hi can anyone tell me if a baliff can charge 120.00 waiting time.

this was charged on my account on the same day i paid him in full to clear the account it was for council tax debt.

no a bailiff cannot charge waiting time when collecting council tax debt

 

 

there is no such fee in the

THE COUNCIL TAX (ADMINISTRATION & ENFORCEMENT) REGULATIONS 1992 (amended)

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

do you know what other charges were added to your account

do you know the amount of the liability order (confirmed by the council)

do you know the date the liability order was passed to the bailiffs

 

 

once you find out if all other fees charged comply with the regulations

 

write to the bailiff company (copied to council) asking them to return the unlawful fees within 14 days or you will take them (and the council as co defendant) to the small clam's court for the return of the fees + interest

hello hallowitch, i know the date and amount of the liability order the full amount was paid to the baliff the same day he applied the waiting fee(120.00) after paying him a couple of weeks later i rang rossendales for all account info,when received thats when i noticed the waiting time fee, if they have acted unlawful and are not allowed to charge this i am going to cause a right stink up and think this would be a good story for my local paper to let everyone know what kind of thugs the coucil use any more help with this would be much apriceated.

think you would have to take them to court to get the fees + interest

 

you go through there complaints procedure first ask them to return the unlawful fees if they refuse then you take it to court

 

and please make a formal complaint to the chief executive of the council

A simple route to take is:

 

1. Ask them for a breakdown of their fees, sample letter at end.

 

2. When answer received come back for help and advice.

 

3. If wrong send copy of N1 Form to Bailiffs and Council demanding repayment.

 

4. If 3 not received within 7 days issue N1 at County Court.

 

Sample breakdown charges - adapt for your own use and send by email and letter.

Dear Sir

 

With reference to the above account. Can you please provide me with a breakdown of the charges including Computer Screenshot. I require this information within 14 days.
