Hi,

Just wanted to say this is an amazing forum who has given me so much hope.

I am anotherwho got themselves into trouble. Got a small Wonga loan ages ago, then found it was hard to pay off, so got another one to pay off etc etc. Feel so stupid.

Makes it worse that for 10 years now I have been with Payplan (absolutely brilliant):whoo:

However i got these loan whilst with Payplan. I swallowed my pride and emailed them and they were great.

So loans were all due about a week ago (25th).

Have 4

Wonga - 1442.64 (5.80)

PayDayUK - 613.48 (2.47)

PaydayExpress - 800 (3.22)

PoundsTillPayDay - 1143.82 (4.60)

After talking to Payplan they sent off my financial statement that day. I pay £200 pcm to Payplan and upped it to £250 per month - this for me is stretch big style but was on their advice. The numbers in brackets are the offers to them as Payplan pay on a ratio system.

Payplan told me that PayDayExpress accepted immediately.

I cancelled my card and stopped all CPA with bank.

Issues

1. Heard nothing from PPT. Worried sick! Isn't that odd?

2. Wonga did send me email asking for I & E but spoke to Payplan who said ignore it as they were sent one anyway. Email says charges will stop for 38 days while they assess it (oddly today got an email from them saying they have charged me £20) so I emailed back and asked why based upon the email that said there would be NO charges.

3. PayDayUK are calling 4 times a day with all different numbers. Ignoring them. Again oddly they do not leave a message.

Any advice on what I should be doing would be gratefully received.

Pay plan seem to be doing a good job although advising you to stretch your finances to breaking point is kinda strange.

As for the constant telephone calls, send them the telephone harassment letter and add that any amd all communcTion is to go theough payplan from now on. some pdls like to agree to dmps but harass the debtor for even more money.

Many thanks for that.

Have you any experience of Wonga? Like i said previously annoyed that they sent a 'nice' email saying "Thank you for getting in touch with us. Now we aware that you are experiencing some level of financial hardship, we will freeze interest and charges on your account for a period of 38 days. We will also stop sending any collections related correspondence during this time." on the 28th August - day loan was due but Payplan sent letter by then and then today got email saying, "The following default sum is payable.

"A default sum of £20 for missed payment of your loan on the repayment date became payable on 2012-08-28.

This Notice does not take account of default sums which we have already told you about in another default sum notice, whether or not those sums remain unpaid.

The total amount of all default sums included in this notice is £20."

i sent an email to them asking why one said one thing and one another. I find the repayments to the 4 x PDL's very low. Do you think they will accept? That said this is all I can afford! Really worried about baliiffs, CCJ's etc.

Penalty fees are reclaimable. Which is what that is.

Court action, ccjs and especially bailiffs are a very very long way off. If it ever even happens.

Thanks once again @renegadeimp.

If i continue to pay them via Payplan I guess there's nothing to stop them at some point in the future getting the ache and going hell for leather to get the money back, as lets be honest, its going to take a LONG time for them to get it back via the small amounts that they are being offered.

That's what worries me a bit - that they all accept it (i doubt it somehow) but after a year they all kick off again and again its an issue.

If theyve agreed to payplan then any court would come on your side if they tried to geta court claim in while you were paying.

Right more help needed! I'm new to defaulting of payday loans so forgive me.

Have 3 emails today from Wonga, PaydayExpress and PaydayUK (they never stop calling!). As my previous posts explain I am with Payplan and 'apparantly' all 4 companies have accepted the offer. So therefore why the heck have i had all these email TODAY - when the loan is defaulted by less than a month.

And what is the best action? Ignore? I certainly am not answering the phone and told work to tell them nothing as well. I have already written and emailed to say that I only want email/letter communication.

Any ideas or suggestions would be extremely welcome.

Jon

WONGA

Please act now to avoid possible impact on your credit rating.

We are very concerned that, despite our previous correspondence and offers to help you resolve this matter, your loan remains unpaid.

Your balance today stands at £1099.5 and interest continues to be added at the agreed rate.

You must please call us on 0844 842 9109 if you are having problems making full payment and we may be able to arrange a staggered repayment plan. Otherwise, we may view your lack of contact as deliberate avoidance of your responsibility under our agreement. We can offer a range of solutions to help you. Please do call.

You can also visit the My Account section of wonga.com and choose the Repay My Loan option at any time. In this area of our site you can also select or add an alternative card, make whole or part-payments or agree a repayment plan at any time. You can also choose to repay us with your primary debit card using our automated payment line on 0845 862 1439

If the situation continues we will need to register the fact that you have not repaid your loan with one or more credit reference agencies and your credit rating will probably be impaired as a consequence. This is the last thing we want to happen and we would much rather reach a solution with you.

Please act now.

PAYDAY EXPRESS

We have applied for your loan repayment of £800.00 by debit card. However, the payment was declined. Repayment of your loan is due today and therefore we will make further attempts, today and further days, to collect your payment via the debit card details provided by you. Such attempts will include the full balance or lesser amounts. If we are only able to collect an amount equal to the accrued interest, then to assist you we may at our discretion defer repayment of the remaining balance of the loan until it next falls due . Interest will however continue to accrue on the outstanding balance during that period. If you do not wish us to defer repayment of the balance and would like to come to some other arrangement to pay what you owe please contact us immediately.

Should you not contact us and if we are unsuccessful in collecting at least the interest payment due, then as per the terms and conditions of your agreement with Payday Express, a default fee of £15 will be applied to your account. Interest will continue to be charged on the amount you owe.

If you wish to talk to an agent regarding your account or you are experiencing difficulties in making your payment then please contact our offices, within the next 7 days, on 0115 908 1162 between 0800 and 1900 Monday to Friday or 0900 and 1300 on Saturdays.

Yours sincerely,

PAYDAYUK (MEM CAPITAL)

Your repayment of £613.48 due to PaydayUK last month was not authorised. We were unsuccessful contacting you to resolve this and therefore your loan is now in arrears and the Recoveries Team are now dealing with your account.

We may still able to offer you a deferral where you will only need to pay a minimum of the interest * on your loan now. Your loan will then be extended for a further month so that you repay the full amount on your pay date the following month. If you would like us to defer your loan please confirm your pay date for the following month and your usual pay frequency. Please note: Short term or Payday loans should only be used for short term financial needs and are not appropriate for longer term borrowing or if you are in financial difficulty. Please borrow responsibly.

If you are experiencing financial difficulties then please contact our collections department on free phone 0800 280 2666 (Call charges may apply depending on your telephone provider) and one of our agents will be happy to help. Our Collections Team is available between 8:00am – 8.30pm Monday to Friday, 9am – 1pm Saturday.

Please be advised that payment may be tried at any time in accordance with the terms and conditions of your Loan Agreement. Your loan will be repaid using the continuous authority on your debit card you provided us with when you signed your loan agreement. If the repayment is not made, we will make further attempts to collect the money from your debit card, either in one payment, or in several amounts, on a continuous basis until the amount you owe is repaid. If you choose to cancel this, you will still owe the full balance and any interest on your account and must provide us with an alternative repayment method to ensure your account does not go in to default, which could, in turn, negatively affect your credit rating.

Kind Regards,

Recoveries Team

Ok. you need to put in writing, that harassing you for more payments when you are in a DMP is against OFT guidelines and you will be reporting them.

Also have a good read of http://www.consumeractiongroup.co.uk/forum/content.php?493-Harassment-by-telephone-response-letter

With wonga, its probably crossed communication. It seems to happen a LOT with them, despite them simply stating it is an "admin error".

Automated or not, they are still a breach of guidance under harassment.

OK that's great. Ignoring Wonga but find it worrying that had nothing at all from PoundstillPayDay - the one based in Malta. I did email them and Payplan sent them the normal stuff but heard nothing. Expect I will hear from someone else that they sold it to in due course!

Just want to big up Payplan. I emailed them to say that paydayExpress were doing my head in - calling work - emailing every few hours - texting and calling 8 times a day. Asked Payplan to help and they called them and it has stopped! Hurrah. They were not accepting the DMP but think they are now.

Well done. It seems that some PDL's sign up to the DMP, yet still think they can get extra by harassing the debtor. This is mainly because most debtors cower away and never inform the DMP of what is going on.
