    • Good evening, My husband and I are looking for some help regarding a faulty car which we have recently purchased from Big Motoring World Enfield. The details are as follows: - Make - Nissan Qashqai 2017 1.2L milage 55,349 miles.  Date purchased -   01/06/2024 Price paid - Deposit £9000, finance £4794 (this includes the 3yr Nissan extended warranty), buyers fee £249.      Total including all fees etc = £ 13794.        Initially, during the test drive, there was no problem with the car at all and this is why my husband bought the car on the day. No problems on the way home from the dealership and up to three days after purchase, the car drove smoothly. However, after day 4, occasionally we would feel a slight shudder during some gear changes (automatic car). Over the next few days these shudders worsened and then on day 5 the car would make very a very loud shudder with every single gear change. It was at this point we contacted Big Motoring World for advice as we are still under the 14 days no questions asked return.  My husband contacted BMW for advice on 06/06/2024 and stated the problems as above. He spoke to a sales person who informed him that he should only take the car to a Nissan dealership (we have now been told that this is false information). We were also promised that a courtesy car would be provided for us after the fault on the car had been identified and confirmed by their mechanic fixing the car. We took the car to the garage that Big Motoring World had told us to go. Upon arrival there we discovered it was a third-party garage, not Nissan. We took the car to the garage on day 9. The mechanic ran a diagnostic test which found no faults, but after the test drove the car and below are his findings...   we scan the car but no faults with the gearbox showing but when I test drove the car it was really juddering and jumping.I spoke to my auto transmission specialist and he said they are very common on these as the CVT belt starts jumping within the box due to pressure loss.  We had this vehicle in for diagnostics for gearbox mate but both the gearbox and battery are faulty.Gearbox supplied and fitted comes to £3500 plus vat   Where we are at now…. My husband spent all of day 10 (11/06/2024) making phone calls between the garage, Warranties2000 and Big Motoring World. He tried, unsuccessfully to find out if the diagnostic reports had been shared between all three. Everyone kept saying the report hadn’t been received and yet the garage assured us it had been sent. Eventually we were told that the courtesy car would be given to us if it was deemed the works to fix the car would take longer than 8 working hours, and that decision would be made after 48hours of receiving the report. Today is day 11 and no decision has been made as nobody is telling us any decisions as people are off sick or on holiday! Today we called the garage and told the mechanic NOT to start any work as we will be returning the car. He said none have been started and we have left the car in his storage as he has deemed the car undrivable. I have sent an email to BMW now formally stating that we want to return the car and I have used the terminology that was suggested.   What can we do next?   Thank you everyone. .  
    • Yes will do thanks Dave, I wonder what will happen at the preliminary hearing no idea what they will ask I assumed once I sent the proof they asked for about my sons condition that I would have just  been given the go ahead to be Litigation friend
    • First the judge will rule on you representing your son, which will be a doddle. After that the full hearing date will be fixed, with WSs exchanged 14 days before. So for the moment just concentrate on getting the right to represent your son.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

After 6 months the morning has arrived when i can at last for the 1st time in a cpl of years i can shout IM PAYDAY LOAN FREE!!!!!!!!!!

just over 6mths ago, i had 10loans, eating my monthly wage, rollin over just to live and provide, and after reading on here i decided i can do this.....

i can honestly say apart from PDE it was relatively smooth.

Again IM PAYDAY LOAN FREE!!!!!!!

absolutley no way, no need to, also the fact i had so many lenders im sure im a big black mark with each and every one.... i hope so anyway!

 

It feels good, it will feel better next mth when i dont have any payments to pay out, and so much money to spend!!!

i actually left that account open. as we had no other debit cards, it was handy..

but when i first agreed the plans PDUK, and WONGA still repeatedly tried the card but to no avail, this all got stopped when the bank called and questioned these failed transactions, at which point i recorded these as fraudulent.

 

Thats was the last time the bank called!! not sure if they then put a block on these 2 companies.

 

but that account is only used as a means of paying something, and the money doesnt go in til the payment is literally being made. and is only in the accoutn seconds prior to the payment........

 

money is never in that account for more than 1 min!!!

I dont it with the help and guidance fro the many threads on CAG.... i read other forums, but found these one nothing more than helpful. Other forums, are so judgemental its unreal.

If I count up, i had loans totalling over £2,000. i was paying over £800 per month on rollover fees. Overtime at work was what i was surviving on...

I thought enough was enough.

I called everyone once then dealt after that with emails.

Wonga, WDA, LendUK, and U Buck were the easit to deal with. The rest needed a bit of persuasion. PDE needed a boot up the )( cheeks.

I managed to pay PDE over 2 mths, but refused to pay the rollover/interest fees. the wouldnt budge, and i told thm to take me to court. eventually after many heated telephone exchanges they backed don, and confirmed in email the account was settled and closed.

 

The key is to close the bank account and cut their scource of pilfering as they will, and at will.

I paid all by faster payment, and WDA and EPDL by ddeb. i didnt mind the ddeb, as if they tried to take more i would simply enforce the ddeb indemnity.

 

Ive been on the count down over the 3mths, and finally today it happened... all cleared.

 

I paid the 10 over a period of 3-6mths.

the final ones being 247, EPDL, WDA & Wonga.

 

These companies imo do serve a purpose, and they advertise how great it is to use them, and they even compare the bank charges, problem is they dont tell, what they will do when things go wrong. and its this end that needs regulated as well.

 

There needs to be more regulation in the application stage, as its 2 easy to rack up with 10loans wheneve your takehome is £1200.... doesnt give much left over after rollovers....

i stood my ground with them.. and refused to pay their silly charges..... eventually an account manager called me and we sorted it out, but the ones that answered the phones had no common sense at all

also how long did it take for them to back down?

 

they wouldnt so within 2 mths i called to pay balance + one month, they refused, and i said i had the money to pay and thats all i was paying, and they were refusing to even take that..... so eventually an account manager called, and i explained all i was will to pay to clear the account was loan+1mth, i said you can take me to court and your company can explain why you have refused to take payment.... he agreed to take my money, but before i did, while he was on the phone i requested an email to that effect... only then did i faster payment the money onto the debit card, and give the money over,,,,

Hi Just wanted to say reading your posts has given ne the push to sort out my payday loan mess. I owe wonga 1250 and pduk £500. Both are due to be paid on 25th, unfortunately I havnt been able to open up a bank account in time as Halifax say they have had lots of applications and could take 10 days. My work process my wages a week before I'm due to get paid. I've heard mixed reviews about both pduk and wonga and how willing they are to take on payment plans. Do you gave any tips on the best way to contact and deal with each of them? I'd be so grateful as can't afford to rollover again as already behind with rent.

Hey, I also meant to ask if anyone had advice on how to stop both wonga and pduk taking the money out of my account when I get paid. I'm worried that not being able to open a bank account in time will result in them taking. From what I've read just cancelling my card may not be enough. Any advice would be really appreciated, I'm determined not to sort this out but really worried.

for wonga send the same email to errol.damelin@wonga.com, balanceoffer@wonga.com, john.hegarty@wonga.com NOW.......

 

explain your change in financial circumstances, offer 6-9mths, ask for sort code/acc number so you can send payment by faster payments on payday.... within hours, they will freeze your interest, and giv you your monthly payments....

 

dont wait til the 25th... as wonga charge interest daily they will stop as soon as they recieve your email
