    • In my time I've never seen a payout/commission from a PPC to a landlord/MA. Normally the installation of all the cameras/payment of warden patrols etc is free but PPCs keep 100% of the ticket revenue. Not saying it doesn't happen mind. I've done some more digging on this: Remember, what your lease doesn't say is just as important as what it does say. If your lease doesn't mention a parking scheme/employment of a PPC/Paying PCNs etc you're under no legal obligation to play along to the PPC's or the MA's "Terms and conditions". I highly doubt your lease had a variation in place to bring in this permit system. Your lease will likely have a "quiet enjoyment" clause for your demised space and the common areas and having to fight a PPC/MA just to park would breach that. Your lease has supremacy of contract, but I do agree it's worth keeping cool and not parking there (and hence getting PCNs) for a couple months just so that the PPC doesn't get blinded by greed and go nuclear on you if you have 4 or 5 PCNs outstanding. At your next AGM, bring it up that the parking controls need to be removed and mention the legal reasons why. One reason is that under S37(5b) Landlord and Tenant Act 1987,  more than 75% of leaseholders and/or the landlord would have needed to agree, and less than 10% opposed, for the variation to take place. I highly doubt a ballot even happened before the PPC was bought in so OPS even being there is unlawful, breaching the terms of your lease. In this legal sense,  the communal vote of the "directors" of the freehold company would have counted for ONE vote of however many flats there are (leases/tenants) + 1 (landlord). It's going to be interesting to see where this goes.  
    • @Whyisitthisthank you very much for asking. I am still feeling anxious, especially when someone rings the doorbell, or when I receive a letter I feel a it paranoid. I stopped going to the shops unless I really have to. I shop online now. When I see security I feel paralised. 
    • My expectation was their WS would include the best paperwork, like at least true copies of originals, but these just look wrong somehow, perhaps the font and size of font... Not sending me the DN in CCA request but producing it for evidence I would argue could be a tactic used by them... - Page 11 with ticks - there is no reference to IP addresses - Home addresses are correct for dates in documents   Just looking up example Defendant WS's while awaiting your thoughts on this

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

We knew it was only a matter of time before the Matrix was made redundant...a sad victim of a lost case.

We understand that RLP have now discovered something with equally as much mystery as their speculative invoices.

 

It looks like whilst in Oxford,JL took some time out to visit the university bookshops and came up with an idea for inclusion in letter number 5.

A nice summary - short but sweet - The Magna Carta

 

The Magna Carta 'established' nothing new at all, but instead provided a summary and convenient name for the social and criminal legal developments of the previous century. The original document of 1215 had only one genuinely new principle: it allowed a council of 25 nobles, all of whom were appointed by the rebellious nobles who had defeated John in civil war, to seize his wealth, property and even person without any form of justification at any time they chose. Rather than limiting the power of the king, the clause effectively was designed to turn England into an oligarchy run by a select group of nobles. This charter was repealed almost immediately after being signed, and, needless to say, this 'new principle' was not included in the later versions that became part of English law.

Suppose it depends how you view it and whether it is relevant today.

RLP obviously think so...and appear to have incorporated it into THEIR charter.

My Latin is not good either...it was not on the cirriculum at school....but having said that RLP were not around in those days.

La Lambert's reference to Magna Carta merely demonstrates that she doesn't know her legal rectum from her articulatio cubiti, given that Magna Carta's primary purpose was to ensure that only the law could administer punishment to citizens. In other words, precisely the opposite of what these latter-day Sheriffs of Nottingham seek to do.

Also there are four copies of the Magna Carta, in the following locations, Lincoln Cathedral, Salisbury Cathedral and two at the British Library, having incorporated the 'Magna Carta', I'm sure 'individuals' will want to inspect the document c/o RLP.

I have been reading Magna to see if there is any reference to a very famous old case from long ago.

It is the case of Adam and Eve in which Eve's unlawful actions caused severe disruption.Sadly I couldnt find any mention of it,nor does it appear to be mentioned on RLPs list of cases on their website.

The latest drivel on RLP's website, in which they overtly criticise the way their client's counsel presented the case (and hilariously suggest that the security staff were inexperienced and confused), is yet another demonstration of how increasingly desperate they are, not only to prop up RLP's failing reputation, but also the almost pathological need to have the last word.

 

It does give an interesting insight into the personality of the person who's writing it - how transparent and predictable she is.

But then an arguement develops....as one says "We have not got time for your holding room -we are on work soon,how long is this likely to take ?"

 

To which the reply comes "Well it could be half an hour but for evidential purposes lets call it 90 minutes....with another 30 waiting for the Police"

 

"Wow how come so long ?"

After a pause the reply comes

 

"Look just come inside now for 90 minutes and we promise you will be free in 40"

I used Google Translate :razz:

 

It is mangling the translation a little its not very good with Grammar in most languages, though it seems to do Swedish very well.

 

The general gist is

 

 

"Having received your extortionate demand claiming a requirement for me to give you money, I have but one reply.

Go forth and multiply you horrid little barbarians"

 

*Barbarian being a pretty major insult to call anyone in Roman times :D

 

Having done some more playing, "vade et multiplicabo" seems a better way of saying "Go forth and Multiply" so I will deff be keeping that one to use in letters. it's amazing how a bit of Latin adds a certain... formality to a letter!

I replied very politely.

 

In Welsh.

 

Got a nasty one back either demanding, or "requiring" me to communicate with them in English.

 

Welsh Civil cases held in the Principality can be conducted in Welsh by legal requirement, as all official business is required to do. I wonder if it could be argued, and perhaps a judgement won, that a Debt Collector dealing with Welsh citizens must provide a full bilingual service? :D Most Banks conduct bilingual business now.
