    • My mind is a blur so i cant recall exactly what the judge said at the end, but he mentioned that he would be making an order for Evri to make payment to me. I wasn't sure if the court order will also be provided to me, either by post or email - if anyone can shed some light please?
    • Agree with everyone here it's bang to rights. Looks like you just slightly jinked left in order to go right. Ultimately, your time saving attempt is going to cost you as I don't think you have any grounds to appeal. I'd just pay the charge and chalk it up to experience.
    • Thank you everyone!  thought to share some points from my experience in court today that may help others who are taking Evri to court: The judge sets out how the hearing will go and how each party should behave; while i was certainly feeling anxious/nervous ahead of the hearing (and I'm sure @jk2054 may have also observed this), the judge really does try to put any non-legal persons at ease; refrain from talking to the other party and instead speak to the judge if you have any questions/responses; the judge and the advocate spoke about tort of negligence - i wasn't sure how this applied to my case but the judge was questionning the advocate about this so i chose to stay out of this; the judge made reference to a historical case of Donaghue v Stevenson which established a duty of care; the judge observed that some of the points in Evri's witness statement by george wood needed cross examination but george was not present today for questionning; While i was claiming 8% interest, the judge pointed out that is the upper limit and that today, savings accounts give 4-5%. I therefore opted for 5% interest which was agreed to by the judge and the advocate; above all else, ensure you know your court bundle and have any notes to help you refer to specific sections - it helped me to structure my answers to the judge/defendant's queries, and point to specific evidence where i was asked to prove e.g., the value of the item. @honeybee13 - yes, will confirm when payment is received. I have emailed the Evri.claims email with my bank details and also provided them after the hearing to the advocate. @BankFodder message received and i am replying to it

    • So a little update.  I sent a complaint to ico and have heard nothing. I just got the general reply email and that's it.  Sat twiddling my thumbs and thought about what I should do next. I searched for the CEO of Studio but then found that he'd left so as keep getting letters from studio about the arrears etc. I thought I'd email the David Twigg. Sent him all the bumpft and a copy of my original complaint and sars request.  Got no response. So didn't know what else to do. Then I thought I'd try through the financial difficulties option on the online form. One last try before I just give up and let them default me.  Then on the 5th June. I got an email from their customer services. That the items that had gone AWOL have all been cancelled. Nothing else on that email, so I had a look in an email account that I don't use anymore and there was an email from the customer service.  That they were sorry for the problems I've had for the last 9 months. That the sars info was emailed to me on 14/04, it wasn't I've kept all spam and deleted emails on that account, they have raised a complaint with their studio pay team regarding the issues, balance dispute, fee's and my credit file. They are hoping to resolve in 3 days but they have upto 56. They also said in regards to my other issues I have to raise a complaint with studio retail but haven't told me how I do that.  The sars info only goes upto the end of December 2023. It has my previous complaints on there but nothing after so I don't know how I get hold of that information. Luckily I've kept copies of every time I've contacted them. Every web chat or social media contact.  Apologies for the extremely long post but I wanted to add everything I could just incase.  I have checked my account balance and it's still minus 900 odd pounds but I'll keep checking to see if it's all cleared and on my credit file.  I'm hoping this is the end of the whole debacle and they close my account because I never want to do this again. Although it's been a learning experience.  Thanks to dx100uk for pointing me in the right direction. Much appreciated.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I’m very disappointed with the response I’ve had from Vodafone as I have been with them for years and thought they were a professional company.

However, they are now chasing me for a small debt that I do not owe and, in fact, I think they owe me a small refund which I hadn’t intended to pursue.

The facts are:

At the beginning of June 2011 I purchased a dongle (for about £20) from Vodafone and entered into a month long contract with them for internet usage, at a cost of £7.50 per month. This contract was cancellable with one month’s notice.

I couldn’t get the dongle to work on my computer so after approx three attempts I gave up. I’m not sure if it ever actually connected but I was never able to surf the net using it. It was a waste of £20 plus £15.00 (June and July rental) but I put it down to experience and on 30th June I wrote to them giving them one month’s notice to cancel the contract and for them to send me a final bill.

 

After I couple of months I noticed that they had continued to take the £7.50 by direct debit from my bank account. My own stupid fault I thought as I should have cancelled the direct debit instruction. I duly cancelled the direct debit with my bank and had overpaid Vodafone for August but I thought no more about it as it was only a few pounds.

 

On 23rd November I received a letter from Vodafone chasing me for £22.50 (three months line rental). I later found out that this was for September, October and November.

On 1st December I wrote back enclosing a copy of my cancellation letter.

On 14th December I received a phone call from Frederickson International (had no idea who they were) asking for my postcode and date of birth. I refused to give those details and they finally admitted they were acting on behalf of Vodafone. I explained that I had written to Vodafone and that I would not talk to anybody on the phone and that I wanted all correspondence in writing so that there would be a record of all communication.

For the next three or four weeks I received daily text messages from Frederickson asking me to call them. I will not talk to these people on the phone. I tried texting back but that doesn’t work. There is no fax number on their website. There is no contact email address on their website so I wrote to them but didn’t get a response.

On Christmas Eve I received a bright yellow card from them in the post in capital letters “ADDRESS VERIFIED” and pay up or else….or words to that effect.

 

I have since written to Vodafone five more times and not had a response.

 

I also filed a complaint with Vodafone's customer services on their website and a couple of days ago they finally responded by saying that they had not received a cancellation letter from me and that they had replied to all of my letters.

I have now received a notice before action letter from Vodafone for the sum of £31.45. It appears they have accepted one of my December letters as the 30 day notice.

I replied by email to their customer services department saying that I do not believe that they replied to all of my letters as I would have surely received at least one reply. All of them couldn’t have got lost in the post and I asked them to send me copies of their replies.

They replied again repeating what they had said in their first email, that I had not given notice and they had replied to my letters and that £31.45 debt had now been passed to their collections department.

Yesterday I responded again sending them copies of all my letters and asking them once again for copies of their responses. They have responded again today giving me instructions on how to pay them £31.45. They clearly do not read the emails!

Where do I go from here?

I wrote to them giving them notice they say I didn’t. They say they replied to all of my letters but I did not receive one reply. I did not receive a notice before action letter before they set Frederickson International on me (although FI stopped harassing me in January I think - I have since cancelled the phone they were contacting me on). Vodafone have now issued me a notice before action letter and are going to pursue the “debt”.

If I had actually used the service I would pay it but I think they are being very unfair.

I gave them the required notice and it was ignored. What am I supposed to do? I can afford to pay this money but I don't see why I should as I gave them notice and I haven't used the service. I would rather give the money to charity!

I would really appreciate any advice anybody can give me.

Hi,

 

I am in a similiar situation whereby VF are saying that although they recieved my cancellation email they didn't cancel my contract for a mobile account because I didnt respond to their response asking for security details.

It is probably worth you checking your credit score as if VF consider you have missed 3 payments or more they will issue a default (as they have with me).

Lee from Vodafone should be able to help, i'm sure the other very helpful members of this forum will give you the instructions on how to contact Lee and get him to look into this for you.

I have had another email from "customer care" this morning saying that if I want a copy of a bill (I don't!) then I will have to pay £1.54 per bill and that they do not have any copy letters to send me. I think this proves that they didn't reply to my letters despite saying that they had. It does suggest however that they received my letters. Interesting though that they claim not to have received the one cancelling the contract!

 

Thank God they no longer have my phone number as I'm sure Frederickson would have escalated their harrassment by now.

Well it's taken a while but thanks to the intervention of Lee, this matter has now been resolved and Vodafone has waived all charges applied to my account. They have done this as a goodwill gesture as they say they did not receive the original cancellation letter I sent in July 2011.

 

I am relieved they have taken the common sense approach having seen that I have not actually used the service since June/July 2011 and therefore have not incurred any usage charges.

Check ALL credi reference agency files, also make sure they get the records of searches removed also, i have a thread/dispute running at the moment with VODAFONE. Lee helps out a lot. But dont expect things to be completely to YOUR satisfaction

Whilst I appreciate that this recent experience has been far from ideal I hope that my involvement has gone some way to restoring your faith in us.

Check ALL credi reference agency files, also make sure they get the records of searches removed also, i have a thread/dispute running at the moment with VODAFONE. Lee helps out a lot. But dont expect things to be completely to YOUR satisfaction
