    • Hi and thanks It looks like they ticked all the boxes to me but I'll try and upload the notice. I was wondering if a witness to late delivery might be considered proof - I'm assuming they posted it as normal but Royal Mail stuffed up delivery. If not then they're really saying it just has to be posted within 12 days of the incident, regardless of when it is received.     • ROFL - dont get upset just because someone (quite a lot of someones) dont want smart meters - well unless you get paid for it .. in which case ...   I assume you haven't been with Octopus long enough to be on one of the very long fixed price tariffs they offered before the prices went bonkers .. and that you dont use your electricity in the evening/lunch time if you think the 'agile type tariffs are good value .. let alone worth installing a smart meter for - high price a good disincentive for an evening cuppa eh? Let alone all your computer/tv etc time in the peak price evening or lunch time. - and boy do those peak prices instantly hammer your bill when those Russian and middle eastern issues kick off.   I would only have considered a smart meter if solar panels had been an option for me - but roof is oriented completely the wrong way. Oh - and My opinion hasn't changed since the smart meter trials 40 years ago, because neither have the issues (well not enough) but I'm happy for you. Be happy for me.

    • Well naturally if you want to maintain your outrage, and retain something to bitch about, then arguing about the level of your fixed monthly DD is the way to go. You are of course perfectly free to ignore the easy solution.
    • His financial situation isn’t great, and the landlord has made lots of things up. The things he’s put isn’t true at all. My friend did tell the full truth with incoming and outgoing, I helped him fill in his form and he checked bills etc. to make sure it was right. His wage is ok, but not as good as the landlord thinks it is,  and he doesn’t have anything spare. How much are they likely to take from him? Should he send any reply?  the letter just says to take the court letter with him.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Welcome Finance! I'm sorry I ever set eyes upon them. The problems they cause are riddiculous. I have been asking for a statement of my account for two months now. I told them I need it for a solicitor for an Asset declaration for court. They keep telling me it will be in the post or pass the buck to someone else. Perhaps they have something to hide? Going to try again then send a letter complaining. They are a bunch of Asses.

erm... i am desperately in need of extra cash. and was about to take out a loan for maybe £2000. the settlement figure, after a 1/4 is something like £1795 and repayments would be £105 a month for 3 years. Now... i can afford this.

 

are they ok to deal with if repayments are kept up to date? or should i still steer clear?

If I was stuck for money as I have been in the past and I knew what I know now about Welcome I would steer well clear. They handle the loan files very badly and are very shy at sending statements. When you have a problem and you approach them they talk to you as though it is your fault and not theirs as the case may well be.

So my advice is dont go there, try somewhere else.

just talking off of my thread

i am in the court process with welcome over 2 accounts, this is ref lousy agreements,unenforceble.

all i am after is the defaults removed.

in there defence they are saying they court can enforce the agreements

need advice on this one

You say the agreements are lousy and unenforceable.......

 

are you sure of this, i must admit that a LOT of Welcome agreements are crud, theonly way to get a positive answer is to post them on here and get an oppinion

next point

if you do a modified agreement, does that entail a whole new agreement, or just a notification of modified agreement to sign

also the extras, ie warrinty, breakdown, collision call etc

if details not supplied in sar, but on agreement, and cannot produce policy etc,

where does that leave the legality of the original cca

 

just thinking out of the box

I phoned welcome and asked for a settlement figure which was quoted at around the £2800 figure in December but now has gone up by afew pounds rather than down.

I have written and asked them for a statement (which they are rather shy of sending) as I was paying 4 weekly and the interest was being applied the same way (4 weekly). I have suggested that they have overcharged me in interest and I am now awaiting their reply.

My account has been with them for a few years. I was paying 4 weekly and noted on the statement I actually managed to get from them that the interest was being applied at a 4 weekly rate and at least 3 quarters of the amount I paid was interest. I have the agreement at home. This is an ongoing problem and I have threatened to complain to the fiancial ombudsman or the FSA if my complaint is not settled to my satisfaction. I note that they have applied payment protection although they said they would not bother. I have used it in the past though. I just think they are a bunch of sharks and the interest rate is above what it should be. I have changed the payment to monthly now.

Been off this site for about a year and only just recently on. Had a quick look through the thread but there are soooo many pages. I was one of those idiots that kept taking a new loan with welcome every 10 months or so. I am pretty sure they kept adding PPI on. I was told i wouldnt get the loan without PPI. I paid them off with another loan a few years ago. I did do a SAR last year but info they sent was incomplete and they said they couldnt find my agreements. Because i have paid them off is there any way i can reclaim the PPi as they forecd me to take it and I didnt want it but needed the loan(s)...Also when I had a look through docs it looked like PPI was never refunded when I took out a top up loan, just a new policy charged again. Can I di anything about this seeing as I have paid them off? I only found out about mis-selling of PPI once I paid them off. Will have a look around more on site in next few days but single mum of toddlers and work full time and dont drive so by time I get home and see to kids and get them bedded my free time is limited! Any pointers to relevant pages appreciated. Found the email adfdress for CEO of cattles on an earlier thread so thats handy....Thanks to guys who posted that.

Hi, I'm not too sure if you can claim the PPI back. I would think if you have proof that it has been mis sold to you then you could.

As you know they are not the most helpful people to deal with.

I am battering them with letters but they never reply. I am going to check and see if I can claim PPI.

I dislike them with a vengance. They cost me lots of money.

I have just dug out my agreement with Welcome. The orignal load in 2005 was total amount £6101.66 including PPI of £1676.43

The settlement letter tells me the loan was £8685.58

I am writing to them straight aay to see what is going on.

Can I reclaim the PPI and even more so what about the quote being £2583.92 difference?

isnt it about time the oft or fos take a look at welcomes books

i know from experience what they are like

no statements

covert charges, so know one knows how much is out standing

ignoring letters and legal requests etc

 

how do they keep getting away with it

I have been on the phone about the discrepencies in the amounts quoted. I have also written a letter asking for a refund of the PPI which they told me they would not be adding but did add on. I was quiet intimidated at the time when I think back to the agreement date 6.5.2005

There were three of them in the office when I went there.

At least I'm going to fight this one with them and get what is mine of them.

Are you aware that judging by the date of your agreement Welcome were regulated by FSA. Also that due to this fact the FOS will take on your claim for mis-sold PPI and will look into it for you. Its a slow route but stress free pretty much.

I am currently working on my welcome claim myself and it was standard practice for them to state they could offer a loan if you took out PPI. Therefore due to your financial difficulties you were forced under duress to accept this PPI policy IMO.

With regard to welcome I still have not been sent a statement. But the good news is I have got rid of them by paying the loan off. I undercut them by £500 which I am quiet happy about. They told me they would send a letter confirming the settlement, that was three days ago, I'm not holding my breath. I cancelled the direct debit and as far as I am concerned its good riddence to them. I wont pursue the PPI as I dont think I will win it. Once bitten, I wont be dealing with them ever again.
