    • You can't, but you can (and really should) bring up the point that the lender isn't meeting their legal obligations in selling the property for fair market value. You'll have to do this in court, though.     A receiver is bought in by the lender, not you. If they're a registered insolvency practitioner, you may be able to raise a complaint to the insolvency service but there are no guarantees here.     • Lolerz - I don't understand you.  Rebuked you?   No. I simply replied to your orange comments with legal facts as I know them.  I've already worked through the s42 and s146 issues - over the last 3-4y - and these issues are (mostly) resolved legally.  In terms of posting evidence.  Sure I can post some.  But my most recent questions have been a) how can I enforce a sale before trial?  And b) how can I make a complaint and/or a claim v receiver? (E.g. to which body do I complain?).  At the mo I'm asking for some helpful pointers on those specific questions??  I'm not asking for help with how to prove or present evidence. Fwiw - all evidence for trial has been disclosed (although additions are poss). The lender sent me like 10,000 emails and docs.  There's also 000s of emails, docs, photos, videos, recordings and texts that relate to freeholders/ me.   I read, filed and categorised everything for ease of future reference.  Witness statements and evidence were prepared for trial in the 42 and 146 matters. (now joined with current claim to save duplication).  I've lived the process before.  My current statement and linked evidence has taken like 6 months to draft/ write - to ensure I can succinctly prove my defence and counterclaim points.   Whether I can convince a judge at trial w/o lawyer / barrister is debatable 🙄   But I've prepared.  And continue to try better prepare - which is why I visit this site (and clinics).  This is NOT my business or expertise at all.  I'm just trying.  Not that anyone should ever have to justify why they need help if they ask politely!

    • It doesn't use the word reconstructed in the cover letter.  Although, I have just noticed on the cover letter they have asked me to complete a financial statement and offer a repayment within the next 10 days, or they will continue to follow court directions.  They sent a separate letter on the same day advising me they will be continuing with their claim ?  They have done the same for both claims.  Is it worth just doing that - doing the financial breakdown and offering a x amount.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

 

We are sick to death of some of the Debt Collection Agencies harrassing us for debt that I have not run up - but a relative of mine, who has a similar name.

 

We have answered their cards and called them, explained that I am a different person to who they are looking for, but yet, 1 month down the line we then get a threatening letter from them demanding monies owing.

 

It is frustrating that we explain all this to them and then we still get the letters. A previous one - going back over a year now, basically called me a liar - which I am genuinely not. So now due to having to spend my time researching their "target" and doing their job finding where they now live, I have invoiced the current one for this time and have stated that anymore time spent on dealing with this will incur further charges.

 

How can we stop them? I have explained that I haven't spoken to them in over 6 years and gave them all of the information I could have given as I moved away and so did they. If I can do the digging around and finding out where they live, why can't these companies do this?

 

This is causing no end of stress on myself and my wife.

 

Can anyone shed any light on this before, it gets all nasty.

Well...... Westscot SPV at Hull (which trying to locate them showed up your page and how they have not conformed to the CCA) and IND at Stamford.

 

The one last year unfortunately, I cannot remember their name - but I could have swung for them.

Yes - Westcott, I think it is? are idiots - do not know the others. You need to start reporting them to the appropriate authorities. Best to start with Consumer Direct helpline and ask them to report to Trading standards also the OFT, you can report by email and post.

 

Send a strong letter headed COMPLAINT to the muppets saying this has nothing to do with you and that you have reported them. Do not acknowledge that you know the person or try to help them find them - just say that this is not you.

 

NEVER ever phone them, put everything in writing with a 'Copy to:' heading quoting Trading Standards and OFT.

You should check your credit reports to ensure that they have not registered any association between you and this person and take it up with the CRA if they have. You need to state that you have no financial association with this person.

 

It is not too late to complain as these people are harassing you and this is what you are complaining about. You have told them the truth but they are taking no notice and you want them to leave you alone. Do you know which company they are collecting the debt on behalf of as you can complain to them also and tell them to call the vultures off?

Guess you don't like this relative of yours much if you went to the trouble of tracing him/her down for them. (Sorry, just saying that in jest) :)

Would you like my family, instead? There are reasons I don't invite them to my house for example. :D Best shot of them, so I know how you are feeling all too well. You can pick your friends, but not family as the old saying goes. ;)

 

PS I wouldn't wish them on anyone. Well, maybe a few DCAs I would.

Don't forget to check your credit records to see if these companies have noted your record in error. Experian, Equifax are the main ones and there is also Call Credit. Worth checking all, as records do vary. All offer a free trial if you remember to cancel.

 

I have been in this situation. You have to write to them by recorded delivery with the relatives address and phone number if you have the info. But be prepared to still receive communications if your relative does not cooperate with these companies. Your address is noted against the relatives credit record, so until the address is updated on their record you will be hassled.

The other thing here is - and I have also found myself in the same position, but not a relative, though I knew where the person on the letters sent to where I lived at the time had moved to because of how well I knew the area I lived in ie semi-rural, small communities and so on; this was a very long time before I knew anything about anything of much use to the situation, the more I did the more they just kept sending them, the only thing they didn't have was my new telephone number, as the phoneline had to be physically reattached to the house I lived in - the more you contact them the more they will hassle you. They are a bit like piranhas, won't let go.

 

But complain as already suggested.

Personally I would just return their letters unopenend with not at this address written on it, why stress out over it, not your debt not your problem, let the fools waste their time trying to find people dont do their job for them, and if you do open it then use their envelope and sent it back minus a stamp of course

My brain appears to have fallen out lately, either that or I am thinking too much but I totally misssed suggesting what PG did. It's what I did in my situation, in fact I tore a load of them up in the end, as the DCA just wasn't getting the message when you wrote on the envelope 'not at this address'. Not my problem.
