    • Am in the middle of selling my house but it's been held up as still showing a change on the property from welcome finance, have not had any contact from them for years or prime credit and need this sorting asap
    • Evening all looking for bit of advice again , currently doing my own debt management , but think may have burgered up on 1 of the creditors (creation loan) had got sold to Intrum around nov 23 and havent paid anything to it since then , it never went to default ( I thought it did  , now checking credit file , intrum is there and says 1 missed payment and doesnt say account defaulted can i let that go and intrum will default it? hope that makes sense what i have said

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

My husband has been unemployed now since October last year, I had a business which I had to close due to not being able to sustain it due to income. Despite myself trying to get part/full time work as well as the business it all went wrong and I have recently had to admit defeat and sign on.

 

However after 9 weeks it is driving me stir crazy, applying for 10 or so jobs a week getting the odd interview but still not getting work I spoke to the job centre about starting a business again, this time not one where a huge stock outlay was required.

 

They said I can work under 16 hours and declare anything i earn so basically be working for the £10 joint allowed amount, but it seems they dont really like you doing it

 

hope this makes sense so far

 

Apparently they've now scrapped the £50 a week for those starting their own business and obviously they had to be unemployed for 6 months anyway.

 

Is there anything I can do to get help to run a business again? I do know we can still get help with housing and council tax if my husband signs on and I dont, but last time one of the nails in the coffin was that the powers that be took my 'turnover' into account not my 'profit' so took £50 a week off the jsa benefit when i was only earning £2,500 for the whole year

 

 

The last 10 months have been such a struggle, being behind with bills etc and I really want to try and turn this around, but it seems thats just too much to ask:!: I looked at working tax credits but im in my 30s and looks like id have to be doing over 30 hours and then its not guaranteed you get it.

 

it feels like a no go at the minute I'm just wondering if there's anything I've missed or dont know about, help appreciated thanks

Yes there is lots of help for those starting up from being unemployed.

Currently being rolled out nationally,is the New Enterprise Allowance Scheme (NEAS) which offers funding and help including mentors.

You should contact your local Chamber of Trade too.

Thanks for those, Ive not been unemployed long enough but i think theres probably nothing stopping my husband starting it up. The NEAS must be a new version of the one the JC were talking about although it seems it was available in April when they told him it wasnt

While most JCs knew of it-they didnt know all finer details until after April.

Depends on your area.

For Merseyside it is being done through St.Helens Chamber.

There is info on the BIS website about regions and when it will be offered.

Before you could get the 50 quid self employment credit with new deal- it was paid for 26 weeks.

As far as I know-you still get the free months council tax and housing benefit.

There is also a £100 one off payment from the JC for anything you need-though they dont advertise it.

Worth checking on tax credits too-theres an online calculator you can use for that.
