    • Received a call and follow on confirmation email from the police about my cabinets! They wanted to confirm that I was prepared to support police action for the matter and that I would be happy to provide a statement and attend court at a later date!!! I think that something might actually get done - it won't get my cabinets back I know that but hopefully it will put a stop to this so called courier doing this to people!
    • Around a month ago I had to send a sympathy card to a friend in GB. Logistically it made sense to buy a personalised one on eBay and get it sent straight to my mate, rather than faffing around getting it sent to me.  This mighty purchase set me back all of £3.05 (including postage costs). I was taken aback that, when it was sent, I got a tracking number.  For a flippin' three-quid card!  I had no idea that technology had moved on so much and that tracking was so easy.  The shop has feedback for 16,300 purchases so tracking must be easy & automatic. It's unlikely your case will get to court, but in cases that do this got me thinking that we need to aggressively challenge the PPCs where they have lied about the timescales of sending their rubbish and have no proof at all of posting - when it would be so easy to provide it.
    • Thanks for uploading the appeal.  It was a waste of time but well done in not outing the driver. Why have your friends paid £60 they don't owe to a cowboy private company that have no means of making them pay as they don't do court?  If they paid by card, as I presume they did, they should get on to their bank and do a chargeback immediately. We call the £70 the Unicorn Food Tax.  The law specifically states they are only allowed to charge the original £100 but the PPCs and their bezzies in their trade associations allow this made-up extra £70 so £100 becomes £170.  Unfortunately for them the law doesn't. Anyway, snotty letter time.     • Thank god you're not a part of the tribunal! Terribly biased and negative.  HR isn't all knowing. And this case proves it. Thanks again for your opinion.  I'm not going to court because of a few emails, I'm going to court because the head of HR has invented a PCP solely for me, which no other employee is made to sit. The language used in the emails is discriminatory and inflammatory.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Yes I am aware about penalty charges for so called service fees and non direct debit charges.

I have successfully claimed them !!!

Theres no harm in asking a DCA to provide a breakdown of their true costs and taking them to Court too if thats what is needed.

I claimed charges that were applied after direct debits were cancelled or not paid too.....in fact I also got costs and that was just on the threat of legal action.

Hmm Martin3030 I never thought about that! Must count them up and go for it! Thanks for that comment as financial matters can start to escalate fast as nothing is 'free' in this world. I thought of going down the 'these banks are there to make profit' but think that could run on for a long time! ;)

Just a question

 

If you ask a bank to set up a standing order via one of there standing order forms and they set it up wrong then send u a letter saying they are charging u for the money not being there then can u argue they are responsible for the mistake not you?

Of course you can.

You would need to give them the usual 8 weeks to either refund the charges or else seek a final response.

If you could show enough evidence then I think just the threat of a complaint to the FOS would see them refund the charge-they know its very likely the FOS would rule in your favour.

You have said enough evidence would a photocopy of the form be enough evidence to say that u asked for it to go out on one date and the letter they sent be enought to say they set it up wrong?

 

I have a copy of the original form and there letter but thats it?

I think there could be a burden of proof needed on the delivery of your instructions to them-how did you advise of that ?

If you are certain on this then you could tell them that you will be making a subject access request which will reveal it WAS their mistake-if they KNOW it WAS their mistake,then they are quite likely to just refund it-especially if you tell them you will additionally be seeking the refund of the £10 SAR fee on top !!!

it was handed in at local branch.

 

It needs to go to a office whose address doe not get given out to the general public u see.

 

Also they should have a record of me going in as i was complaining about a letter i had just recieved as they had balls up the previous standing order to the same company. They did not put the correct amout of numbers in the account number so the transcation did not go threw. I also handed in a letter that day about the compaint as they refused to do anything about it saying computer error.

 

She said she had made a computer note explaining that i was not happy and that i expected it to be done properly this time.

 

Actually comming to think of that ther time is nearly up on that complaint.

Am I understanding this correctly?

 

I have had 2 or 3 bank accounts I have used to pay my benefits in for the last 15 years - all of them have charged me in some form or another, some charges have brought me over my overdraught limit which incurred further charges.... :Cry:

Believe me I have tried reading through the whole thread - but tbh I have a fairly good relationship with First Direct and my son suggested something I thought was quite useful.

 

He suggest I write to them about future charges and let passed ones slide. I dont know if I can do that. I dont consider this to be one of my major problems so Im going to take my time with it - but its a good thread (still reading it atm).

ok no problems.

With many people the older charges are more significant since these were far higher amounts....in some cases £39.00 ...and these days only £12.00 !!!

Yes, thats true - some of my older charges are extremely high - I think all the more reason for me to take my time with this one, that way if I feel I cant cope or cant be bothered I wont have risked screwing up the relationship I have with First Direct. :cool:

Yes, well its usually my son who sets me off the 'think logically path'. He says things like:

And its usually his stress on 'if you must' that makes me take a step back and take a deep breath - so I dont go in with a flaky head!

Its strange how some of lifes biggest headaches can come from a couple of letters of the alphabet....yes theres X Y Z

Hi

They seem to have ignored the social security act, have said that hardship cannot be considered as on the running of the account they can see that regular deposits were credited (past tense)? His jobseekers goes in to a different account. All of the amount overdrawn is bank charges and he does not have an overdraft facility. The amount was just £20 overdrawn and went up to £297 with charges added on. £100 was paid in to his account by his sister, because she was scared for him.

Any help on what to say in my complaint would be great
