  1. Hi Falcon Welcome Finance took over the business of Watson Finance who my wife had a loan from and immediately they added on £450 to the balance. They claimed that this fee was legal cost which had to be bore by all persons who had existing accounts with Watson's. Some time ago I received my wife's statements from Welcome and I redrafted the account, taking out all charges including the £450 and recalculating the monthly interest and presented them with the new account. They were showing a balance of £1,258 and the new account showed £217. After many months of letters back and forth they sent an agent out to the house. He said that Welcome would take £500 off the account if I would drop this complaint. I refused. Eight weeks later I got the court papers back and got them served on Welcome. Four days later they telephone and told my wife that the account was cleared off. File the papers and take them to court and they will settle immediately. Cheers

  3. Hi Mjanet I started my claim against Lloyds TSB in the middle of August and now I am just waiting for a court date. I received a copy of Lloyd's allocation questionaire from their solicitors. It states that they want a further month's grace and in addition they are not able to go to court throughout the month of December. Their defence is woeful and goes on and on about me accepting their terms and conditions when I opened the account. However one point that throws me is the fact they state that they will call an expert witness. I have never come across this before when looking at other peoples allocation questionaires. The claim is for over four grand and with the interest added it is just under the five grand. I reside in Scotland but I filed in Willesden County Court in London because of the £5000 smjall claim's limit in England. I looked into legal precedent in relation to jurisdiction before I filed. Lloyds defence makes no mention about challenging jurisdiction so does this mean that they cannot introduce in court. If anyone has come across the expert witness thing before I would like to hear from them. Tony

  6. I think that Lloyds TSB will certainly defend my claim in court as I expecting them to challange jurisdiction. However I am looking forward to the challenge. Tony

  8. Hi Seylectric Since Jan 2004 when they took over handling this account this is the only time I have known what the so called balance was on the account. It was not until I put in my subject access request that I discovered what they presume I owe them. However by the time I am finished with them there will be very little left on the balance.   9. Hi Dipply 75 I received details of my Welcome DPA this morning but unfortunately the post arrived after I went to work. The bad news for Welcome was that I wrote a very snappy letter last night to them and I posted it first this morning. Originally this account was with Watson Finance but they folded up in Jan 2004 and Welcome took over the account. The first thing they done was add on £75 for a Disbursal of fees (any idea what this is) I presume everyone that was with Watsons got hit with this. I told them that I required full disclosure of what paperwork they received from Watsons but needlessto say, no paperwork on that score. I requested a copy of their terms and conditions and once again nothing. Throughout the account statements the rate of interest charged is full of flaws. There is a difference in the rate of interest charged each month but the amazing part is they are charging more than £11 of a difference when the balance is lower than the previous month. I am back on the phone to them tomorrow and when I find out their monthly rate of interest I am going to rewrite the account history leaving out all the charges and then I file I will be doing so using the contractual rate of interest.   10. Hi Lisa Just made out a diary of claims I have pending right now (thirteen in total) and they are all at various stages. I have just discover that this mob GE Money have not replied to my first letter six weeks ago. Right now I am going to send off my DPA to them and watch them very closely. I will let you know when I bring them to their knees. Tony
  11. Hello All Just came back home after personally lodging my DPA with Welcome Finance. I also told them in the letter that I was putting the account into dispute and they were not getting a penny more until either they settle up all the charges or the court reaches a decision. All told I left them a very unhappy bunch. Tony
  12. Hi Falcon 185 Wrote to them 3 weeks ago, recorded delivery and they have not replied. First thing Tuesday morning I am taking my DPA into the main branch in Glasgow. Gonna file against these sods as soon as I get the information on the account from them and there 14 days are up. Tony
  13. Zuzu Never to late to include the interest. Include it when you send in your schedule of charges to the court. I received a 4 line reply to my letter prior to court action against Lloyds TSB yesterday. It stated that the bank's decision not to refund the charges was final and that they would not be entering into any further correspondence on this matter. I visited the post office today and my claim will be with the court for either tomorrow or Friday. Tony
  14. Sweetpants How are you getting on with Sainsbury's. First letter sent recorded, no reply. Second letter sent recorded along with a copy of first letter. Usual sorry but no joy letter received. DPA sent along with £10 cheque, they took 22 days to cash it. Statements due mid November, wait to file against them. Tony
  15. Hi Bankfodder Everything crystal clear now. I will be filing online on Thursday. I hope I get my trip down south for a holiday but I reckon that Lloyds TSB will deny me my day in court. This one is the first, I am awaiting the results from six other DPA's for family and friends. Cheers Tony
  16. Hi All Time to file on Wednesday against the TSB, desperately needing information. Can anybody tell me if a person resident in Scotland can file their claim in England if they use a friends address down south. My claim is too big to go through either a small claim or a summary cause in Scotland and the court has told that I would have to file an ordinary cause. Any help would be appreciated Tony:D
