Hi all,

wonder if anyone can help.

I have found myself in a payday loan hell. i have 13 different payday loans and have set up 12 different payment plans all on e-mail and agreed.

 

the problem im having is with
minicredit i took a loan out with them last month and they are not listening and do not want to set up a payment plan. I have been e-mailing them asking to set up a payment plan but are getting nowhere. i asked them to put a hold on all charges and interest but as you can imagine they will not and its going up each day.

should i call trading standards? and ombudsmen? any help would be much
appreciated.

Hi, i wouldnt say getting the ombudsman involved at this stage would help at all. I would say that you have been looking into bankruptcy as the situation is so bad and would like to pay them off before the order comes into effect. This might scare them into accepting a plan and i think its worth a try, give them a decent offer and see what happens, keep us posted...

The fact is if they can't access your funds they will have to negotiate otherwise they don't get paid. I have not seen much of this lot but they are known for being quite rude on the phone. You may have to play a waiting game with then until they are reasonable with you. They can add what they like to the loan but does not mean you have to agree and pay it. I doubt they will go to court to try and enforce it.

They may be, but how will they enforce it if you refuse to pay? Most of these companies will back down and agree a fair settlement. The loan plus a months interest is often considered reasonable. If they go to court you can demonstrate to the judge that you have tried to be reasonable.

 

Personally I would tell them (in writing) that you do not accept their charges/interest and will not pay until you reach agreement. Keep records of all e-mails letters etc.

 

Personally I would say see them in court if they wish - not for everyone of course.

Yes got same problem with these, they seem to ignore every email I send, or if I get a reply its is an automated one. Received a letter from them yesterday saying they were sending round a door step collector between 26th and 2nd November 2010 and charged me £100 for the pleasure!!!!:-x I have sent theym so many emails I have lost count, also one stating that I do not give permission for them to attend my property. I have been making token payments but not even an acknowledgement of these. Oh well I least I know I have made every attempt to try and resolve this. ****ing hard work tho!!!

got an e-mail from these people last week stating they will get doorstop collectors involved.

 

sent a few e-mails now but still no reply

 

They can send who they like round, doesn't mean you have to talk to them. Very unlikely anyone will turn up and if they do tell em to get lost. As for the charge just refuse to pay it.

They are NOT allowed to charge for sending a doorstep collector round, the collector has no legal standing and can be told to go away.

 

These need reporting to the OFT because charging for debt collecting or counselling is against their guidelines.

I am currently having same problem with Minicredit. I am trying to repay them, but wont pay there charges. They have applied 3 charges to my account. I have told them ill pay at once original loan plus interset accrued. Getting no joy and threatening legal action. How are you getting on. Im new to this site, if ive posted wrong!

loan taken out on 6th Sept. they are wanting 200 plus 25 plus 55 plus 100 in charges and all interest. whenever you ring you seem to speak to a woman called Chris, who wont budge or come to any agreement other than what they say you owe. is it likely they'll go to court?. have you had any joy with them at all?

im not sure robbo, my balance is going to be £750 at end of november for a £300 loan in sep and im just gonna pay it as im fed up with there bully tactics and really dont need the hassle from them. out of all the payday loans i have had (13 in total) these have by far been the worst. anyone reading this just stay well clear of these guys they are complete loan sharks

You can challenge the amount they claim by defending the original sum borrowed and one months rolllover fee, it won't 100% be a CCJ if you defend, odds on they will run away at allocation stage or even discontinue their claim completely. It has happened quite a bit on this site.

 

You MUST defend a CCJ claim against you, it takes away THEIR only power over you and makes them think twice....
