The purpose of the sending of the CCA is that I want them to send me a list of charges they have applied to both accounts so I can claim them back. I am NOT disputing the fact that the accounts are/many not be mine, they are. In light of this, does my CCA request still give me the right to stop paying them.

Also, arent Ambrose Wilson, JD, Fashion World and Simply Be applied for online and DIGITALLY SIGNED, thus No signature.

I just got another one from RC telling me they were told to contact me regarding a cancelled DD.

I cancelled it as they were requesting an100% increase which is unreasonable and I told them that but as they give out an incorrect address, they wont get it.

I am now printing copies of all the letters I sent them (with the word 'COPY' printed on them too) and will be sending them aall to the new address I have got.

Well, they signed for this one. I also got another letter as per cancelled DD.

Also, they sent me statements for each account and according to them, I'm £58 to pay in charges and missed payments.

Anyone suggest how long I should give them on this one as it refers to the CCA I sent earlier.

Hi Pooky,

Can you clarify whether you sent a CCA Request (Consumer Credit Agreement Request, fee £1) or a SAR (Subject Access Request, fee £10) as you keep mentioning CCA requests, yet seem to be expecting a list of charges.

A CCA Request is only for the agreement, T&C's and a brief statement of account. For this they have the 12 +2 working days to respond. A SAR is for ALL the data they hold on you, including a full list of charges, payments, correspondence, comms logs etc. They have 40 days from receipt to comply with this. (This is what I advised to send earlier).

I sent a CCA request. Someone mentioned they did the same and got a statement, with list of charges.

Looks like I'll be sending them a SAR then instead.

 

But then what about the incorrect address they have at the top of their letters, the M99 2BD post code, was informed by Royal Mail it will not get there as the post code doesn't exist.

I sent the CCA to that and they've still not got any of the three letters I've sent, one was the CCA. I was given a new address for them and it seems that one works.

Because of the post not getting to them and theyre sending me letters and statements, £58 in missed payments and charges, can I dispute these, I'd guess I can, as I have proof of posting.

I got them today, just after 12.

The CCA AND a FULL breakdown of each account since it was opened.

One thing to note, on the CCA. They put my NEW address on it which I've lived at since March 2010 , NOT the address which the account was opened in 2006

Isn't THAT falsifying a document?

Could I get out of the agreement on that since they do not have one with the address which the account s were opened

It's not the true original agreement IMHO.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.

Sounds like a carbon copy of my situation. At this point I asked to have all charges removed from the account to offset the balance and in return I'd make an offer of repayment. I have heard nothing since. (I used the figures in the statement of account - I never sent a SAR request) You could put the account into dispute regarding the incorrect address. I'm not sure that an unsigned reconstituted agreement is grounds to dispute anymore. Hopefully someone will say I am wrong.

What do you reckon I should do?, The accounts ARE mine BUT they have put my NEW address on the CCA NOT my OLD one which I was at when they were opened?

With them NOT putting the address I was at when the accounts were opened but the address I am at now, I have only been here since Mar 2010, they MUST have breached SOME terms?. Accounts were opened in 2006.

I could make their lives difficult.

They supplies 2 'signed' credit agreements, one which was signed by one of their representatives and the other one was unsigned. BOTH do not have my signature.

Another thing, they have different interest rates, one at 39.9% and the other is 39.6%, with further reference to interest rates at 34.06% and 33.8%

Which is quite sus

Is this another word for PPI? as since my wife opened the account she has paid £53.72 in total.

And also £84 in charges, 'missed paymen't and 'telephone debt calls'. Are these charges allowed and does it really cost £12 to call us to remind of the missed payment.

We are thinking of reclaiming these charges back (£137.72). Will this make Littlewoods become hostile towards my wife by saying some rubbish like because she is claimig the charges back, they are closing her account and wany payment of the outstanding balance in full.

They could easily find any previous addresses since these would be logged on your credit file.

This is so ANNOYING!!!!!!!

I have sent them countless letters since their letter on 13 April 2011 and they have basically ignored them all, the only thing they have done anything about is the CCA request, which was ONE of MANY other requests I sent them.

 

I have had to resort to contacting them by telephone (which I have recorded) 3 times.

I spoke to a Luke who informed me that there is a 4 week backlog on post and he also told me that they have sent me a dispute letter on 31 May 2011, which I have yet to receive.

Today I spoke to the SRT department and they have told me that the charges have been removed from one of the accounts already and that the charges on the other account will be removed within the next 24 hours.

 

I sent the SRT department a letter on 27 June 2011 and they received it on 30 June 2011 as I have proof it has being signed for, they have told me that they have yet to actually receive it in the SRT department...... After 1 week of signing for it, whats taking so long.

 

I am very annoyed that it has taken countless letters over 4 months to get nowhere and then 3 phone calls in 2 weeks to get it resolved.

I will be telling them that I want the other requests in the letters resolving and an apology as to why it has taken this long to get it sorted.
