessary......I will load my response from them on this later for some advice.....
  19. hiya all, just a quick update, I have sent off my LBA last Thursday recorded delivery but I had a letter from the Halifax today saying that they are looking into my claim and should respond to me no later then the 5th June 2007. Come on.......I hate this waiting game, got over £7k to come back over 6 years so am so looking forward to receiving that....
  20. Suze, I have sent off yesterday my LBA letter to the Halifax and have only requested my unlawful charges - no interest at this stage - rightly or wrongly am not sure but will be looking out what to do next anyway
  21. Thank you for that "itsmeandonlyme" - I have read with interest and have sent my letter of response back to Kieran at Welcome and see what he says to it. I have also sent a letter regarding my PPI claim which he failed to recognise so lets hope we get a better response than before......
  22. I have today received a response from the compliance dept in nottingham. The letter states: "I have investigated the issues raised and can respond as follows. Fees applied to your account are in line with our standard charges for collecting overdue payments. This is provided for contractually in the terms of the agreement(s) signed and out standard rate of charges is supplies to customers taking out their agreement(s). I note your reliance on Office of Fair Trading (OFT) guidance is in relation to credit card, bank overdraft, storecard and mortgage default charges and not those of a regulates secured loan agreement(s). The guidance involved the OFT insisting some of the credit card companies reduce their charges to £12. Given that we only charged £5 for each letter and telephone call we are obliged to make, we cannot agree that these charges are disproportionately high. Our records indicate that you were sent a letter on 31st August 06 explaining the new charges payable should you breech your agreement, which took effect on 15 Sept 06. These new charges incorporate a £10 charge if we have to telephone or write to you. Please note these charges are only applicable if we have to initiate contact with you where you have not fulfilled your contractual requirements. You will also note this guidance is not in relation to PPI. As a result I am unclear on what grounds you seek to recover your PPI premiums. On receipt of such clarification, I shall be happy to consider the matter further. Kieran Scothern, Compliance Officer" Please advise if what they are saying is correct or can I pursue the charges in more detail? I am going to pursue the PPI as each loan we have had , my hubby was self-employed and surely that would not have covered him?? Sorry this is so long but am desperate for some advice.

  24. I have filed 2 claims into the Halifax and their time is now up as of Friday 27th April and today, I am due to send the next letter (LBA). Do I send copies of the letters and statements which they already have on my file? it seems a waste of time to copy and send them all again.........please advise me

Hiya guys, I have had a letter today from Welcome Finance saying that they are looking into my claim for PPI and Charges over 7 of my old loan agreements and they hope to respond to me within 14 working days. I have found this to be polite upto now, so am hoping that the path will run smoothly. I rang and asked for my statements with our current account manager, they were sent out within 2 working days (impressive ), I then drafted up my letter and faxed it over to my local branch who have acknowledged this and hence the letter when I arrived home tonight.......will keep you posted
