ok so heres the story lol, and a short one at that....

 

Basically in moved in with my partner and he is claiming JSA income based(and still is), i had to make a claim also after moving from england to ireland. But i was awarded jsa contrib based.

 

I started gettting paid in June. My partner did fill out a change in circumstances form when i applied for JSA, stating that i had moved in etc, now as in today months on we get a letter saying they have had notification of me living with him which they should already know, so now im panicing, like i do thinking well theve been paying us separatly he been getting his income based and iv been getting my contrib based. so if someone could explain to me whats gunna happemn next it would help! the letter just stated that i give my name, national insurance number and date of birth and date of claim. help!! Is this an error on their part? Surely me and my partner arnt responsible for them being lacks a daisy in not updating their system quicker....??? My initial worry is them saying we owe them money... i think to much lol

Normally your cont based JSA would be deducted from his Income based JSA, which would be paid at couple rate.

 

If you and he did everything right in notifying the DWP and completing the appropriate forms, then any overpayment would be official error and not repayable under social security law - of course they may still request repayment, but cannot compel repayment.

Thank you for moving the thread to the correct place :) and thank u for ur reply. Yes we definatly notified them nd filled out the relevent pperwork etc so if the tell us to repay wat do i say?

It depends on what it says in their letter. If they admit their error, then you write back saying that according to social security law, overpayments occuring as a result of official error are non recoverable. If they do not admit to the error, then you may have to appeal the overpayment on the grounds it was caused by official error.
