    • Your case shows the idiocy of employing a solicitor to do things you could easily do yourself. Had Countryside dealt with their own case they would have entered judgement on 4 June and there would have been no way back for you. But they thought they were clever by running to Rachael and Sean of BW Legal for a more "professional" (aye, right) service.  These dodgy solicitors can only make money on private parking cases by doing everything on the ultra cheap and certainly cant check the judgement date for every single separate case. Ho!  Ho!  Ho! Anyway, glad you got the defence filed OK.     • It is already trespass, nothing further needed to make out trespass. Not sure where ‘interference with goods’ helps you / how you’d bring a claim for that that stops them parking there.
    • Thanks Dx,    For some further information, the holiday was booked as a package holiday for 2. One of the 2 had to be changed, and changing costs £700 for a new flight as "tickets had been issued and they cant do a name change". I cant quite figure out how compensation works for things when it comes to package holidays.    From what I can tell  - The plane was due to land in Turks and Caicos to drop off passengers, something happened during descent, resulting in technical fault.  - The rest of the original flight from Turks & Caicos -> Montego Bay was cancelled  - A New flight was put on today, which was then delayed by 1.5hrs aswell  - Hotel was provided for the night after much hassle.  - 1.5 days, 2 evenings of holiday lost  If I understand correctly, since the original flight (LHR -> Turks -> Montego Bay) was cancelled, they are both entitled to a refund on that full flight? I can't quite work out if they are only entitled to a refund for the equivalent of Turks -> Montego Bay, or for the full LHR->Turks->Montego Bay, since it was issued as one ticket/all Virgin, and they should have arrived yesterday..?)  I can't work out how to get the cost of that compensation, or whether its a set figure, and how the loss of days of holiday is factored in   I am aware:  If you received less than 14 days’ notice of the cancellation, you are generally due compensation, awarded in pounds or euros depending on where your flight was due to depart from, according to the following scale: £220 / €250 for all flights of 1,500km or less (e.g. Glasgow to Amsterdam); £350 / €400 for all flights between 1,500km and 3,500km (e.g. East Midlands to Marrakech); £520 / €600 for all other flights (e.g. London to New York). Compensation will be reduced by 50% if the arrival time of the replacement flight doesn’t exceed the arrival time of the original flight by: two hours for flights of 1,500km or less; three hours for flights between 1,500km and 3,500km; four hours for all other flights. So I "think" its £520pp for the flight part as compensation (7500km)... but some sites say its a full refund for the flight... is it both?  Thanks,  Ryan

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

I am very new to this forum so I hope this is not a completely daft question. I have a number of debts ( CC's, personal loan, catalogs, store cards- all spiralled out of control due to sudden unemployment) - most of these are now with DCA's. I have come to reduced payment arrangements with all these DCA's. All have issued defaults about 2-3 years ago but none threatened court action as I honour the arrangements. Some of these debts have been assigned to 2 or three agencies already and in fairness I have lost track a bit what debt is what and how much each debt actually is. Is it worth asking for CCA and full statement of each account or would that just make the situation worse?

If the DCA's are then unable to produce CCA, do i still carry on paying them the reduced payments?

Welcome, my suggestion would be to send a CCA request to each 'current' DCA. If or when you receive replies, open a seperate thread on here for each one and we can proceed from there. I would suggest that at present you should keep making the agreed payments to each one.

The agreed payments, are they what YOU told them YOU could pay, or are they what THEY TOLD you to pay??

 

If you get a copy of your Credit File (CRF) then that should flag up, who is collecting and what amount they state is owed.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

The reduced payments ( anything from £1.00 to £10.00 pm) are payments I have offered based on my Income and Expenditure. They have been in place for 2 years or so and during regular reviews of the accounts the DCA's asked me to increase them. Some of them increased by £2 - £3 pm some stayed the same depending how pushy the DCA was.

Thank you for your replies. I cannot remember if there was any PPI taken on the loans but I think they charged PPI on CC's automatically. If i wanted to reclaim these, how would i do that? Do i just write to the relevant creditor to tell them that i want to reclaim these charges?

Do you have all the statements for your loans and credit cards?

 

If not you will have to fire of a SAR to each of the companies to get all the information they hold on you. Each SAR will cost you £10 and they will yield all information the company holds on you relating to their dealings with them, including all the statements. They will have 40 days to comply with your request.

 

When you have all of your statements you can then start putting your claim(s) together.

 

In the meantime, as previously advised, carry on making minimum payments in an amount that YOU dictate, NOT what they tell you to make.

Check your statements and see if they are charging you PPI.

 

It is unlikely they would charge PPI automatically on CC's but nothing will surprise me!

 

ALL charges and fees MUST be reclaimed.

Thank you all for all your advice. I will get the SAR and CCA sorted to start with and see what happens. When ( and if) i get any replies from the DCA's I will very likely need your expertise as to what the best course of action to take is. In a way I do feel a bit guilty doing this because I know that I owe the money and it needs to be paid back.

I havent got any of the original statements anymore as I have been dealing with DCA's not the original creditor for the last 2 years or so. My bad, i should have kept them but SAR will sort that bit out. Thanks again.

Ah but the thing is you will find hat you don't owe them as much as you think you do or as much as they say you do.

 

Don't feel guilty.....this is all about Reclaiming The Right.

 

We've all been there in one way or another.

It's fair enough to want to pay what you owe, but it certainly isn't fair to pay back what you don't! Get the information, and then you'll know what you do and don't owe them.

Today is the tomorrow you worried about yesterday, and all is well!

It matters not, if you owe money and have fallen on hard times, then it is YOUR right to continue paying them back at a rate which is more realistic and affordable to YOU!

 

Peoples circumstances change for a plethora of reasons, which is why the current "contract" system is on it's way out (IMO)

When I was working & earning, the banks couldn't give me money quick enough, and TBH I was able to repay at the monthly rate they demanded, but when all that changed. literally overnight, and I was unable to work again, they did not want to know!

 

I left employment in 2007, with the likelihood of never returning to paid employment again, since then, the 55K debt that I had amassed with various creditors is still disputed and is extremely unlikely to be repaid, not because I am avoiding it, but simply because of their attitude and their failure to provide relevant documents or even to have a modicum of morale fibre in their bodies!

The more I read your comments, the more I am starting to believe that I should get this sorted. God knows really how much of the balance i owe is actually payable. You are spot on, the banks lend you money left right and centre when you are paying back- even if its a minimum payment every month but as soon as things go pearshaped i.e due to loss of job, they are so unhelpful and they start adding late payment fees at stupid rates- which really just makes the situation worse. Thank you all for your advice and moral support.
