    • Thank you for posting up the results from the sar. The PCN is not compliant with the Protection of Freedoms Act 2012 Schedule 4. Under Section 9 [2][a] they are supposed to specify the parking time. the photographs show your car in motion both entering and leaving the car park thus not parking. If you have to do a Witness Statement later should they finally take you to Court you will have to continue to state that even though you stayed there for several hours in a small car park and the difference between the ANPR times and the actual parking period may only be a matter of a few minutes  nevertheless the CEL have failed to comply with the Act by failing to specify the parking period. However it looks as if your appeal revealed you were the driver the deficient PCN will not help you as the driver. I suspect that it may have been an appeal from the pub that meant that CEL offered you partly a way out  by allowing you to claim you had made an error in registering your vehicle reg. number . This enabled them to reduce the charge to £20 despite them acknowledging that you hadn't registered at all. We have not seen the signs in the car park yet so we do not what is said on them and all the signs say the same thing. It would be unusual for a pub to have  a Permit Holders Only sign which may discourage casual motorists from stopping there. But if that is the sign then as it prohibits any one who doesn't have a permit, then it cannot form a contract with motorists though it may depend on how the signs are worded.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello

 

I have today recieved a letter from Power2contact about a debt with Barclays Bank ,

 

I have written to my bank twice saying I didn't agree with the charges they had put on my account

 

they wrote back after the second letter just saying they will take no more contact from me straight to Barclays bank,

 

then I got this letter saying if I don't contact power2contact about the £874.79 within 72 hours

they will call at my house to collect payment or goods to the value of...

 

I am a disabled lady, a single mum and Im terrified what there going to do..

 

my next step ...

 

I was going to write to the financel Ombasman about barclays bank charges

but now I have this letter from Power2contact Im panicing what to do ..

 

. Im in a right mess..

 

Please help !!!

Are you able to scan that letter in for us to see, please. Follow the instructions below..

 

Dx100 – Instructions on uploading pdfs

scan the required letters/agreements/sheets

as a picture file

remove all pers info inc barcodes etc using paint

but leave all figures and dates.

goto one of the many free online pdf converter websites

convert the image to pdf format.

or ir you have PDF as an installed printer drive use that

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

within 72 hours they will call at my house

 

If anyone does turn up, it has been known from time to time, as posted above, they are not bailiffs and have no powers.

 

TELL them to leave your property, if they refuse, then call the Police who will quite happily remove them on your behalf.

 

Just remember, YOU are in complete control, not power2contact or any other DCA.

Im sorry but I cannot scan the letter but I will try and explain a little better,

 

I had a Barclays bank account for over 10 yrs with Barclays and I started with an overdraft of around £100

but then I became ill and slowely started using my overdraft

 

i had a meeting with an adviser explaining I wasn't working so they said I should increase my overdraft to help ,

 

to be honest I wish I hadn't bothered but at the time it was the only way I could see of coping with things so I said yes,

the bank knew I was on benefits and couldn't work due to ill health and they said it was ok for me to increase my overdraft to £400 .

 

I wasn't using all of my overdraft until the CSA stopped payments without telling me so I went over the £400 over draft limit

my bank sent me a letter telling me I was to be charged so I put enough money into my acc to cover the extra money leaving it

but the bank took another charge out then charged me again for using the over draft limit...

 

If the bank hadn't taken the second amount I wouldn't of been charged and since then they just kept putting charges on

even though I told them I was now disabled claiming ESA and I asked them to freeze my acc to stop the charges

but they ignored my letter and just kept charging me

 

I got info off this forum and sent it to Barclays saying I didn't agree with the charges ,

they replied stating the charges were put on my acc for being over the overdraft limit..

 

I wrote again they replied stating they couldn't take anymore letters from me and now I have had this letter from Power2contact..

 

This is what the letter says...

We have been instructed by our client to VISIT YOUR ADDRESS TO COLLECT THE ABOVE DEBT.

 

You have made this action necessary as you have ignored all their requests to contact them and you have failed to pay your account.

Our visits take place within the following hours..

Saturday = 9am - 12 noon

 

should you wish to avoid this course of action, you must contact our instruction agent WITHIN 72 HOURS of receipt of this notice.

ithink you either need to investigate BCOBS

or

try the hardship route and reclaim the charges

 

as for P2C

 

ignore them.

 

they can do nowt to you

they are a DCA

they have NO LEGAL POWERS

 

do not converse on the phone either.

can Power2contact put extra charges on top of the bank charges... I will make an appointment on monday with the CAB and ask them to help me with a hardship claim..

no

no dca has any LEGAL remit to add ANYTHING to a debt

unless they OWN IT

 

and those charges are INLINE with with the ORIGINAL T+C from the time of debt.

Do you have another account into which you can have your benefits money paid. If not, you should make this a priority or Barclays will be taking charges from you from here to eternity. Apply elsewhere, even if it's for a basic a/c. Then you can keep all the benefits money you're entitled to.

See sections 224 - 227 which refer to customers in Financial Difficulty

 

Instead of offering you a higher overdraft, they should have offered to stop adding any further charges and interest.

If we think your case is suited, we may be able to help you take the bank to court to get back the charges and interest they have taken from you. They have a duty, under BCOBs to treat you fairly.

I stopped everything going into and out of my acc in April last yr and this is when I wrote to the bank to ask them to freeze my acc so I wouldn't get anymore charges but the bank ignored my letter and the bank kept on charging me :(

I just had this same letter, same address but listed as Cougar Financial Services. How can they be allowed to operate under different names? And how can they threaten to come to my home and 'collect the above debt'

its just a threat-o-gram

 

pers i'd ignore them

 

they'll go nowhere near a court for fear of a counterclaim.

 

have you moved the BCOBS complaint/reclaim fwd yet?

 

it might well be an idea to get your CRA file too.

 

and see whats going on there.

I have been dealing with all my creditors through Kensington FM stupid I know,

as it would appear that they have not been doing what they are being paid £40 a month to do,

a lot of my creditors are still contacting me asking for information,

saying they have not heard from KFM and I started this all back in April!!

 

I have now had numerous letters all saying they have been trying to contact me,

which they haven't and to call them, which I haven't.

 

Anytime someone DOES call me I answer and they want to know my account details,

which I refuse to give out over the phone to someone who cannot verify who THEY are,

so why should I give them all my personal info, DOB, address, acct info etc when they won't give me any info. It all seems a bit one sided to me!

Thanks dx, figured that one out when I read some other forums :( they are dumped, just have to wrest all my creditors back to contacting me and forgetting about Kensington, have ordered a CRA file from one company, just have to go through the proceedure with the other 2 now to get a full and in depth idea of who has what info and whether it is correct or not!

 

Wish I had never gone to kensington in the first place, but a family member used them and all was good for them.
