    • thread title updated moved to overseas debt forum. sadly as they are outside any UK jurisdiction upon DCA rules which state in the UK they must not call employers, there not alot you can do to stop these scammers. make sure you totally make private ALL social media twitter/facebook/linked in etc etc as there no-way for them to findout where you work otherwise so you must have a leak somewhere. find it. your employer details arent even legally available to UK DCA's so how have they found it out to date???  simply write to the BANK informing them of your correct and current address ALWAYS!!. if you want to arrange payment or not TO THE BANK ONLY thats upto you. never ever ignore a Statutory Demand a Letter Of Claim a Court Claimform. if if if any of those ever happen. till then ignore and rewash. dx

    • Hello All,  I’m hoping someone can help me urgently here. Firstly, I’d like to say I have read multiple other threads and have some what an idea of what I should be doing, however my case might be slightly different so coming with my own questions here.    my situation is I lived in Dubai and had a credit card and a loan, loan with HSBC and credit card with Emirates (or the other way round), I lost my job and was forced to leave the country as I was staying in the country on my companies visa.    since coming back, after a few years 2 different debt collections agencies have been approaching me (one being IDRW and the other J&P). I’ve never answered IDRWW and they constantly chase me by calling and messaging me and my employer. My current company is ok with this as I explained the situation but I’m soon to be joining a new company who definitely won’t be ok with being messaged and called. I’m afraid to continue to ignore them as they may message and calm the new employer as they have before and I’ll lose my job. However, it seems clear from these forums that dealing with the debt collection agencies is never a good idea. You shouldn’t agree to the amount or pay anything.    j&p caught me on my phone but I still haven't sent them any money or confirmed the amount they’re saying is owed, they keep pushing to pay off the “principal” amount by making monthly payments, from reading these forums it seems like if I make one of those payments (they have provided bank details for ENBD), then it’ll just be paying off interest and not actually clearing the principle debt and the bank won’t even approve receipt of payment or that it’s coming off principle.    this is my predicament as ignoring them might not be an option if they chase my new employer. Maybe there’s a way to ensure the debt collection agency don’t contact my new employer?? I don’t know? Massively appreciate peoples help here. Thanks,

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Have read previous posts with rising concern,in a weird way its nice not to be alone in this situation.

 

My problem started in nov 10,

leaking diverter valve.

 

Numerous phone calls and house visits still not fixed.

 

Have heard every excuse in the book,from to busy to turn up (cold weather),to part broken in post,

(by the way you could run over said part with a bulldozer probably wouldnt mark it).

 

The heating engineer who services my boiler showed me exactly what was wrong,

so the next homeserve person who turned up i watched what he was checking,

 

now because the diverter valve is above plate heat exchanger water drips onto it,

so after 3 mins of indepth checking said person anounces the heat exchanger was leaking proceded to tighten top screws,

i was so amazed i let him go.

 

I then phoned homeserve and told them to send someone else who was compitent at there job.

 

Whilst on phone i advised them of the real problem also of the parts they would need to bring to fix it.

 

Next person arrived needless to say no parts, stayed with him while he filled in a parts list request form,

the same person came back 7 days later, and as my wife opened door he stated he had wrong parts (honest i would not joke) got in his van and drove off.

 

Thankfully i was at work.:mad2:

 

So they then phoned me the other day and stated i would owe them £160 because the work they have done is over my £500 limit.

 

I calmly asked to see a statement of work done and parts fitted, to which the reply was the stock

i am only a call center person i dont have that info on my screen.

(written on a postit note stuck on side of moniter) believe me ive seen these notes.

 

One more thing my B & C insurance is with the halifax who do not admit any responsibilities towards homeserve and state my money is paid to homeserve not them.

Argued the toss with halifax stating my direct debit says otherwise and they recommend homeserve and the fact they are virtually using homeserve as subcontractors.

 

Also said they had no means of lodging a complaint about homeserve.

 

In the end they put in a complaint to homeserve for me.

Have had two letters so far Yippee.

Boiler not fixed yet though.:mad2:

 

I wasnt going to put this much detail in but its good to vent now and then.

ps.can i get a written transcript of phonecalls and work done from homeserve.

Fedup1962 welcome to The Consumer Action Group community.

 

You haven't received any replies to your problem yet so you might be better off posting your story again directly in the sub-forum which deals with your kind of situation. You will get lots of support there.

 

Also, spend some time looking round the forum. Once you understand the layout, you will be able to get best use from this Consumer Community. It is a big forumm and may take some time. But it will be worth doing.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Send a Data Subject Access Request to get the transcript of phone calls.

 

I have recieved a letter from Homeserve, convincingly dressed up as a letter from Vaillant, my boiler manufacturer, offering a tempting boiler breakdown cover etc. It is extremely misleading as I assumed it was from my boiler company. I rang them to confirm the quote they offered, and they went on to try and collect data from me (obviously for the purposes of marketing) and after a while it became clear who they really were. I then rang Vaillant, who offered me the same policy for nearly half the price.

 

As a cagger, I have learned that I should expect to recieve what I am sold and no less. Just spending a little bit of time poking around Homeserve online shows that your story is not unusual - infact it appears to be the norm. Of a turnover of over £350 million last year, the company made a profit of £100 million and this staggering result will in part be down to their ruthless extraction of money from customers while minimising the service provided.

 

There is a very good article in the Guardian about this company (and similar) in which they quote Which. 90% of households would be better off putting the money in a bank account each month rather than using Homeserve as the service they provide is poor and the cost of their premiums is very high.

yes you can ask for a SAR, they may charge. But dont worry by the sounds of it they could be facing some steep compo. The letters are pretty much system generated and it is easy for them to fob you off with non compliant resolutions. You have a letter of resolution, best bet is get it fixed at your own cost, fill in FOS application form, mark down all facts of inconv no heating or hot water for the amount of days. There will be a charge of £500 to the business (dont let Homeserve know you know this) write down how many days off work, forwrd copies of your own engineers reports and Homeserves. Write a letter of complaint to Halifax aswell. they are also regulated so they dont know what they are on about. Over time you will see that Halifax will pursue. As a rule its about £400-£500 per month for no heating or hot water. around £50 for days taken off work. The truth is they dont have enough contractors to complete the work. Also email [email protected] of your intentions to go to the regulator or phone up the complaints dept direct and demand to activate your escalultion rights. Ask to speak to the Head of the Department. You will be suprised with the threat of legal action, they have circa 9000 complaints and wont want the media and legal attention.
