Hi All,

I have send Grattan a CCA request AND the template about telephone harrassment.

They have ignored both and are calling me about 10 times a day.

Sometimes at 8.30am and 8.00pm.

Just 5 minutes ago when I told the girl on the phone to stop she 'threatened' me that the the calls would continue until they got paid.

She also said that they had recieved no letters AND admitted they were using an automated dialling system!

The balance is around £40.

How can I report them?

Thanks,

RI

You have to follow the compainies own complaints procedure, do this by requesting it in writing (recorded delivery).

Also, get TS involved by calling consumer direct who will also pass your concerns to the OFT if you request it.

I would do a couple of things...

Send them this

http://www.consumerforums.com/resources/templates-library/86-debt-collectors/590-letter-used-when-a-dca-threatens-a-doorstep-visit-.html

taking care to read this

http://www.consumerforums.com/resources/templates-library/86-debt-collectors/591-dca-home-visit-if-you-receive-or-are-threatened-with-a-doorstep-visit-

and also inlude a seperate letter reminding them of thei obligations under the Debt Collection Guideline as set out by the OFT ...found here...

http://www.oft.gov.uk/shared_oft/business_leaflets/consumer_credit/oft664.pdf

Section 2.2 F & G would apply, there may be other sections you might find applicable also.

All correspondence sent to them send recorded delivery.

I reside in Dawlish Warren but am not a rabbit.

Did you send the request by recorded delivery?

Have you got proof of posting, did they receive?

If not put in the CCA request again.

If you have send the account in dispute letter recorded delivery

Report them to TS and OFT.

If nothing comes back you are then in a strong position to with- hold payment or offer a F&F of £10.

Send thehttp://www.consumeractiongroup.co.uk/resources/templates-library/52-harassment/135--harassment-by-telephone-response-letter- tel. harrassment letter

I have no legal training, any knowledge I have has come from this forum, and my own experiences. Always balance up any advice you get with your own common sense.

If you have a BT line (I don't know if other networks offer this) you can get their "choose to refuse" service which blocks the calls. It costs a little, but I have found that it is more than worth it for the silence!

Good luck

If you have online access to your account, go and change the number to a dummy one.

If you don't have online access, call the regular number and advise them of the change of tel no, they will quite kindly change it on the system, hey presto, no more phone calls! :-D

(You will get letters saying they tried to contact you and couldn't and it is urgent you contact them to discuss your account, though!!! :-D)
