    • Hi all! I've now had a "final notification letter" through from ECP. I assume I should continue to ignore this, but is there likely any action I need to take? Do you need to see a copy of the letter? Thanks
    • Please will you upload the defence in a PDF format document
    • Afternoon All - after 3 weeks of silence, this morning I received an email from HMCTS advising that P2G have rejected my claim. Decide whether to proceed Parcel2Go.com has rejected your claim. You need to decide whether to proceed with the claim. You need to respond before 4pm on 25 June 2024. Your claim won’t continue if you don’t respond by then. This is their ‘defence’ Their defence Why they disagree with the claim When choosing a service on the Defendants website, the Claimant chose to book their order with Evri and selected to take out £20 parcel protection which comes with the service. On the first page of the booking process, the Claimant entered the value of £265 for the contents and was offered parcel protection for loss or damages against their goods for £13.99 + VAT. The Claimant selected no, which then produced a pop up which explained 'We strongly recommend that you protect the full value of your item(s).' however, the Claimant still did not take this protection out and instead continued with the booking process. At the end of the booking process, the Claimant was offered this again which was refused and the Claimant continued with the booking by accepting the terms and conditions which re-iterates the information provided in the booking process. The parcel was sent, however, seems to be delayed in transit. The parcel finally started to track again, however, when delivered the parcel was empty with no contents. As such, the claim was re-opened and attempted to be settled for the £20 protection taken out in the booking process. This was refused by the Claimant as they felt they should be paid the full amount of the value entered when booking. Unfortunately, due to the refusal of the parcel protection in the booking process the Defendant is not liable to settle the claim to the value and only to the parcel protection taken out. The Defendant shall rely on the Terms and Conditions of carriage in particular section 9. The Defendant understands that the contents have not be handled with due care and attention, which is not being disputed, however, they are disputing the amount they are liable to. They have requested mediation, I’m sure not least to drag the case out even longer, but I can see no benefit to me in this and so shall reject it. As ever, I’d welcome your thoughts guys. g59
    • I doubt HMCTS holds any data on whether arrests by AEAs required police assistance.  They couldn't or wouldn't provide data on how many of warrants issued were successfully executed - just the number issued!  In my experience, arrest warrants whether with or without bail are [surprisingly] carried out with little or no fuss.  I think it's about how you treat people - a little respect and courtesy goes a long way. If you treat people badly they will react the same way. Occasions when police are called to assist are not common and, having undertaken or managed many thousands of these over the years, I can only recall a handful of occasions when police assistance was necessary. On one occasion, many years ago, I arrested and transported a man from Hampshire to Bristol prison on a committal warrant. It was just me and he was no problem. I didn't know the Bristol area (pre Sat Nav) and he was kind enough to provide directions - seems he knew the prison.  One young chap on another committal warrant jumped out of his back window and I had to chase him across several garden fences.  When he gave up (we were both knackered) I agreed to drive by his girlfriend's house to say farewell for a while.  I gave them a few moments and he was fine. The most difficult are breach warrants but mainly in locating the defendant as they don't want to go back to prison - can't blame them.  These were always dealt with by the police until the Access to Justice Act transferred responsibility from them to the magistrates' courts. The fact was the police did not actively pursue them and generally only executed them when they arrested someone for something else and found they had a breach warrant outstanding.  Hence the transfer of responsibility.
    • thats down to mcol making that option available for you to select, you cant force it. typically if there are known processing delays at northants bulk it will be atleast 14 days later if not more.

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Oh my GOD!

P45 nice snipe :)

When welcome is gone, Ill be still helping you spongers wipe your arses. EAT ****

I presume your stars should read "Eat Well" as thats what most people on here will be doing once they get Welcome out of their lives.

No point asking God for help either.

I read this as though you are deluded into thinking that as a Cattles employee you are somehow safer than Welcome.

Newsflash, its ALL going down the pan, you included, have a large slice of humble pie, stop proving to everyone that not only are you a fool but you are ignorant too.

If you don't PM Mark then feel free to PM me.

Oh and by the way isn't it a sackable offence to post on here? Just a thought!

See you are Lurking there in the background then bailliff2. Not a word to be said then? Well , not one you can spell!!!

It would be a Revelation to you if you PM`d Major Player!!! He was one of your bosses at Welscum/ Cattles. He saw through their Bull to how ALL the staff had been tricked, lied to, deceived and generally Brainwashed by these ****!!!

Why do you think you have been told NOT to come to these forums? It isn`t because some unhappy customers may find out who you are and were you live, the way you have been told. It is because they don`t want any of the staff hearing and seeing the TRUTH!!!

Cheers, MARK

Bailiff, have you hit your target yet???? If you had worked under me, you would be out of a job, completely unprofessional and such a poor atitude.

By the way, the suits keep an eye on forums like this, don't be surprised if the company starts to issue communications about inappropriate behaviour - consider your card marked - think i remember you saying you had a new job, would they take you on after being sacked for gross misconduct?

You can call the customers all you like but ultimately if they did not exist you wouldn't have a job - I'm sure that situation will right itself in the near future and you will appreciate how offensive it is to defame people for being out of work - there are about 3 million people who would have something to say to you

I'll let Mark respond to you as hes much better at expressing himself than me but needless to say if you did your research you would find out just how wrong you are in calling him dole ****.

Good luck with your life, you won't get far with such an ignorant outlook.

mark1arby have you paid this months payments yet????

Or are you off down the races this week

DOLE-****

Eloquence is Certainly NOT Required with this NOB!!! What A *ANKER!!!

How old are you bailliff2?

I suspect that you are the same age as some of the young MEN and WOMEN who are losing their lives because of something they believe in. And they are not scared of having the right ethics to enable them to do this job. What have you DONE Today to Make You Feel Proud????

You are sat one finger typing bcause you have your miniscual ****** in the other hand. T:pSSER

We could carry on doing this for the rest of your life if that is how you intend to spend your time. I am retired from a worthwhile job that I loved and did for a long time, willingly. So the time I have is My Own to do with as I please, I have most Certainly Earned it.

I can say with TOTAL and Absolute Certainty, if you had ever done the job I did, You WOULD have been SHOT or THROWN OVERBOARD by your Own Side. In a VERY Short space of Time. Which is Probably Exactly what the Other *ANKERS who Have to Put Up with you are Wanting to Do To You.

You are typical of the Monkeys who are employed by Welscum. Of Low Intelligence, so you are easy to manipulate ( were you told the stocks you were buying in this **** company would be worth a mint?), and of NO Morals which enables them to pick you from the Mob as they can easily Train you to be one of THEIR MONKEYS ( Working for the Man).

I have MORE Respect for a Hong Kong Whore than I do for your kind! You are the SAME as AIDS, Everybody Knows What You Are, But NOBODY Wants YOU!!!

NOW Please go and moan with the rest of Unwanted on the Cattles Investment Forum at iii.com/ co.uk

Folks, folks, folks!

Why lower yourself to his level?

I read all the posts on here and I am shocked at the mob mentality and the language used. How is that helping? You are making yourselves no better than him and he is laughing at you because he's managed to get a rise out of you!

By all means respond, but respond using the legal arguments amongst which he is completely powerless, trading insults is only going to make him more determined to stay on to wind you guys up.

We on CAG always have tried to keep up certain standards and I must say that seeing references to small genitalia etc is not something I am proud to see. I also know it is a breach of forum rules and I personally hope Mr Lex finds his CAGbot ASAP. Come on you lot, you can do better than swearing at someone whose mental ability is so obviously challenged that he is no match for any of you!!! ;-)

Point Taken! It`s Sometimes difficult to throw of 24 years of Naval Training!

I do think though that it is more than needed to get down to their level at times.

I apologise for any offence. Against Forum Rules, I apologise for that also.

I do think that bailliff2 has now gained More satisfaction from those last few posts than ever he could from a few simple 4 letter words. That are in Common use now days.

With Great Respect to You and other Caggers. Could the point not have been made by PM? Allowing me time to edit the post.

I wasn't talking to just you, Mark, but to people in general. Also my PMs are switched off, and what I wanted to say, I felt needed seen by everyone.

24 years of Naval training, huh? well, I was a mod on here for over 3 years and I guess some habits die hard. ;-)

No apologies needed and no offence taken (by me at least). As for the soon-to-be-ex-employees, my experience of trolls is that they thrive on the attention-seeking and soon get bored and move on when ignored. The fact someone has drawn their attention to the fact their superiors may be monitoring them and won't appreciate their posting on here is probably going to have an influence too.

When I was still a mod, we had one DCA employee who used to log on CAG at the beginning of his shift, then at lunchtime and again briefly before signing off, thinking he was safe behind the anonimity of his screen. Unfortunately for him, I was able to trace his IP, and told him that I wondered what his manager would make of his misuse of the work computer, and pointed out it would be very easy for the manager in question to find out who within the company was logging on here. His last post was on the line of "yeah right, as if I cared, go ahead..." and then disappeared forever. :-D

Trolls thrive on disruption and attention-seeking. You ignore them or refuse to engage, they soon go trick track back under their bridge. ;-)

24 years of Naval training, huh?

I do realise the respect you are held in on CAG. I myself have read many of your posts, and have always found them informative. How ever, again with respect. What is the above supposed to infer? Or is it that you did not understand my meaning about 24 years of Naval Training?

When I said I was in the Royal Navy I wasn`t looking for CAG points or expecting sharp intakes of breath. It is just a fact I thought pertinent at the time.

Cheers, MARK
