So after a 14 day investigation with p2g i had a live chat with them yesterday ( 8th June) who said they didnt know where the parcel was but closed the case as i didnt take out their protectiove insurance.  So now at 07.33 on the 9th of june i was repling to this thread with all the relivent information to start a claim and i check the tracking of the 'Lost' parcel for specific dates to find the tracking has updated and the parcel is now at the recipients local depot  ? which is annoying because ive already refunded the buyer as i didnt want any negative feedback as it was an ebay listing and id want a refund if i was in his postion. So i posted the parcel with Evri on the 20/5/24  The delivery date was missed due to it being sent to the wrong depot and a case was opened on the 25/5/24 14 Investigation failed to locate the item in Evri's system and case closed on the 8/6/24 and now the tracking has updated on the 8th saying its at the recipients depot so is likey to receive it in the next few days .... Typical.  Oh well nevermind , thanks everyone

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Deller, I sent off my aq on 7th dec, they had till 18 Dec to lodge theirs, I have heard nothing since, should I phone the court and check of progression, thought I might have heard something by now even allowing for the xmas break etc?

Well this is the moment I've been waiting for, got home from work to find I'd missed a special delivery.

 

Rushed to P.O., and yes, cheque for full amount (bar the AQ fee:( )

 

Letter read as follows:-

Should I bother trying to reclaim the AQ fee, or is this gonna be more hassle than it's worth??

It took me about 3 months from start to finish but well worth it in the end. I actually used the MCOL route for my claim and you can see the whole process by reading through the thread, it is a bit of a long one but may help you get prepared.

Once you start your claim, start up your own thread in the Nat West forum then you'll be able to post up your progress, and ask questions and seek guidance. We'll be there to help you every step.

MCOL is money claim online, you can also use the N1 route which means filing your claim manually through the courts.

can any one help cobbets put this in section g case management cannot be proposed until the claiment serves a reply for further info which was due on jan i sent all info it says in light of this the defendant may amend itd defence or apply to strike out please help aq was sent in by cobetts on22n jan i had no offers i go to court on 11 april 2007

Hi everyone - first off I am completely new to this forum and have been reading all of your posts with great interest as I have just started the legal proceedings against Nat West for my daughter in law - just want to let you all know that your posts have been invaluable and that I seem to have made a few mistakes with my on line application for court procedures :-( anyway with your advice I may be able to recitify this. We sent our 1st letter to Nat West branch where the account was held - we had a reply saying that we should contact customer services - the 2nd letter was sent to both customer services and the branch bank informing them that we would accept a reduced amount if they would contact us within 14 days - the branch again told us to contact customer services and we have had no reply from nat west customer services - we have today filled out the MCOL form on line - now we are just waiting to see what happend - must admit not looking forward to going to court.

Might be an idea to start a thread in the Nat West forum (if you haven't already done so), you'll be able to post your progress and queries there and you will find invaluable experience from people who have been through or are going through the same procedure as yourself.
