    • Thank-you dx, What you have written is certainly helpful to my understanding. The only thing I would say, what I found to be most worrying and led me to start this discussion is, I believe the judge did not merely admonish the defendant in the case in question, but used that point to dismiss the case in the claimants favour. To me, and I don't have your experience or knowledge, that is somewhat troubling. Again, the caveat being that we don't know exactly what went on but I think we can infer the reason for the judgement. Thank-you for your feedback. EDIT: I guess that the case I refer to is only one case and it may never happen again and the strategy not to appeal is still the best strategy even in this event, but I really did find the outcome of that case, not only extremely annoying but also worrying. Let's hope other judges are not quite so narrow minded and don't get fixated on one particular issue as FTMDave alluded to.

    • the claimant in their WS can refer to whatever previous CC judgements they like, as we do in our WS's, but CC judgements do not set a legal precedence. however, they do often refer to judgements like Bevis, those cases do created a precedence as they were court of appeal rulings. as for if the defendant, prior to the raising of a claim, dobbed themselves in as the driver in writing during any appeal to the PPC, i don't think we've seen one case whereby the claimant referred to such in their WS.. ?? but they certainly typically include said appeal letters in their exhibits. i certainly dont think it's a good idea to 'remind' them of such at the defence stage, even if the defendant did admit such in a written appeal. i would further go as far to say, that could be even more damaging to the whole case than a judge admonishing a defendant for not appealing to the PPC in the 1st place. it sort of blows the defendant out the water before the judge reads anything else. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Me too, £25.00 a letter and a Fiver for a call out.

Should stop calling the 0898 numbers at a Fiver a go then. Erratic!!

I only mouth my opinion, please look elsewhere for sensible advice! :)

Hi guys

 

So glad to hear there are other 'Welcome fighters' out there (love that tag). Don't know if this is useful but there is a few things I have asked the OFT etc to look into for me:

 

The PPI for a start - if you read the contract is states that welcome arrange this for Norwich Union who hold the records. I am putting a DPA request into them direct for anything welcome have submitted in my name (inc. the amount paid on my behalf for the insurance) as they seem to charge random amounts for PPI and it would be interesing to know if they cream a profit also without us knowing and how much Norwich actually got, and just what gumph they have said about you to get the premium?

 

The interest rates - under the Non Status Lending guidelines (on the OFT website ie people with credit/financial history problems etc) and extortionate rate of interest is illegal and will render the agreement void - have asked to have the term extortionate clarified so we can fight.

 

The early settlement figures (my favourite). Turns out - in the Non Status Lending guidelines again, companies like welcome have been told explicitly NOT to use the same calculation as the banks etc (called Rule of 78) to calculate your rebate if you settle the loan early. It gives them an unfair profit. Every loan they have ever settled has used the Rule of 78 - states on their contracts - calculated by the CCA 1974 etc- OFT is checking.

 

Lastly - watch out if you pay them weekly. They take your monthly amount and just divide by 4 to get your weekly amount. There are so many 5 week mnths in each year so they make extra £hundreds per person over a few years as sometimes they just tick each month as complete and not what you have ACTUALLY paid weekly!

 

The OFT are probably alreay sick of me but Welcome picked the wrong person to con with me. Hope any of this helps and will let you know answers when I get them.

 

PS - their Data Protection licence states they may NOT transfer consumer data outside the European Economic Area - their contract says they will. Bad boys - have reported this to the information commisioner also he he.

I received details of my Welcome DPA this morning but unfortunately the post arrived after I went to work. The bad news for Welcome was that I wrote a very snappy letter last night to them and I posted it first this morning. Originally this account was with Watson Finance but they folded up in Jan 2004 and Welcome took over the account. The first thing they done was add on £75 for a Disbursal of fees (any idea what this is) I presume everyone that was with Watsons got hit with this. I told them that I required full disclosure of what paperwork they received from Watsons but needlessto say, no paperwork on that score. I requested a copy of their terms and conditions and once again nothing. Throughout the account statements the rate of interest charged is full of flaws. There is a difference in the rate of interest charged each month but the amazing part is they are charging more than £11 of a difference when the balance is lower than the previous month. I am back on the phone to them tomorrow and when I find out their monthly rate of interest I am going to rewrite the account history leaving out all the charges and then I file I will be doing so using the contractual rate of interest.

I'm curious about all this talk about statements, I've been with Welcome for just over two years with a H.P. agreement and have never had any kind of statement from them yet!

I only mouth my opinion, please look elsewhere for sensible advice! :)

Since Jan 2004 when they took over handling this account this is the only time I have known what the so called balance was on the account. It was not until I put in my subject access request that I discovered what they presume I owe them. However by the time I am finished with them there will be very little left on the balance.

we were with them for a few years and the only letters we got were for us to contact them, they stated that they had tried contacting us by phone but never got any answer, thats bull as we have a voicemail system on our phone, they never sent us statements either. I'm looking forward to what they do send in reply to my SARN it could be very interesting reading and almost certainly financially beneficial to us! ;-)

Same here, I've scrapped the direct debit instruction as the dates they took it out on were erratic and have told them that I will ONLY pay by bank transfer. They refused at first saying that they could collect the payment at a cost of £25 per callout (no chance) or I could take it in to the local office. I did this for a few months but then they relocated, they are now a 20 mile round trip away.

 

I told them therefore the only acceptable method was to pay by bank transfer, that way i have complete control. Again they said "not possible" so I said "Sorry you won't be getting paid then, refusing my offer of payments isn't going to look very good in court".

 

Surprise surprise they agreed to accept future payments this way and said someone would be round to collect the last manual payment (without charge) today. Sure enough they have tried to ring me all day - a total of seven times - and keep leaving messages on my mobile and landline. this is despite the fact that I have officially requested that they stop ringing. I came home form work then via the back dor popped round to my neighbours. Within 30 seconds their collector was banging on the door and shouting through the letterbox - I stood and watched all this from my neighbour's window!

 

She must have seen me go in the house and assumed I wasn't answering as she was there a good ten minutes then came back again 5 minutes after driving off. This is completely unacceptable - I don't get this much grief from the average bailiff and it's not as if the payment is overdue!

 

My only problem is apart from any charges they might have put on the account (illegal obviously) and the extortionate interest rate I don't think I've actually got any sort of case against them.

I only mouth my opinion, please look elsewhere for sensible advice! :)

I belive they are nbot allowed to call at your door unless by prior arrangement with you. I had them knocking on my door too until I told him that I would report him for harrassment and if he didnt leave my property I was well within my legal rights to escort him from my door using minimum ammount of force necessary obviously :-D Needless to say, he left prety quick and they stopped knocking especially after I rang the Branch manager and told her he was trespassing;-)

I'm dealing with Welcome too. My loans are paid off and were originally taken through a company called Macadam Finance in Aberdeen. I kept getting top up loans with them and one time I paid over a third of the loan off two months after I took it and received no reduction in insurance OR interest. They dont list any insurance on the only loan agreement I kept but I remember when I went into their office they had a few bits of info cellotaped to a desk! Plus they followed that 1974 rule for early payment so I dont think I got any refunds when I paid one loan off with another. Was needing the money at the time and my credit rating was shot to hell although I think it was mainly cos of my mums stuff and the fact I had never had a credit card etc. I sent my SAR and CCA request (Enclosed £15 as am not sure how many agreements I had) last week to the local branch so am just waiting a response back then will ask Nightmareforbanks and anyone else on the forum if I have any kind of case. They forced you to take their insurance but will be curious to see if its mentioned anywhere as may be stuffed on that part if its not mentioned?! But yeaI dont think companies that charge THAT amount of interest should get away with the rule they use for early settlement. Good luck to everyone and I hope companies like this can stop getting away with exploiting the poor or people not so great with their finances.

is the car on credit with Welcome and was the SAR in relation to that loan account or a personal one? I cant see it having any bearing on either to be honest, at the end of the day your looking for their faults to be rectified and get back whats rightfully yours. ;-)

Sorry for jumping on this thread but I don't know if this of any help to any of you but as i have just got over £2000 back from welcome. Welcome have got a complaints devision at the head office in Nottingham. Forget about your local office, write directly to the complaints department.

 

If that fails, don't contact the FSA because they wont be able to help you. Welcome are members of the FLA Finance and Leasing Association. The address is Imperial House, 15-19 Kingsway, London WC2B 6UN. website http://www.fla.org.uk

 

They will want all written copies of what you have already sent to welcome plus any copies of replies etc. If they think you have a case, they will take it up on your behalf. Welcome then get 21 days to respond.

Good info Surreylad.

I to have an ongoing battle with welcome. I never sent in a SAR request. Just a request for a statement of account and copy of my credit agreement.

I am now paying them a tenner a month, but can see from my statement it is littered with charges.

Damn right I am claiming them back.

Should i still send a SAR? This is one debt i really wanna get paid off before I take a baseball bat to my collectors skull. Especially if he comes around to my house uninvited again.

Sorry to hijack the thread but i've had 3 loans from Welcome over the last 6 years, although i've never been charged for late payment etc, would i have a chance at the PPI - i was made to take it with every loan?
