Supermarket crash, father in law needs help

My father in law was invloved in an accident just over a yer ago, where he reversed out of a parking space and a car that was travelling down the car park at some speed had collided his tow hitch, it caught the car and there was some damage.

 

Ins companys were told and thought that was the end of it, i think they didnt pay anything as its in a supermarket, knock for knock etc, but a court summons of £2500 turned up yesterday.

 

Now he's an IAM advanced driver with no pervious accidents etc.

 

Any ideas?

On what basis has the claim been made? What are the POCs?

 

Have you been in touch with the insurer? What was their response?

Any advice given is done so on the assumption that recipients will also take professional advice where appropriate.

let your insurance co deal with it but ask them for advice as you only have 14 days to acknowlege the claim

 

did you get any 14 day letter before action for example

 

if not then its a breach of the civil procedure rules, pre action protocol and the claim will prob be thrown out any way

 

me thinks this claim is going noware
