As the account was set up prior to April 2007, the CCA 1974 applies, which means the creditors/assignees need the credit agreement to pursue this in court. They have admitted that they don't have it.

 

Options.

 

Keep batting this away, by not responding/disputing the debt. Wait along time for the debt to become statute barred. Keep an eye on the post to make sure they don't get a CCJ by default(you not defending). Of course this will affect your credit record/rating.

 

or

 

On the basis that no agreement is held, you could look at negotiating a reduced full and final settlement.

No CCA = No pay.

 

Tough cheddar for them, they have shot themselves in the foot for being so incompetent.

 

As for continuing to process your data when they haven't any legal documents to do so, report them to the ICO for this have a read; DCA breach Howlers!

 

As they have issued you with their final response letter, a complaint to the FOS is a very good idea also.

 

As for them foolishly passing on a disputed account, all you need send Lowlife Farcical is

I have no legal training, any knowledge I have has come from this forum, and my own experiences. Always balance up any advice you get with your own common sense.
