Have the poops actually got any civil servants to agree to go yet - probably end up as more massive payments to VIPal contractors to go and sit there doing nowt shortly eh?    
    • Hi Wondered if I could get a little advise please. I entered into a commercial lease (3 years) and within a few months I had to leave as the business I was trading with collapsed. I returned the keys to the landlord and explained the situation and no money, also likely to go on benefits but the landlord stuck to their guns. They have now instructed solicitors to send letter before action claiming just over £4000. The lease was mine and so the debt. I know this. I have emailed the solicitors twice to explain I am out of work and that with help from family I could offer a full and final settlement figure of £1500 or £10pw. This was countered by them with an offer to reduce the debt by £400, or pay off the amount over 12 months. I went back with an improved full and final offer of £2500 or £20pw. This has been rejected with the comment 'papers ready to go to court'. I have no hope of paying the £4000 and so it will have to go to court. Pity as I have no debts otherwise but not working is a killer. I wondered if they take me to court, could I ask for mediation? I also think that taking me to court will result in a pretty much nothing per week payment from my benefits. Are companies just pushing ahead with action even if a better offer is on the table? Thanks for your help.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyonehaving posted on here several times i am dealing with my debts i have payment arrangements in place now for several payday loans,i recieved a ccj from tower capital but have nearly paid that off,i am paying regularnow to:

wage day advance

payday express

txt loan

cash genie

1 month loan

My problem is quick quid and wonga

This morning recieved a letter from quick quid saying they are sending a collector round,now i have tried to come to an arrangement and offered £40,i owe £900,now i realise its not much but as i have come to arrangements with others and they have accepted my proposals i explained i cannot pay any more,they simply wont listen,are are they likely to send somebody round? it mentions a specific person on the letter who i have to speak to but i dont want to phne so again emailed my proposals.Does anyone have any advice or experience with these?

QQ will offer a payment plan over 6 months at a push but I guess this is still too much. As for QQ or a DCA threatening a doorstep vist, read below link which was gently lifted from the CAG library:-) Just modify for your needs and send it to QQ or DCA they may pass the debt onto.

Having re read the letter again i notice its from somebody csalled MERIT FORCE,DOOR STEP COLLECTION,does anyone have any experience with them,im a little worried they are going to turn up whilst im at work and speak to my hubbie(he doesnt know about it )

they arent coming, trust me, 10000000%... wait for the DCA and pay them directly. try not to ignore phone calls it will speed up the process and stop them from calling your home or work if you answer the mobile. keep repeating your offer and leave it at that. QQ are not sending someone over, they cannot and neither are they taking you to court. so sleep easy!!

I see most people on here think mackenzie hall dont procced with legal action, i have been registerd for my first CCJ (county court judgment ) because of them and they have been in touch with my employer to get an attachment of my earning. My quick quid pay day loan was £800 and i offered to pay £50 per month but they wouldnt except. Now my name is on a public register and I cant get any credit fo some years, also peolpe from work are now talking about me because of this. So just letting peolpe know mackenzie hall can do this.

MERIT FORCE threatened to come round,im unsure if they will but hope they doint,im not ringing as its an 0844 number i tried to contact them but no response back,i just want to sort this out but can only afford £40 ,my debt is £600 original loan and interest,it now stands at £900!!!

I agree doorstep collectors are probably unlikely but, just to share my own experience, I lived in a lot of fear under the threat of them showing up and my other half finding out. I eventually came clean to him and it wasn't pretty, he was understandably furious, but I'm still glad we had those conversations - honesty is important. I completely understand if your circumstances are different but I'd recommend biting the bullet if you can; I sleep a bit easier knowing I'm not alone in this mess.

 

While I'm a massive fan of these message boards, I personally find the info on the National Debtline site a bit easier to navigate when it comes to info on the legal processes. I think the main thing is to repeatedly make your reasonable offer and include a financial statement so that they can see what you've got available. That way, even if they do take it to court - which is a risk to them as some charges might be denied - the judge is likely to look more favourably on your case as you have been the one making an effort to sort things out before court. Plus, court orders to pay can be varied at any time by filling in the relevant forms.

 

Also, QQ might pay more attention if another organisation is involved. I know that CAB and other known sources of advice are overrun right now but many people aren't aware that Shelter - the housing charity - also does debt advice in certain areas and could possibly advocate on your behalf. It's usually only available if your income qualifies you for legal aid, but worth checking out the 'find an advice service near you' bit of their website in case they can help. They also do a lot of phone work via Community Legal Advice but, again, you need to be eligible for Legal Help/Legal Aid.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

What an interesting first post and very unusual experience you've had.

 

So how much a month are you having to pay now? I'm sure that if you couldn't afford the full amount the court will have take this into account and looked at your income and expenditure.

 

Frankly, I suspect that for a lot of people who resort to payday loans their credit file is probably already trashed or they'd borrow from a more conventional lender.

 

I suggest that you put in a grievance if your employer or payroll department have been discussing your private information. It's a breach of the Data Protection Act. Where I work attachments of earnings only go to the payroll department and if it was discussed we'd face disciplinary action. If you need help with this then I'm sure you could find help in our Employment Forum.

 

I'm so glad that you've found CAG now because there's a lot of great advice for people which helps them deal with problems. It's very empowering.:-D:wink:
