    • I googled "prescribed disability" to see where it is defined for the purposes of S.92. I found HMRC's definition, which included deafness. I don't  think anyone is saying deaf people cant drive, though! digging deeper,  Is it that “prescribed disability” (for the purposes of S.88 and S.92) is defined at: The Motor Vehicles (Driving Licences) Regulations 1999 WWW.LEGISLATION.GOV.UK These Regulations consolidate with amendments the Motor Vehicles (Driving Licences) Regulations 1996...   ….. and sleep apnoea / increased daytime sleepiness is NOT included there directly as a condition but only becomes prescribed under “liability to sudden attacks of disabling giddiness or fainting” (but falling asleep isn't fainting!), so it isn’t defined there as a “prescribed disability”  Yet, under S.92(2)(b) RTA 1988 “ any other disability likely to cause the driving of a vehicle by him in pursuance of a licence to be a source of danger to the public" So (IMHO) sleep apnea / daytime sleepiness MIGHT be a prescribed disability, but only if it causes likelihood of "driving being a source of danger to the public" : which is where meeting / not meeting the medical standard of fitness to drive comes into play?  
    • You can counter a Judges's question on why you didn't respond by pointing out that any company that charges you with stopping at a zebra crossing is likely to be of a criminal mentality and so unlikely to cancel the PCN plus you didn't want to give away any knowledge you had at that time that could allow them to counteract your claim if it went to Court. There are many ways in which you can see off their stupid claim-you will see them in other threads  where our members have been caught by Met at other airports as well as Bristol.  Time and again they take motorists to Court for "NO Stopping" apparently completely forgetting that the have lost doing that because no stopping is prohibitory and cannot form a contract. Yet they keep on issuing PCNs because so many people just pay up . Crazy . You can see what chuckleheads they are when you read their Claim form which is pursuing you as the driver or the keeper. they don't seem to understand that on airport land because of the Bye laws, the keeper is never liable.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

I need help with crafting a reply to Pay Day UK.

 

I am trying to set up repayment plans with all my PDL which are outstanding, and have done most but this one as well as a few others are being obviously very awkward.

 

They ignored my first two emails and continued to call me between 10-12 times a day for the last week.

 

They finally replied and said this:

 

Thank you for your email.

Shall I reply one more time saying that I don't have to explain my income and outgoings, the most I can afford is £31.91 this is my final offer and if it isn't accepted then I will ***** this is the bit where I dont know what to say...

 

Surely they can't tell me how to spend my money?

Basically, yes, just very nicely write back to them thank you for your email, but unfortunately this is my income and expenditure and you do not have a right to dictate to me how much it is etc... I once again offer X per month as this is what I can afford and would appreciate your prompt assistance.

If they still refuse to cooperate after doing what jamie says, drop the payment to £1 a month until they comply.

They dont need a minimum amount to hold the account at all. Repayments are to be done according to your financial circumstances. If that means a low amount per month, so be it.

 

Also:

Until a payment has been received your account is not on hold and payment can be tried at any time.

 

I would LOVE to see them explain that in court, especially when told that the debtor is in financial difficulties and instructed the lender to stop processing transactions on the account.

They are talking through their backsides and hoping you dont know your rights and give in to their demands.

 

After reading this thread again, you dont really need a letter detailing their errors, as in all honesty they will probably ignore it. The best way to deal with it is send them this simple letter:

 

" Dear idiots.

 

Thank you for your recent communication to me.

 

Please be advised that my offer of a repayment plan is the absolute maximum i can afford to pay without prioritising you above other creditors and without neglecting my essential outgoings.

 

Despite what you may say or think, YOU do not get to decide how much i spend on food/water etc. The income form that i supplied is there to back up and prove my offer is genuine and is a signed declaration of fact.

 

I advise you to reconsider your recent communication and accept my proposal of repayment. If you do not, i will have no other choice but to file a full and formal complaint with the OFT and FOS for breach of OFT guidance, and will also place this debt in serious dispute.

 

If you choose to file court papers relating to this debt, i will have no issues at all providing the court with clear and complete proof of my income and outgoings, and most likely the court will agree to my proposal, or could even lessen the debt or my repayment amounts.

 

 

I look forward to your acceptance of my fair repayment plan.

I note on their reply they say subject to review and increase. if your finances dont allow it, as a previous poster said, dont let them hully you again.

Hello didnt know where to post this but after sorting my loan with wonga my last big hurdle is paydayuk and wanted some advice as with dealing with them, i have followed protocol and emailed them weeks in advance telling them im not going to be able to afford it and they asked for an income and expediture and they then just emailed back saying i can defer the loan by paying 80 pound and then i emailed to say i want to set up a plan and they said that this would only be possible over the phone, i want to get the plan set up but want some advice in dealing with them?

Hi,

 

They were really tricky to deal with and you have to just be persistant. I firstly offered them repayment and sent them the IE form from here, they then asked me some weird questions about how many people live in my house and do I have Children, I replied telling them it was irrelevant and jsut resent the same email offereing the amount I could afford. They then came back talking about goverment guidelines and telling me how much money I could live on basically, and after advice from here I went back to them and said that they could not dictate how much I spent on living allowances and said it was a breach of OFT guidelines to do that, I then said the amount i could pay was non negotiable and should they not accept it I was prepared to defend the action in court if necessary. They then came back with a email as if they had never spoke to me, so I resent all the emails to them again, then someone wrote a fantastic email for me on here which I sent to them and they agreed to the payment altough they did say this Payments of £xx.xx will not hold your account but will reduce the balance. As previously advised we would need a minimum payment each month of £76.48 a month to hold your account

 

I then went back to them and said what does that mean if we are in a payment plan then I have asked you to hold the interest and you have accepted for me to repay £xx.xx.

 

They then came back today with:

As previously advised these payments will not hold your account but will be dedcuted from the original balance.

 

You will still be liable for further action and payments can be tried at any time.

 

So after about 15 emails all together, they half agreed to let me pay the amount I can afford. So I intend to continue to pay this amount until the debt and interest I owe on the orginal loan is paid, and I will not be paying a penny more.

 

I have also today sent an email back to contest what they are now saying, and have asked to make a formal complaint. The battle goes on but at least I now have a paper trail of eviedence shoudl these crooks ever try and take mt to court.
