Hi all I was thinking of sending link a CCA for a Cap one account.

but on checking my paperwork I noticed that they have it marked as a 'Loan Agreement'

but it is a Crap one Credit Card, so do i use s77 or s78 or should I miss them out and go straight to Carp one

The letter I got from Link states that they are now the current owner of the outstanding balance,

as of Dec 2008 Carp one assigned the balance to them under this assignment the full balance due

under this CC account is payable to Link

But all the statements sent from Link say it is a Loan Agreement

How old is the card and are there any charges or PPI you could reclaim, how did you apply for it ?

took card out in 1998 no PPI as i always refused it

don't know about charges as no statements, defaulted in 2008 then passed to Link

was going to send CCA as found a letter from Crap One a month before it was defaulted offering a discount on the balance owing

but only offering to mark credit file as 'part settled'

I sent a letterback to them saying as they would not mark as settled then it could not be taken up and offered pro rata payments

they said they would except the payments for 6 months but then the letter from link arrived 5months later

link statements keep telling me i am in arrears with my payments,and would like the full balance, but they are all upto date

so I ignore and just send a £5 per month

Being the old Bu**er that I am if they it's a loan on the paper

work you have you could ''politely '' inform them you have never

had a loan from Crap 1:madgrin::lol:

I think I agree with Brig.. If they cant get even the basics of the paperwork correct..

 

Just write back and advise you have never had a loan with Capital One and you trust you wont hear from them again :)
