    • Yes, send a message to the purchaser but keep it very friendly and simply that you noticed that the package has now been delivered.  I suggest that you ask them if they want to keep the package still or if they would rather return it and that if they want to keep it then please will they return your payment to you to your PayPal address. Keep it as polite and friendly as possible and then we will decide what to do if he doesn't reply or refuses.  Meanwhile I will have a look at Google earth and see if you are able to spot the gas meter outside the house to get an idea if the delivery is real. Get a screenshot
    • Santander have sent their final response and have agreed that they were in the wrong. They will be refunding me the amount I am due and £50 for the delay.  Just the interest factor would be more than double the £50 that they are offering. Thinking to just close this and move on. Is this what you would do?  Opened a FOS case on the 1st of June but haven't heard back yet. 
    • It just been delivered and ive had a live chat with p2g to get some proof of deliverey and they send me a picture of the parcel placed in a gas meter box which they class as a ' 'Safe Place'  and not placed into the hands of the buyer which is either a good thing as the buyer can claim he never received It so i can claim against p2g or a bad thing . Do p2g have coordinators when taking pictures and scanning of parcels ?  I know Royal Mail do ... I'm going to send the buyer a message and see what he says

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

I put a PPI claim in to the FOS on behalf of my husband October 2010,at the time he was still managing to pay his CC and loan, however it all went belly up in April this year and as I have heard nothing for months from the FOS I'm wondering where it will leave this claim when the HSBC take action against him which from the letters received yesterday could be soon

Hi,

initially I wrote to HSBC asking for a PPI refund,

they said no

,I chased after them for a while but they went to ground.

 

I contacted the FOS a couple of months later to ask for advice,

after asking a few questions I was advised to let them deal with it so forms filled in etc.and that was it it apart from the standard letter apologising for the time it was taking.

 

The HSBC did eventually send a copy of a DD mandate signed by my husband but there was a problem with the date being illegible,

the FOS said they had asked for further information from the bank and was waiting for it.

 

As I did not hear from them for quite some time I rang them a couple of months ago and the person who was dealing with it told me she had been seconded elsewhere,

her successor did ring me but I was out at the time,

I also received a couple of emails from him

 

.I have rung him several times since,last time was yesterday but to date he has not been available.

Hi,

after my earlier post I had a thought,my husband had a business loan in 2005 from HSBC which he finished paying 2010,would there be PPI on this if so how would he know? Apologies if this is a repeat question but I couldn't find anything specific,

look at the agreement or the statements on the loan.

Ok I did it the painless way I sent the OH to find it,yes it had Credit Protection Insurance on it,I'm surprised as the bank knew that he was self employed.It has been signed by both parties:!:

posted this on another thread but I am reposting it here in case anyone else has an HSBC PPI claim in to the FOS,

 

I contacted them today and was advised that all HSBC claims are coming under review,

there was no reason given and the only other information was that they would let me know whatever as soon as they could.

I have been struggling to do the calculations on OH's loan to reclaim the PPI,I cannot get it right :sad: .I've tried the OFT calculator oh dear, is there anyone who could tell me what I'm looking at ?
